This Amendment to Agreement for Animal Control Services (the "Amendment") is
entered into as of August 1 , 2022, by and between the City of Waterloo, Iowa
("City") and Cedar Bend Humane Society ("Contractor").
RECITALS
A. City and Contractor are parties to a certain Agreement for Animal Control
Services (the "Agreement") dated as of June 19, 2017, as amended in 2020.
B. The parties desire to further amend the Agreement as set forth herein.
AGREEMENT
NOW, THERFORE, in consideration of the premises and other consideration, the receipt
and sufficiency of which is acknowledged, the parties hereby agree as follows:
1. The Agreement is amended to strike paragraph a of Section 6.2 therefrom in its
entirety and to substitute in its place a new paragraph a, as follows: "Quarantine for animals that
have bitten and are not redeemed by an owner — $175.00."
2. The Agreement is amended to strike Section 7.1 therefrom in its entirety and to
substitute in its place a new Section 7.1, as follows:
7.1. The Contractor shall commence work under this Agreement at 12:01 a.m. on
July 1, 2022 and shall thereafter provide services hereunder until 11:59 p.m. on June
30, 2027. The hold time is three days. Animals with identification are automatically
held seven days at no additional cost to City. The fees to hold stray animals will be as
follows:
7/01/22-6/30/25 $18.54/day $55.62 for three days
7/01/25-6/30/27 $19.10/day $57.30 for three days
3. Except as modified by this Amendment, the Agreement as previously amended
shall continue unmodified in full force and effect. This Amendment may be executed in one or
more counterparts, each of which, included counterparts signed electronically or signed
counterparts transmitted by facsimile or other electronic means, shall be deemed an original and
all of which, taken together, shall constitute one and the same instrument.
IN WITNESS WHEREOF, the parties have executed this Amendment to Agreement for
Animal Control Services by their duly authorized representatives as of the date first set forth
above.
