The request of Phyllis Jacobsen to appeal weed/mowing invoice in the amount of $182.50 for
property located at 327 South Hackett Road was heard. Phyllis Jacobsen reported that on
Tuesday, October 16, 2007 she received a billing notification from the city's Waste Management
Services Department for mowing her yard at 327 South Hackett Road on August 17, 2007. Ms.
Jacobsen explained that on Friday, July 20, 2007, she received notification by certified mail from
the city's Waste Management Department about a complaint on her back yard for grass
exceeding 12 inches in height and that a fine would be assessed if the grass was not mowed in
ten days, which would have been Sunday, July 29, 2007. Ms. Jacobsen reported that within two
days she hired and paid Ron and Marlene Luloff to mow the fenced in yard, which they
completed on Sunday, July 22, 2007. On Tuesday, July 24, 2007, Ms. Jacobsen witnessed that
the yard was completely mowed and she made payment to the Luloffs.
Sharon Spears, Special Projects Technician, reported that she took a picture of the property on
July 18, 2007 which shows the area behind the fence was not mowed. Ms. Spears explained that
she reinspected the property on July 31 and some of the property had been mowed, but not the
area behind the fence in the backyard.
Bob Adams with B&B Lawn Care reported that he received a work order on August 1, 2007 for
property located at 327 South Hackett Road, that on August 10, 2007 a third party started
mowing the front yard, and on August 16, 2007 the front yard was completed, but not the back
yard. Mr. Adams reported that B&B Lawn Care mowed the back yard inside the fence on
August 17, 2007, and that they picked up brush, sandbags and carpet. B&B Lawn Care had to
use a weed whacker along the fence, and they hit a stump breaking the blade.
Ms. Jacobsen stated that it should not have taken the contractor 2 '/2 hours, and she has witnesses
who said he was not even there for one-half hour. Ms. Jacobsen reiterated that she had the
property mowed on July 22, 2007 after she received notification from the Waste Management
Services Department. Ms. Jacobsen stated she feels Ms. Spears waited too long to reinspect the
property because Ms. Spears reinspected the property on July 31, which was nine days after she
had the property mowed. Ms. Jacobsen stated she feels she should have been notified by the city
prior to the contractor mowing the property because she met the deadline and had the property
mowed on July 22, 2007.
Moved by Getty, seconded by Greenwood that the appeal of Phyllis Jacobsen of the weed
mowing invoice in the amount of $182.50 for property located at 327 South Hackett Road be
denied. Ayes: Three. Motion carried.

The request of Greg Bagsby to appeal the mowing fee in the amount of $296.25 for property
located at the corner of Ash and Albany was reviewed.
Greg Bagsby, representing Mygene Carr who is the owner of the property, explained why they
are appealing the fee. Ms Can was sent a notice on June 18, 2007 regarding tall grass on her
property. Mr. Bagsby was notified by Ms. Can on June 24, 2007 that she received the notice,
and Mr. Bagsby informed her he was in the process of looking for someone to mow the grass,
and on June 29, 2007, Mr. Bagsby had the grass mowed. Less than two weeks later, Mr. Bagsby
noticed people mowing the grass, and he called Waste Management Services and told them the
grass did not need mowing. Ms. Carr received a bill for $296.25 for the grass being mowed, and
she feels this is an unfair charge since the grass did not need to be mowed.
The contractor for the city explained that he mowed the lots. The first area had partially been
mowed, but the slope had not been mowed and the lot next to it had not been mowed.
Sharon Spears, Special Projects Technician, explained that the city had the property mowed
because it is not mowed in a timely manner. The city receives complaints from neighbors, and
this has been a continuous problem.
Mr. Bagsby commented that last year he did not do a good job of mowing the lots, but it has not
been a continuous problem. This year the property was mowed except along the sidewalk where
the property slopes. The vacated street where the barricades are located are not part of his aunt's
property.
Councilperson Getty asked Mr. Bagsby to have the neighbor watch the property next year during
the mowing season, so that the lots are mowed in a timely manner. Councilperson Getty feels
Ms. Carr should be required to pay one-half of the invoice because of the staff time involved and
the contractor did some of the mowing at this location. Councilperson Schmitt agreed with
forgiving one-half of the cost because of the discrepancies and the amount of time city staff spent
on this complaint.
Moved by Getty, seconded by Schmitt that Ms. Can be required to pay one-half($148.12) of the
mowing fee for property located at Ash and Albany. Ayes: Two. Absent: Greenwood. Motion
carried.

The request of Sally Sallis to appeal the mowing fee for property located next to 940 Sumner
Street was discussed. Sharon Spears, Special Projects Technician, reported that a complaint
regarding the lot was received at Waste Management Services on July 13, 2007. The lot was
inspected on July 17, 2007, and it was not in compliance with the city's ordinance. A certified
letter was sent to Sally Sallis on July 19, 2007 and the property was again inspected on July 28,
2007 and it was still out of compliance. A work order was created on August 1, 2007 and the
property was mowed on August 7, 2007. Ms. Spears reported there was a lot of junk in the lot
which had to be removed before the area could be mowed. Ms. Spears reported she visited the
property on September 25, 2007 and the weeds are again over 12 inches tall, but her department
has not received a complaint. This property was mowed by the city last year. Ms. Spears
commented that someone is mowing about the first five feet of the property but not the rest of it.
Councilperson Kincaid stated this lot is a garden area, and they keep the part mowed by the
street. The gentleman who uses it as a garden has been sick for the past year.
Sally Sallis, owner of the property, stated she was in the hospital when the notice was mailed.
She was given until July 29 to mow the property. Ms. Sallis stated she hired Mr. Holden to mow
the property and it was completed on August 2, 2007, and then she received a notice on August
7, 2007 that the city mowed the property. Ms. Sallis noted that the man who uses the property
for a garden took care of the lot in previous years, but he has been ill. Ms. Sallis stated she
cannot afford to pay twice for the lot mowing.
The contractor from B&B Lawn Care commented that he was told by a neighbor that a
gentleman did try to mow, but his mower was not big enough for the tall weeds. The gentleman
left weeds ten feet tall approximately five to ten feet out from the fence. The lot was full of
garden equipment, and B&B Lawn Care used a hedge trimmer so they could see the equipment
to pick up prior to mowing. Approximately three bags of garbage was removed from the lot.

Mark Rice, Superintendent of Central Garage, reviewed the proposed agreement with Mc
Squared LLC for placement of advertising on city-owned garbage trucks. Mc Squared will
provide turnkey marketing, sales, brokering and project management services for the purpose of
covering city-owned vehicles with paid advertising using applied vinyl. This is a five year
agreement with an option for two additional years. The city will receive 40 percent of the
advertising receipts to be paid monthly. Any option for additional years will increase the city's
portion to 50 percent of receipts. All selling of advertising, billing, receivables, collection, vinyl
installation, vinyl repair, vinyl removal is the responsibility of Mc Squared LLC. The Public
Works Committee will have final approval of all messages and artwork to be applied to vehicles.
Mr. Rice reported that local businesses were given an opportunity to bid for these services, with
no response. Moved by Greenwood, seconded by Schmitt that said agreement be approved and
forwarded to the full council for approval. Ayes: Two. Absent: Getty. Motion carried.

The request of Greg Bagsby to appeal a weed invoice in the amount of$317.50 for a vacant lot
located in the 200 block of Albany Street was reviewed. Mr. Bagsby, representing his aunt
Mygene Carr who is the owner of the property, reviewed the sequence of events. During the
week of June 24, 2007 he was in the process of looking for someone to cut the grass at his aunt's
property when he was notified by his aunt that she had a notice from the City of Waterloo telling
her she had until July 1, 2007 to cut the grass or the city would do it and assess the cost to Ms.
Can. Mr. Bagsby called the Waste Management Department the next day explaining to them
that he would have the grass at the property cut as soon as possible, and they agreed to a couple
of days' extension. Mr. Bagsby explained that on that same day he hired Louis Holmes to cut
the grass and the grass was cut on June 29, 2007. Less than two weeks later, Mr. Bagsby noticed
people cutting the grass on the lots and was told that the city was having the lots mowed. Mr.
Bagsby believes the grass was cut by the city's contractor for no reason related to any code
requirements and feels this is an unfair charge since the grass did not need to be cut.
Larry Smith, Assistant Superintendent of Waste Management, reported that the bill for $317.50
is mowing by the city last year and not this year's invoice. Mr. Smith explained that the invoice
for this year's mowing has not been mailed to the owner at this time.
Mr. Bagsby stated that he does not have an issue with last year's bill and will wait until his aunt
receives this year's bill.
The contractor for the city noted that when they mowed the grass at Albany and Ash some of the
grass had been cut, but there were trees growing into the sidewalk, where the barricades are
located the weeds were 5 to 6 feet tall and there was some trash. Mr. Bagsby stated that the area
where the barricades are located is city street.
The committee asked that the Waste Management Services Department meet with Mr. Bagsby to
review this year's bill.
Moved by Getty, seconded by Greenwood that the invoice in the amount of$317.50 for a vacant
lot located in the 200 block of Albany Street for 2006 mowing be affirmed. Ayes: Three.

The request of the Building Official/Maintenance Administrator for authorization to certify
unpaid sewer repair fees for 2720 East 4th Street in the amount of$1,850.00 was reviewed. In
August 2006 a sinkhole developed in front of 2723 East 4th Street, and the street pavement began
to sink and barricades were installed. The Sewer Department was called because sewers in
surrounding properties began to back up, and it was determined that dirt and sand was enterin .
the main from the collapsed sewer in front of 2723 East 4th Street. The owner of 2723 East 4m
Street hired Hovey's Plumbing to repair the sewer. During excavation, it was discovered that
2723 East 4th Street was not the sewer that was causing the problem. The sewer line at 2720 East
4th Street was opened and needed repair. Hovey's Plumbing was unable to locate the owner of
2720 East 4th Street for authorization to proceed, and the Building Official gave the approval
order for Hovey's Plumbing to make the repair to prevent continued plugging of the sewer main
and to re-open East 4th Street. The repairs were completed, and Hovey's Plumbing was
instructed to bill the owner to collect payment for the work that was done. The owner of the
property located at 2720 East 4th Street has not paid Hovey's Plumbing for the repair. The
Building Official/Maintenance Administrator will submit a resolution to the council to assess the
cost to the property. Moved by Greenwood, seconded by Getty that said request be approved.

it was noted that the railroad closure gate across Black Hawk Creek, between Highway 218 and
Westfield Avenue, was damaged. VJ Engineering was hired to come up with a list of options
and estimates of what to do with the gate. VJ Engineering has given a report to the city detailing
six different options. The Engineering Department is recommending that Option 5 be approved.
Option 5 is the complete removal of the gate and concrete walls that the gates is attached to and
build a new levee in its place.. The new levee would be of the same size and shape matching the

adjacent property has verbally agreed to grant an easement for this storm sewer project, which
will greatly reduce the length of pipe needed. Moved by Getty, seconded by Greenwood that

The request of the Assistant City Engineer for authorization to seek bids for sidewalk repairs
along East 4th Street between the Cedar River and Mulberry Street was reviewed. These repairs
are necessary to eliminate existing dangerous areas of stamped brick and sidewalk that need to
be repaired. The city currently has a contract with Craig Ritland Landscape Architect to prepare
the plans for these repairs as well as looking at other improvements possibly for the future.

The request of the City Engineer for authorization to seek bids to dispose of salvaged steel
stockpiled near a Greenbelt parking lot at W. Shaulis Road and Black Hawk Creek was
reviewed. Years ago, the city salvaged structural steel from an old bridge on West Ridgeway
Avenue that was replaced. The salvaged steel was stockpiled near a Greenbelt parking lot at W.
Shaulis Road and Black Hawk Creek. The idea was to re-erect the bridge to replace a very poor
bridge where W. Shaulis crosses Black Hawk Creek. Due to the old design standards of the old
Ridgeway bridge, it was too costly to re-erect to meet modern load limits and the idea was
abandoned. There is local private interest in scraping out the remaining steel. Moved by Getty,

Management Services for authorization to purchase 400 96-gallon garbage carts and 100 64-

Sandie Greco, Superintendent of Traffic Operations, reviewed the 28E agreements with
Evansdale, Elk Run Heights and Black Hawk County. The city has had the agreement with these
entities for a number of years. Black Hawk County deeded over the traffic signals and streets
lights at Dubuque Road and Lafayette Street/Plaza Drive to Elk Run Heights. The agreement
with Black Hawk County is for maintenance on an as-needed basis only for six street lights
located at the intersection of Highway 218 and Black Hawk County Road C-57, with all non-
routine maintenance charged according to a rate schedule. The agreement with the City of Elk
Run Heights adds monthly inspection and maintenance of the four street lights located at
Evansdale Road and Gilbertville Road and the traffic signals at Dubuque Road and Plaza Drive.
The agreement with City of Evansdale adds the monthly inspection and maintenance of traffic
signals located at Evansdale Drive and Doris Drive. The agreements with the cities of Elk Run
Heights and Evansdale include an increase in the service fee for each monthly inspection.
