Set Date for Next Regular Meeting; 4. Hiring Temporary Employee for Human Rights Commission. Moved by Culp, seconded by Murphy to approve the Agenda as amended. NEW BUSINESS Police Officer List The Reserve Civil Service List for Police Officer was presented for certification. The original list was certified on September 15, 1992. The Police Department has applied for a large grant which, if received, will allow the Police Chief to add as many as thirteen (13) officers to the force. The officers on layoff would be called back first and the initial Civil Service List exhausted before the reserve list would be used. Murphy questioned whether the seniority issue in regard to military service had been resolved. Jim Rodemeyer said that issue will be addressed at the next regularly scheduled Civil Service Meeting. Moved by Murphy, seconded by Culp: We, the members of the Civil Service Commission, certify the following Reserve List of applicants, who are eligible based upon the examination process as set forth by the Civil Service Commission for the appointment to the position of Police Officer for the City of Waterloo, Iowa. Appointment(s) shall be made from this Reserve List for the next year (September 9, 1993 - September 14, 1994) upon exhaustion of the Certified List. Carlson Juon suggested the Commission see what issues (i .e. seniority, performance, layoff) the attorneys representing the City and Mr. Carlson are planning to address at the September 17, 1993 hearing. Attorney Walsh, representing the City, said the City's stance is that the primary issue is the layoff of Mr. Carlson as governed by Iowa Code Chapter 400.28. He would like to avoid hearing over and over that Mr. Tagtow and Mr. Carlson did not get along since probably nobody would dispute that issue. Attorney Buckner, representing Mr. Carlson, said his stance will be that this was actually a termination in the guise of a layoff. If the Commission rules it was a layoff under Chapter 400.28, the seniority issue pursuant to the Code will be addressed. Mr. Buckner also maintained that the issue of personalities will enter because Mr. Carlson maintains that was why he was laid off (terminated) rather than someone else. He will present testimony on the history of the employment relationship between Mr. Tagtow and Mr. Carlson and this will require calling a few witnesses to speak on this matter. Attorney Walsh wondered if the hearing could be shortened by all involved agreeing that Mr. Carlson and his witnesses will say that Mr. Tagtow is not the best park director in the world? There was no response to this inquiry. He said the decision should be made tonight who will present first and whether evidence can be presented only in person or if letters and affidavits will be acceptable.
