There were no amendments to the agenda.
It was moved by Eibey, seconded by Braun to the approve the
minutes of April 21, 1983. Motion carried.
Under unfinished business, Jim Rodemeyer, Assistant Personnel
Director, reported that Fire Department promotional exams were in
progress with 31 testing for Fire Equipment Operators and 37 testing
for Lieutenant positions on May 24, 1983. Completion of the exams
will allow the Civil Service to certify a list in June, 1983. He
also reported that Iowa State University may be quitting the
business of testing for fire promotional and entrance exams by the
end of 1983.
Under new business, Resolution No. 5-26-83-1 was brought to the floor
for discussion. The proposed resolution authorizes the placement of
certain city employees under Chapter 400 of the State Code of Iowa or
other related matter. Mr. Rodemeyer summarized that the proposed
resolution would extend "blanket - coverage" to those persons
determined to be non-excepted. The determination of those employees
that will be covered by Civil Service will be determined at a later
time. Roger Mogle, Personnel Director, indicated that due to
several law suits, grievances, and a report from the state
ombudsman 's office this action had been precipitated. Mr. Rodemeyer
read the following proposed resolution into the record:
RESOLUTION NO. 5-26-83-1
RESOLUTION AUTHORIZING COVERAGE FOR VARIOUS CITY EMPLOYEES
UNDER CHAPTER 400 OF THE CODE OF IOWA (1983) AND RELATED
MATTERS.
BE IT RESOLVED by the Civil Service Commission of the City of
Waterloo, Iowa, that:
WHEREAS, Section 400.6(1 ) provides that the provisions of the
Chapter 400, Civil Service Chapter, shall apply to all appointive
officers and employees of all cities over 15,000 except certain
designated employees set forth in Section 400.6(1 ) (a-f), and
WHEREAS, all city employees, including employees of city
boards and commissions, were tested in some manner at the time of
their hiring, either orally or in writing or both, however, it is
unclear as to whether or not all such city employees were
subsequently appointed to their present or initial position with
the City of Waterloo from a required Civil Service eligibility
list.
ACCORDINGLY, this Resolution is intended to clarify and
correct, if necessary, the Civil Service status of all City of
Waterloo employees and employees of City of Waterloo Boards and
Commissions.

NOW, THEREFORE, BE IT RESOLVED that the Civil Service
Commission of the City of Waterloo, Iowa, does hereby blanket in
all current non-excepted City employees of the City of Waterloo,
Iowa, and employees of City of Waterloo Boards and Commissions in
full Civil Service rights and standing as provided in Chapter 400
of the Code of Iowa (1983) from the employee's beginning date of
employment with the City of Waterloo, its Boards and
Commissions. This resolution shall have no force or effect as to
sworn Waterloo policemen or firemen since City records clearly
indicate there are no policemen or firemen employed who were not
tested as firemen or policemen and appointed from a Civil Service
eligibility list.
BE IT FURTHER RESOLVED that the Civil Service Commission of
the City of Waterloo shall adopt and develop further
implementation of this action in an orderly manner and/or as the
need arises.
PASSED AND ADOPTED by the Waterloo Civil Service Commission

Vic Kennedy, Assistant City Attorney, stated those employees which
are excepted from Chapter 400. Due to the terminology of those
excepted employees, the job duties of various City Employees must be
reviewed to determine if any fall within the "excepted" category.
Odie Piper, Business Manager for #1127, protested the untimeliness of
the City's undertaking of Civil Service. He stated that this matter
should be undertaken in conjunction with contract negotiations,
particularly due to the seniority clause which exists within the
contact. He stated that he would protest its implementation. He
asked that a plan be set forth, with the assistance of union
employees, before the blanketing in of various employees.
Larry Wandro, Business Manager for Local 844 (Teamsters) stated that
his knowledge of Civil Service matters is limited, but agreed with
Mr. Piper in protesting this action.
Mr. Rodemeyer stated that a detailed plan of implementation
procedures is not possible due to limited staff time and complexity
of establishing examination procedures. He suggested that criteria
for vacant positions be developed on an "as need basis".

W. David Tyler, City Attorney, briefly covered the history of Civil
Service to the point leading to the Commission 's proposed action to
place all non-excepted employees under Civil Service. In response to
Mr. Piper's concern with the contractual obligation of seniority, Mr.
Tyler reported that Chapter 20 of the Code of Iowa states that when
such conflict exists, Chapter 400 prevails. He stated that should
litigation transpire, he would rather defend the city in its
attempt to comply with the Civil Service law than in defending its
non-compliance.
The possibility of "blanketing in" only dispatchers was dismissed as
an alternative.
Commissioners Braun & Eibey stated that they would rather be in
compliance with all non-excepted employees covered by Civil Service.
Commissioners Braun & Eibey stated that they would prefer to be in
compliance of the Civil Service law. Braun reported that the
Commission had anticipated legislative changes in Chapter 400 due to
the obvious conflicts inherit in collective bargaining & Civil
Service; however, none have been or appear to be forthcoming.
Therefore, she felt action was necessary at this time.
It was moved by Braun, seconded by Eibey that "Resolution authorizing
coverage of various City employees under Chapter 400 of the Code of
Iowa and related matters", be adopted. Ayes : Braun, Eibey and
Giesen. Resolution adopted and the chairman assigned this Resolution
No. 5-26-83-1.
The two (2) lists of persons successfully completing the oral and
written tests for the position of civilian dispatchers were reviewed.
It was moved by Eibey, seconded by Braun that the following lists be
certified, with the amendment that the word "with" be deleted, and
the word "within" inserted within the text of the following (see last
paragraph: )

Motion carried.
The vacant position of Parks Superintendent was discussed. It was
suggested that the examination consist of an oral interview with
three (3) interviewers. After discussion, the job posting will read
as follows:

SUPERINTENDENT OF PARKS
DESCRIPTION
Administrative and supervisory staff position responsible for the
daily supervision, coordination and direction of unskilled and
skilled employees in the maintenance and development of park grounds,
facilities and buildings; golf course; levee and non-park turf grass
areas; and city street trees. Assists the director in performing
certain administrative duties including record keeping in areas such
as: time acounting, work scheduling, personnel evaluation and budget
preparation. Routinely inspects grounds, equipment and buildings to
assure a consistent level of maintenance. Develops, recommends and
implements maintenance schedules and standards for park facilities
and equipment. Evaluates and recommends vehicle and equipment
repairs and replacements.
QUALIFICATIONS
Comprehensive understanding of park maintenance techniques,
principles tools and equipment. Ability to supervise and coordinate
a wide variety of skilled and unskilled employees under a collective
bargaining contract. Thorough knowledge of the basic principles
involved in turf grass management; urban forestry; horticulture;
landscape construction; automotive and construction equipment repair
and maintenance. Minimum of three years direct daily supervisory
experience of a comprehensive maintenance and parks program.
Graduation from an accredited college or university with course work
in park administration, landscape architecture, forestry,
horticulture or related fields or any equivalent combination of
experience, training and education judged to meet the requirements of
the position.

EXAMINATION
Oral examination will count as 100% of the total score. An
individual must attain 60 points out of a possible 100 points to be
eligible for the certified list. The oral examination panel shall
consist of a minimum of three people who have expertise in the areas
being tested.
DEADLINE DATE
Eligible candidates must submit a comprehensive resume to the
Personnel Department by 5:00 p.m. , Friday, June 24, 1983.
TESTING DATE
All qualified candidates will be notified of the time, place and date
of the examination.
END OF NOTICE
Advertising of the position will be regional in scope, including
publication in the Minneapolis Tribune. It was moved by Braun,
seconded by Eibey that the above proposal be approved. Motion
carried.
The vacant position of Assistant Planning Director was discussed. It
was recommended that the exam consist of an oral interview panel .
The job posting should also indicate that the opening is a
promotional position and that posting will be in City Hall . It was
moved by Braun, seconded by Eibey that the job posting read as
follows:

ASSISTANT PLANNING DIRECTOR
DESCRIPTION
Administrative position responsible for professional level planning
activities including the formulation and development of comprehensive
plans in the following areas: land use, zoning, capital
improvements, program performance budgeting and census analysis.
Prepares maps, charts, designs and layouts to scale. Involved in the
aquisitions and disposition of city property and easements. Fills in
as acting director.
QUALIFICATIONS
Detailed knowledge of the physical , social and economic implications
of local planning activities, including a thorough understanding of
land use concepts, population density, annexation problems and
performance budgeting. Minimum of three years professional
experience in planning or related field. Graduate with a
Bachelor's Degree from a college or university of recognized standing
with major work in city or regional planning or related field.
EXAMINATION
Oral examination will count as 100% of the total score. An individual
must attain 60 points out of a possible 100 to be eligible for the
certified list. The oral examination panel shall consist of a
minimum of three people who have expertise in the areas being
tested.

Due to the added responsibilities associated with implementation of
Civil Service procedures, additional personnel may be needed in the
Personnel Department. As a result, the Personnel Department was
directed to make a detailed recommendation on staffing for
administration of Civil Service, including salary and job
responsibilities.
The next Civil Service Commission meeting will be held June 22,
1983.
With no further business before the committee, the meeting was
adjourned.
