HomeMy WebLinkAbout2010-300-4 /26/2010RESOLUTION NO. 2010-300 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CITY -OWNED PROPERTY GENERALLY LOCATED ALONG THE LEVEE SYSTEM BEHIND MANATT'S SITE AT 84 WEST MULLAN AVENUE FOR $1,189.00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1,189.00, plus costs, has been made by Manatt's, and WHEREAS, a public hearing was held on April 26, 2010, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Manatt's, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on April 23, 2010, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Manatt's to purchase real property for the sum of $1,189.00, and costs, be and it is hereby accepted for real property described below: Description Flood Levee Parcel K That part Lots 4, 5, and 10, Block 1, James Eggers Addition in the City of Waterloo, Iowa, described as follows: Commencing at the most Southerly corner of Lot 4 in Block 1, James Eggers Addition in the City of Waterloo, Iowa; thence North 41009'59" East along the Southeasterly line of said Lot 4 a distance of 30.00 feet to the point of beginning; thence North 42007120" West along the Southwesterly line of property recorded in Deed Book 518, page 131, a distance of 97.51 feet (recorded as 95.69 feet); thence North 25044'46" West along said Southwesterly line a distance of 119.21 feet; thence South 34056158" East a distance of 133.32 feet; thence South 40059139" East a distance of 77.80 feet to the Southeasterly line of said Lot 4; thence South 41009159" West along the Southeasterly line of said Lot 4 a distance of 15.54 feet to the point of beginning. This parcel contains 2,697 square feet. Resolution No. 2010-300 Page 2 Description Flood Levee Parcel L That part of Government Lot 7, Section 23, Township 89 North, Range 13 West of the Fifth Principal Meridian including part of Lots 9 and 10, Block 1, James Eggers Addition and part of vacated Thompson Avenue in the City of Waterloo, Iowa, described as follows: Commencing at the most Southerly corner of Lot 4 in Block 1, James Eggers Addition in the City of Waterloo, Iowa; thence North 41009159" East along the Southeasterly line of said Lot 4 a distance of 30.00 feet; thence North 42007120" West along the Southwesterly line of property recorded in Deed Book 518, page 131, a distance of 97.51 feet (recorded as 95.69 feet); thence North 25044146" West along said Southwesterly line a distance of 202.97 feet to the point of beginning; thence North 61046101" West along said Southwesterly line a distance of 101.00 feet to a point on the Northwesterly line of vacated Thompson Avenue that is 440 feet Northeasterly of the Northeasterly line of Commercial Street; thence North 48054'33" West a distance of 234.49 feet to the most Northerly corner of property owned by Manatt's Inc., recorded in City Land Deed Book 600, page 465; thence South 80028119" East a distance of 53.97 feet; thence South 28004156" East a distance of 41.13 feet; thence South 37025132" East a distance of 56.29 feet; thence South 66031140" East a distance of 123.59 feet; thence South 42021114" East a distance of 38.32 feet; thence South 29049150" East a distance of 39.70 feet to the point of beginning. This parcel contains 5,798 square feet, all in the City of Waterloo, Black Hawk County, Iowa; for $1,189.00, plus costs. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Manatt's by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Manatt's. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Manatt's upon receipt of the sum of $1,189.00, and costs. PASSED AND ADOPTED this 26th day of April, 2010.
