HomeMy WebLinkAbout11/20/1980 Civil Service Commission November 20 , 1980 Chairman Braun called the meeting to order . Members Present : Braun, Eibey , Randall Absent : B . J . Furgerson Others present : Vic Kennedy , Attorney ; Roger Mogle and Jim Rodemeyer , Personnel Office ; Larry P . Burger , Clerk of the Commission; and Fire Chief, Gerald Olson . Corrections to the October 21 , 1980 meeting minutes were : 1 . Fourth paragraph after the word Commission, strike the word TAKES and add the words WOULD TAKE . Corrections to the October 16 , 1980 meeting minutes were : 1 . Page two (2) , paragraph thirteen (13) after the word and, strike the word TO , and add the words SUGGESTED MR. WEIRES . Motion by Randall to approve the minutes of the October 16 , 1980 (as amended) , and the October 21 , 1980 meetings . Seconded by Eibey . Motion carried. Chief Olson explained that he has one man left on the first certifi- cation list of recruits for the Fire Department and that the second list ' s time limit has run out . Olson continued that the last name on the list is not a desirable candidate because of past work records and with the Fire Department presently having two openings , he would ask the Civil Service Commission to conduct a Fire Recruitment Exam. Rodemeyer reported that the support staff of the Commission could have some of the details for the recruit exam worked out by the December meeting for their approval . Braun asked for an update on the litigation filed by several members from the Waterloo Police Department . Kennedy reported that the Courts filed an injunction against the Civil Service Commission to stop any promotional exams and then the individuals filed a cross petition with the Courts which was unclear to Mr . Kennedy . Kennedy continued that this is where the situation stands at the present time . Randall stated that the Commission would like a hearing on the temporary injunction to either dissolve the injunction or to make it permanent . Motion by Randall to direct the City Attorney to file with the Courts a request for a hearing to dissolve the temporary injunction as soon as possible . Seconded by Eibey. Motion carried. Mogle stated that in regard to the residency requirements that the City places on its employees , this may be in conflict with Civil Service Law. Kennedy explained the history of the requirements of becoming a Civil Service employee . He then continued that the Supreme Court has ruled the cities do have a right to require their employees to be residents of the city . Mogle stated that he interpreted the section of Civil Service Law that deals with the requirements of not being a resident of the City as meaning for the condition of employment . Kennedy stated that he has discussed this with the Mayor and he feels very strongly in support of employees living within the corporate limits of the City. -2- Civil Service Commission Discussion followed concerning some of the procedures that would have to be followed if the entire City were to be placed under Civil Service Law. Braun called for any additional business , there was none . Motion by Randall to adjourn. Seconded by Eibey. Motion carried. Larry P . Burger , Clerk Civil Service Commission Civil Service Commission October 21 , 1980 Special Meeting Chairman Braun called the meeting to order . Members Present : Braun, Eibey, Furgerson Absent : Randall Braun announced that the only two items that the CommissionAtake action on is the certification of the Waterloo Police Chief List and the Cert- ification of the Fire Chief List . Braun then read the following : We the members of the Civil Service Commission certify that the following list of persons meets the minimum requirements as set forth by the Civil Service Commission for the appoint- ment of the Chief of Police of the City of Waterloo , Iowa : Lawrence Dolan Junior Grimm Arnett Davis C . F. Myhr Gil Hansen Dennis Damon Donald Kehoe John Corder Roger Shook Robert Maltas Motion by Eibey that the above list of applicants be certified by the Waterloo Civil Service Commission as qualified to perform as Chief of the Waterloo Police Department . Seconded by Braun. Motion carried. Braun explained that the Commission had not set out a cut-off point for Fire Chief interviews due to the fact that they were unaware of the scoring procedure of the Fire Extension Service of Ames , Iowa. Braun then announced the Fire Chief scores ran from 54 . 32% thru 80 . 637 . Motion by Eibey that any score above 50 . 00% is to be included in the list for Fire Chief. Seconded by Braun . Motion Carried. Braun then read the following : We the members of the Civil Service Commission certify that the following list of persons meets the minimum requirements as set forth by the Civil Service Commission for the appoint- ment of the Fire Chief of the City of Waterloo , Iowa : Ed Paganelli David Wickersheim Gerald Olson Stanley Stapella Virgil Cutsforth Eugene Fortune Melvin Cook Motion by Eibey that the above list of applicants be certified by the Waterloo Civil Service Commission as qualified to perform as Chief of the Waterloo Fire Department . Seconded by Braun. Motion carried. Mayor Rooff then commended the Commission and support staff for the fine job that was done in completing the two lists for certification .
