RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF A 16' X 306' STORM SEWER EASEMENT
ON AN UNPLATTED LOT BOUNDED BY ASH, MOBILE,
NEWELL AND WEBSTER STREETS, NORTH OF 805
ADAMS STREET AS MAY 3, 2010, AT 5:30 P.M. IN
CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA
AND INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5:30 p.m. on the 3rd day of May, 2010, for the purpose of
considering and acting upon a proposal to vacate a 16' x 306'
storm sewer easement on an unplatted lot bounded by Ash, Mobile,
Newell and Webster Streets, and legally described as follows:
Commencing at a point on the East line of Mobile Street
which is Two Hundred Nineteen (219) feet South of the
South line of Newell Street; thence Easterly to a point
on the West line of Ash Street which is Two Hundred
Nineteen (219) feet South of the South line of Newell
Street; thence South along the West line of Ash Street
a distance of Sixteen (16) feet; thence Westerly to a
point on the East line of Mobile Street which is Two
Hundred Thirty-five (235) feet South of the South line
of Newell Street; thence North along the East line of
Mobile Street to the point of beginning, all in the
City of Waterloo, Black Hawk County, Iowa;
For the purpose of constructing, operating and
maintaining a storm sewer, through and under said strip
of land upon which said easement is located, together
with a right of ingress and egress to said strip of
land.
Storm Sewer Easement Filed for Record on June 24, 1971,
in Easement Book 4 at Page 44, with the Black Hawk
County Recorders Office; subject to a newly submitted
25' x 306' storm sewer easement being dedicated and
recorded.
Section 2. That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 19th day of April, 2010.
