Motion carried. Moved by Culp, seconded by Juon to approve the May 12, 1994 Minutes as mailed. Motion carried. NEW BUSINESS The job description and testing criteria for Associate Engineer were presented for review. There is a vacancy due to a resignation. Plans are to advertise in the Courier and Register. There is presently an employee on layoff who will be given an opportunity to return but it is anticipated he will not return to this job because it is an entry level position. Moved by Culp, seconded by Juon to approve the job description and testing criteria for Associate Engineer. Motion carried. The job description and testing criteria for Senior Engineer were presented for review. This is a new position although the City had the position several years ago. This position will fill a vacancy as a result of a resignation of an Associate Engineer. The Engineering Department would like to find someone with a few years experience. Plans are to advertise in the Courier and Register. After discussion, it was agreed to change the period of time allowed to obtain the Professional Engineer certification from six months after appointment to one year after appointment. Moved by Culp, seconded by Juon to approve the job description and testing criteria as amended for Senior Engineer. Motion carried. The job description and testing criteria for Traffic Engineer were presented for review. There is a vacancy due to a resignation. The same employee on layoff who is eligible for recall for Associate Engineer is also eligible for recall for Traffic Engineer. A couple changes need to be made in the Civil Service notice. On line fifteen the word, "Construction" should be deleted; also, the phrase "must be able to obtain" should be changed to "must possess an Engineer In Training (EIT) Certification." This position will be taken to the Human Resources Committee on July 5, 1994. Moved by Culp, seconded by Juon to approve the job description and testing criteria as amended for Traffic Engineer. Motion carried. The job description and testing criteria for Associate Planner were presented for review. There is a vacancy due to a promotion. The position has not yet been approved by the Human Resources Committee. There is a Planner on layoff who is eligible for recall to this position. Moved by Culp, seconded by Juon to approve the job description and testing criteria for Associate Planner. Motion carried. UNFINISHED BUSINESS Update on Veteran's Preference For Promotional Exams A letter has been written to Senator Lind asking that he request an Attorney General's opinion on this issue. Former City Attorney Vic Kennedy also addressed this issue in 1978, stating the rationale behind not awarding veteran's points for promotional examinations. He explained that the Code language has evolved and that the statement, "other than promotions," and the statement, "appointment of Fire Chief and Police Chief," were put into the Code at • different times; therefore, they are not related. A compromise has been developed for both the Fire Captain and Fire Engineer lists. For Fire Captain, all candidates signed off on the compromise which involved changing the examination criteria. The impact of veteran's points was reduced by increasing the total possible points for the testing. This compromise is meant to be non precedent setting. A detailed written explanation was provided to the Commissioners. A brief discussion followed on the proposed compromise. Frank Magsamen pointed out that this compromise is meant to save time and money and was the fairest to all concerned given the time constraints and the need to certify a list. Moved by Juon, seconded by Culp: We, the members of the Civil Service Commission certify the following list of applicants, who are eligible based upon the examination process as set forth by the Civil Service Commission for the appointment to the position of Fire Captain for the City of Waterloo, Iowa. Appointment(s) shall be made from this list for the next two years (June 30, 1994 - June 29, 1996). Furthermore, it is stipulated that the compromise testing criteria used to develop this list is to be non precedent setting. The compromise testing criteria shall be attached to this list. Assistant City Attorney Han pointed out that, if the Attorney General's Office chooses not to move on this issue, the City can seek a declaratory ruling from District Court. A similar compromise was developed for Fire Engineer but not all candidates would sign the compromise. There is only one eligible veteran and he has voluntarily agreed to waive his right to veteran's points. The list presented is based on the original testing criteria. Jim Rodemeyer suggested the Commission moved onto Items 5-7 under New Business because all of these promotional examinations could be impacted by veteran's preference. Since none of these examinations will probably have more than ten candidates, it is recommended that the Commission allow the Personnel Department to proceed on developing the Civil Service Lists. Applicants will be advised that the issue of veteran's points has not yet been resolved. NEW BUSINESS The job description and testing criteria for Assistant Fire Chief of Support Services was presented for review. There is a vacancy due to a promotion. Candidates must hold the rank of Battalion Chief. Moved by Culp, seconded by Juon to approve the job description and testing criteria for Assistant Fire Chief of Support Services with the provision that candidates will be advised that veteran's points may or may not be awarded.
