Moved by Getty, seconded by Hurley that the Minutes of December 2, 2002, as proposed, be approved. Ayes: Three. Motion carried. The request of the Police Chief for authorization to purchase two dual radar units at a total cost of$3,584.00 was reviewed. The Police Department has been awarded a grant in the amount of $22,100.00 from the Governor's Traffic Safety Bureau. Included in the grant award is $3,600.00 for the purchase of two dual radar units. A quote has been obtained from MPH Industries in the amount of$3,584.00 for two Python II Series Ka-band Dual Antenna Radar units. MPH is the manufacturer of the radar units presently used by the Police Department. Moved by Hurley, seconded by Getty that said request be approved. Ayes: Three. Motion carried. The Consolidated Urban Revitalization Area Application Form was reviewed. In September 2001, the City Council adopted a form to accompany the Consolidated Urban Revitalization Area. The form adopted a timeline when the applications where due to expediently process the application. The Black Hawk County Assessor's office has recently contacted the city about residents filing their CURA applications a year or so after their improvements. The timeline was adopted to ensure that applicants were turning in their forms, to avoid the municipality from receiving taxes one year and then having them removed the next year. The timeline has caused extra work and problems for the applicants, staff and the County Assessor for the following reasons: 1. The timeline may not allow applicants to avoid using one of their abatement years on a partial value. 2. The timeline can be confusing to applicants who are remodeling, adding on additions, etc. as they may not be aware through their tax bills that they are paying on that portion yet due to reassessments, different levy rates, etc. 3. The timeline can be aggravating to applicants who are doing a phased project, as they will still be assessed as the project commences. Staff was informed by the City Attorney's office that there is no specific statute or regulation regarding what the penalty is for filing late. The timeline form was set up to state the penalties for filing late on a yearly basis. The timeline form coincides with the tax year payments. It was intended to ensure that anyone filing a CURA application would receive at least one tax bill before being ineligible for any abatement. Options suggested by city staff are: 1. Planning staff will still inform people to submit the applications as they take out their permit, but the elimination of the timeline will help applicants whose project runs from one assessment year to another to be able to retain all of the years of the program. 2. If the council decides to leave a timeline on the application, city staff could reword the application to read similar to the industrial application in which the council could grant an extension for a late application if they felt conditions were warranted for such an extension.
