Members present: Tim Luce, John Blitsch, Lou Porter.
Also present: Cheryl Weber, Chris Wendland, Brian Rath, Tim Shea, Larry Smith, Cheryl
Huddleston,Nancy Eckert.
Moved by Blitsch, seconded by Porter that the Agenda, as proposed, be approved. Ayes: Three.
Motion carried.
APPEAL HEARING
The purpose of the meeting was to hold a hearing on the appeal by Brian Rath of the seniority
list for Waste Water Operator classification. Mr. Luce asked Mr. Rath if he wished to have a
closed or opened meeting, and Mr. Rath responded he wanted the meeting to be opened.
Chris Wendland, attorney for the City of Waterloo, presented testimony from Cheryl
Huddleston, Human Resources Manager; and Tim Shea, Superintendent of Waste Management
Services. Commission members questioned Ms. Huddleston and Mr. Shea.
Mr. Wendland placed on file four exhibits for the City of Waterloo, and he explained each
exhibit.
Brian Rath, representing himself, gave testimony on his appeal of the seniority list for the Waste
Water Operator classification. Commission members questioned Mr. Rath.
A recess was held at 10:35 a.m. and the meeting was reconvened at 10:41 a.m.
Mr. Wendland gave a summarization of information presented for the city.
Mr. Rath gave a summarization of the information he presented.
Moved by Blitsch, seconded by Porter that the commission adjourn to Executive Session at
10:50 a.m. Ayes: Three. Motion carried.
Moved by Blitsch, seconded by Porter that the commission adjourn Executive Session at 10:59
a.m. Ayes: Three. Motion carried.
Moved by Porter, seconded by Blitsch that the commission affirm the appeal of Brian Rath, and
that the commission's decision is that Brian Rath should be the first person listed on the seniority
list for Waste Water Operator, and that Mr. Rath's seniority is continuous from his date of hire,
with adjustments as set forth in City Exhibit 1, pursuant to Iowa Code Section 400.12. Ayes:
Three. Motion carried.
With no further business before the commission, it was moved by Blitsch, seconded by Porter
that the meeting be adjourned at 11:01 a.m. Ayes: Three. Motion carried.
