NOVEMBER 24, 2009, IN THE COUNCIL CHAMBERS, CITY HALL
Chairperson Anfinson called the regular meeting of the Waterloo Board of Adjustment to
order on Tuesday, November 24, 2009, at 4:00 p.m. Board members in attendance were:
Holdiman, Goldsberry, Mohr and Anfinson. Member not in attendance was Mixdorf. Staff in
attendance was Shane Graham and Tim Andera. There were no people from the public in
attendance.

It was moved by Holdiman, seconded by Mohr, to approve the agenda as submitted. Motion
carried unanimously.

It was moved by Holdiman, seconded by Mohr, to approve the minutes as submitted. Motion
carried unanimously.
III. Decicinn Items
1. Request by Nagle Signs, Inc. on behalf of Taco Bell at 1819 La Porte Rd for a variance to the
32 SF maximum size limit for a menu board sign located in the Highway 218 Corridor
Overlay District, to allow for the construction of a new 48 SF menu board sign, 16 SF larger
than the maximum allowed.
Andera gave the staff report, noting that applicant is requesting to replace the existing 44 SF
menu sign with a new 48 SF menu sign. The Highway 218 Overlay Ordinance allows for drive-
thru menu signs that are no larger than 32 SF in size. The proposed sign will be 16 SF larger in
size, and will consist of multiple colors, including purple, white and gold, matching the colors
of the Taco Bell Corporation. The front of the sign will either be made from plexi-glass or
polycarbonate, and the sign contractor has noted that glass will not be used to shield the menu
board. Currently, staff is revising the Zoning Ordinance to allow for menu signs up to 60 SF in
size within the Highway 218 Corridor Overlay District, and allowance of the proposed menu
sign would still be 12 SF smaller than the amendment being proposed by staff, and the request
would not appear to have a negative impact upon the surrounding area, as well as the corridor.
The property in question has limited visibility from Highway 218, as the proposed menu sign
would be located directly behind the existing Super 8 Hotel at 1825 La Porte Road. Andera
indicated that staff recommends approval of the request, as the new sign would have limited
visibility from Highway 218, and staff is currently working on an amendment to the Zoning
Ordinance which would allow for a fast food restaurant to have a menu board sign up to 60 SF
in size.
It was moved by Goldsberry, seconded by Holdiman, to approve the variance to allow a 48 SF
menu sign. Motion carried unanimously.
VARIANCE REQUEST APPROVED.
