HomeMy WebLinkAbout08/01/1995 CIVIL SERVICE COMMISSION HEARING Mark Meyer Appeal of Disciplinary Action August 1, 1995 2:00 p.m. City Hall Council Chambers Members present: Bonetta Culp, John Blitsch, Eric Branson, Walter Reed Others present: Police Chief Bernal Koehrsen, Police Lieutenants Jack Stainbrook and Roger Shook, Police Sergeant John Beckman, Waterloo Police Officers Rich Knief, Al Holms, Becky Morgan, Cedar Falls Police Officer John Pedersen, Black Hawk County Deputy Larry Wessels, Assistant City Attorney Sang-Ki Han, Jim Rodemeyer, Cheryl Huddleston Moved by Blitsch, seconded by Branson to approve the Agenda for August 1 , 1995 . Motion carried. Moved by Blitsch, seconded by Branson to adjourn to Executive Session at 2 : 10 p.m. for the purpose of reviewing a personnel related matter. Assistant City Attorney Sang-Ki Han indicated this is an approved reason to go into Executive Session pursuant to Iowa Code Section 21 . 5( 1 ) ( i ) ( 1995 ) . Motion carried. All parties listed were in attendance for all or part of the Executive Session. Moved by Branson, seconded by Blitsch to adjourn the Executive Session at 5 : 10 p.m. and resume the hearing. All Commissioners were present . Motion carried. The Commission members felt they had three options: 1 ) agree to the one day suspension of Police Officer Mark Meyer; 2 ) reduce the disciplinary action to a written reprimand; 3 ) decide that no disciplinary action was warranted. Commissioner Blitsch felt the suspension should be reduced to a written reprimand. He felt that mistakes were made by both parties. He understands that procedures need to be followed for safety reasons but he felt Sergeant Beckman made a mistake in not placing the perceived oral reprimand from the March 1994 incident in Officer Meyer' s personnel file. Commissioner Culp agreed with Commissioner Blitsch. She also felt that Sergeant Beckman took other things into consideration when recommending a suspension that the Commission has not been privy to. Commissioner Branson concurred that the suspension should be reduced to a written reprimand. He also thought that, due to the procedural error in March 1994 , Officer Meyer did not realize this was an oral reprimand. He also felt Sergeant Beckman took into \r account other incidents that happened and that upper management ' s decision was based on Beckman' s recommendation for a suspension. Ex-Officio Commissioner Reed had concerns (questions) as to what Sergeant Beckman took into account when recommending the suspension. He also felt that Chief Koehrsen took other matters into account. Officer Meyer' s perception of what Sergeant Beckman' s discussion with him after the March 1994 incident meant was also a concern. He concurs with the recommendation of the other Commission members. Commissioner Blitsch wanted all parties to understand that his decision was not an indictment on any of the parties; there were just too many extenuating circumstances to be considered; also, that police officers need to be able to act on their own discretion without fear of disciplinary action. Commissioner Reed agreed that the members of the "narcotics unit" face enormous risks and that some discretion is necessary, but he also pointed out that the ultimate responsibility for an individual officer' s decision generally ends up with upper level management and Chief Koehrsen. Commissioner Culp said that the officers present need to understand there is still a chain of command and this decision should not be construed to mean that the Commission is giving permission to go against established procedures. Moved by Blitsch, seconded by Branson to reduce the one day suspension of Police Officer Mark Meyer to a written reprimand. Motion carried. Chief Koehrsen indicated he will make the necessary changes in paperwork reducing the suspension to a written reprimand and will reinstate the lost wages. A written copy of the Commission' s decision will be forwarded to Chief Koehrsen, Mark Meyer, and the Police Protective Association as soon as it is signed. Five employees submitted resumes and were interviewed on June 5, 1995 by a panel composed of Larry Smith, Gary Schellhorn, and Cheryl Huddleston. Moved by Blitsch, seconded by Branson: We, the members of the Civil Service Commission, certify the following list of applicants, who are eligible based upon the examination process as set forth by the Civil Service Commission • for the appointment to the position of Treatment Operations Foreman-Water Pollution Flood Control for the City of Waterloo, Iowa. Jim Rodemeyer gave updates on the following positions: Police Lieutenant The job description and testing criteria were approved by the Commission on March 11, 1995. The position was posted as a promotional and eleven employees submitted resumes. Interviews will be held on July 20-21, 1995. The interview panel will be composed of lieutenants from Sioux City, Iowa City, and Dubuque. Fire Inspector and Fire Lieutenant The Human Resources Committee has not given approval to fill these positions. No further action will be taken until the report from the reorganization committee is completed. Technical Project Specialist The job description and testing criteria were approved by the Commission on April 4, 1995. This is a new position due to the reorganization of WPFC. Thirteen resumes have been received. Oral interviews have not been scheduled. Sewer Maintenance Worker The job description and testing criteria were approved by the Commission on April 4, 1996.
