MINUTES OF THE WATERLOO BOARD OF ADJUSTMENT MEETING HELD ON
MAY 28, 2009, IN THE COUNCIL CHAMBERS, CITY HALL
Acting Chairperson Mohr called the regular monthly meeting of the Waterloo Board of
Adjustment to order on Thursday, May 28, 2009, at 4:00 p.m. Board members in attendance
were: Mohr, Goldsberry, and Mixdorf. Members absent were Holdiman and Anfinson. Staff
in attendance was Shane Graham. There was approximately 1 person from the public in
attendance.
I. Approval of the Agenda for May 7R, 2009
It was moved by Mixdorf, seconded by Goldsberry, to approve the agenda as submitted. Motion
carried unanimously.
II. Approval of the Minutes of the Regular Meeting nn April 7)3, 7(1(l9
It was moved by Mixdorf, seconded by Goldsberry, to approve the minutes as submitted.
Motion carried unanimously.
III. Decision Items
1. Request by the City of Waterloo at 707 Park Rd for a special permit to construct a public
building erected and used by the government, and a special permit to construct a marina,
boat rental,or similar use located within the floodway, to allow for the construction of a
new 2,160 SF boathouse building, which would be constructed in the same location as the
existing substantially damaged boathouse.
Graham gave the staff report, noting that The City of Waterloo Zoning Ordinance requires that
a special permit be approved for the new boathouse building,as it would be erected and used
by the City of Waterloo. The Zoning Ordinance also requires that a special permit be approved
for a marina,boat rental, or similar use that is to be located within the floodway.
The request is to construct a new boathouse on the same site where the previous boathouse
stood for 45 years,which would be located within the floodway of the Cedar River. It would
allow for continued use of the park by the rowing club, as well as add a meeting or gathering
place that can be used by the public.
Graham noted that although the boathouse building will be located within the floodway of the
Cedar River, which experienced unprecedented flooding during the summer of 2008, it would
be constructed in accordance with the Floodway District Performance Standards. The proposed
building would appear to meet all of the required standards,which include not increasing the
100-year flood level, not affecting the capacity or conveyance of floodwaters, shall have a low
flood damage potential and shall not be used for human habitation. The new building has been
designed so that floodwaters can easily enter and exit the building, as there would be 9 garage
doors on the ground level that could open during periods of flooding to let water through,
which would not have a negative impact on the capacity or conveyance of floodwaters. The
building would also be located in the same location, as the existing building, so there would not
appear to be any additional negative impacts on the floodway. Graham indicated that the
Planning and Zoning Commission voted unanimously to recommend approval of the special
permit request at its meeting on May 5th 2009. Graham indicated that staff recommends
approval of the request, as the request is in conformance with the Future Land Use Map and
Comprehensive Plan for this area,which is designated as Parks and Open Spaces, the request
would appear to meet the requirements of the Zoning Ordinance, the request would allow for
the continued enjoyment of a boathouse facility by the public, the building has been in the same
location for 45 years, and this request is to construct the new building in the same location,
