HomeMy WebLinkAbout12/27/2005 MINUTES OF THE WATERLOO BOARD OF ADJUSTMENT MEETING HELD ON December 27, 2005, IN THE COUNCIL CHAMBERS, CITY HALL Chairperson Moine called the regular monthly meeting of the Waterloo Board of Adjustment to order on Tuesday, December 27,2005, at 4:00 p.m. Board members in attendance were: Moine,Holdiman,Anfinson and Mixdorf. Member not present was St. John. Staff in attendance was Aric Schroeder and Shane Graham. There were 2 people from the public in attendance. I. Apprnval of the Minntec of the Regular Meeting nn NTnvemher 97, 200.Fi. Hearing no additions or corrections,Moine approved the minutes as submitted. II. Apprnval of the agenda for December 27, 20(155 It was moved by Anfinson, seconded by Holdiman, to approve the agenda as submitted.Motion carried unanimously. III. Decision Item 1. Request by the First Church of the Open Bible at 100.5 Cnvmme'rrial St for a Special Permit for the establishment of a youth ministry in the existing facility. Schroeder gave the staff report, noting that the area in question, as well as the surrounding area is predominantly industrial mixed with commercial and residential uses. Schroeder noted that the applicant is not proposing any changes to the exterior or interior of the existing building,so there would not appear to be a negative impact on the area. Schroeder noted that the Future Land Use Map designates this area as industrial. A religious facility is permitted in any zoning district upon issuance of a special permit, so the request would be in conformance with the Future Land Use Map within the City of Waterloo Comprehensive Plan. Schroeder noted that the applicants have an existing church facility located at 928 Jefferson St and have recently purchased the property at 1005 Commercial St,which is approximately one block to the north. The applicants are proposing to utilize the property for youth ministry and youth recreation activities. The property in question at 1005 Commercial Street has an existing 7,068 square foot building and parking area located on it. The applicants have indicated that they are not proposing any changes to the exterior or interior of the building, and would use the facility for youth recreation activities, such as pool and other games, and would also use the facility for youth ministries. Schroeder noted that the applicants have noted that there is an existing off street parking area on the property in question, as well as a row of parking along the building within the 8th Street right of way, and have also noted that their main church facility is only a block away, so they do not anticipate any parking problems. The use in question requires 1 parking stall per 4 seats of maximum occupancy per the Building Code, and it has not yet been determined what the occupancy of the building would be. Schroeder noted that the Code only bases the parking stalls required on the area used for activities and not for storage. Schroeder noted that the Zoning Ordinance requires that all religious facilities obtain a special permit, and further requires that any building for such a use be set back from all yard lines a distance of not less than 2 feet for each foot of building height. The building in question is at or near a zero lot line on three sides, so does not meet the required setback. However given the fact that the building exists, and would appear to have similar setbacks to other structures in the area, it would not appear that the additional setback requirements are needed. The Board of Adjustment can approve a variance to the setback requirements and or parking requirements as
