Council Chambers, Waterloo, Iowa at 11:00 a.m. on June 5, 1986. Mayor McKinley in
the Chair. Roll call : Budak, Seeber, Lichty, Dowie and Miller. Absent : Wright

89307 - This being the time and place fixed in the published notice for the consideration

proceeded accordingly. The Mayor announced that the time had arrived for the

89320 - W. Louis Beecher, representing the investors of Waterloo Meat Pack updated the
Council on the progress made at the former Rath Packing Plant. He stated that
after they had received the property, they were not able to gain access for two or
three weeks (second or third week in February) . The accounting firm of McGladrey
and Henrickson has spent 550 hours looking at the fiscal operation, with a Des
Moines firm reviewing the business plan for the firm. In order to commence
operation, an area on the first floor of approximately 200' x 600' was needed to
house the equipment. The building was found not to be high enough to house this
equipment, therefore delaying the planned opening. The building at the corner of
Sycamore and 18th Street was selected as a site for the equipment. Bids have been
taken on the renovation of this building, but agreements have not yet been signed.
Wayne Snyder from the architectural firm of Thorson Brom Broshar Snyder, showed the
Council plans for the structure. He stated that under the circumstances, the firm
has performed as rapidly as possible.
Mr. Beecher indicated that the current plans of the firm is to have a two-shift
operation with a minimum employment of 250 total persons by March 1, 1987.
Tom Siders, McGladrey Henrickson, stated that since January 31 his firm has spent
approximately 550 hours preparing the financial information for the firm. Such
items as sales volumes, gross profit and operational expenses have been reviewed
and compressed into 30 sets of financial statements. He presented information
indicating the use of funds for Waterloo Meat Pack, Inc. and sources of those
funds. Total cost of the plan is approximately $14 million. To date approximately
$300,000 have been spent out of the pockets of the investors. He also indicated
that stock will be offered for public sale soon and that Cedar Valley Action
Company and the Waterloo Industrial Development Association will assist in the sale
of these public stocks.
Mr. Beecher asked that payment on the note with the City be extended until
December 15 at which time the payment and accrued interest would be payable. Mr.
Beecher clearly indicated that he would not be an investor in the firm and that he
was not receiving any money for the work he had done on this project. He explained
that he was not asking for money from the City but only for an extension of the
principal and interest payment. Mr. Beecher indicated that the Council would be
periodically updated on the progress made at Waterloo Meat Pack.

that an extension be granted to Waterloo Meat Pack until December 15, 1986 on
payment of its contract with the City with principal and interest due at that time.
Prior to a vote on this motion, the following discussion was heard: Councilperson
Lichty indicated that she had been sold on entering into the original contract
because she had been told that the investors had millions and millions of dollars
to invest. She stated that the public was tired of living on false hope and
promises. Mr. Beecher indicated that such an extension was necessary to insure
the jobs and investment in the community.

89325 - HOLD HEARING--This being the time and place for public hearing the Mayor called for
written and oral objections and there were none.
Several Councilpersons asked questions regarding the application. Deb Collett,
Executive Director of the Waterloo Housing Authority, indicated that the authority
currently has 387 applications on a waiting list that were accumulated during a
two-week period in October, 1983 that wish assistance through this program. If the
application is approved, funding will be available to assist low income families
with rental assistance. Twenty-five percent of the individual 's income is paid
towards the rent. These units are spread throughout the City with average rents as
follows: one bedroom--$185-$200 monthly: two bedroom--$235-$250 monthly and three
bedroom--$275-$325 monthly. She indicated that the rents covered by this program
are based upon the market within the community and that landowner's properties must
conform to HUD regulations.

WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of

Dear Mayor and Council :
Transmitted herewith is the request by Timothy J. Lind to rezone One (1)
lot from "C-1" Commercial District to "C-Z" Conditional Zoning. This
property is shown in the shaded area on the attached base map and is
legally described as follows:
Lot No. 13 , Brookeridge Addition, Waterloo , Black Hawk
County, Iowa.
This parcel of land is located at the northwest corner of the
intersection of West Ninth Street and the San Marnan Drive frontage
road. The applicant proposes to relocate Lind Brothers Motors Limited
from their current location at 2222 Edgemont to the subject property. A
site plan identifying the proposed development has been received by our
office and is also attached herewith. An automobile dealership would
require a "C-2" Commercial District zoning classification; therefore ,
the applicant has requested "C-Z" Conditional Zoning. The Conditional
Zoning classification allows conditions to be attached to the rezoning
as an effort to mitigate concerns of the City or area residents.
The Waterloo Planning, Programming and Zoning Commission conducted a
public hearing regarding this request at their June 9 , 1936 meeting. At
the public hearing the Planning and Zoning staff presented the positive
and negative factors in relation to this request, as well as several
conditions that should be applied to the request in the event the
Commission recommended approval . This information is noted on the
attached staff report. Prior to this hearing, notices were mailed to
property owners within 250 feet of this property to be rezoned. The
staff stated that two (2) letters objecting to this request were
received and are on file. At the hearing, opposition was expressed by
area property owners reflecting that approximately 50% of the property
owners within 250 feet are opposed to the requested rezoning.

The Commission recommended denial of the request to rezone the property
on a six (6) to four (4) vote for the following reasons:
(1) It would appear that there is ample land available
along San Marnan Drive that is appropriately zoned
to allow for a new car dealership.
(2) The new car dealership would appear to be an
incompatible use in relation to the existing
character of the area.
(3) It should be noted that this area is composed of
elderly persons and a group home for exceptional
children. Concerns have been expressed for the
impact that the approval of this request may have on
these groups.
(4) Opposition to the request has been expressed by
adjacent property owners.
It is respectfully requested that a date of public hearing be set and the City
Clerk/Auditor be instructed to publish pertinent notices concerning this matter.

RE: UTILITY AGREEMENT with WATERLOO CABLEVISION
KIMBALL AVENUE - SOUTH (San Marnan Drive to South City Limits)

Council Members:
Attached are eight (8) copies of the proposed agreement between the City of
Waterloo and Iowa Public Service in conjunction with the above referenced project .
As part of the Interstate Substitution Progran, certain materials and labor are
eligible for reimbursement to the utility companies for relocation and/or replace-
ment of their facilities. Repayment to the utilities is 85% Federal funds and 15%
City funds.
Work and operations consist of the following :
a. Engineering for the work proposed at the Preliminary and Construction
stages.
b . Rebuild cable plant along Kimball Avenue from San Marnan to South City
Limits.
The total estimated cost of the work to be done is: $18,655.48.
This agreement has been reviewed by City staff and the Iowa DOT and we would
recommend that the City Council authorize the Mayor to enter into this agreement.
The agreement will then be forwarded to the Federal Highway Administration for
approval .

HACKETT ROAD BYPASS -- Pedestrian Overpasses

Council Members:
Attached are eight (8) copies of the proposed agreement between the City of
Waterloo and Iowa Public Service in conjunction with the above referenced project .
As part of the Interstate Substitution Progran, certain materials and labor are
eligible for reimbursement to the utility companies for relocation and/or replace-
ment of their facilities. Repayment to the utilities is 85% Federal funds and 15%
City funds.
Work and operations consist of the following :
a. Engineering for the work proposed at the Preliminary and Construction
stages.
b . Relocate electric facilities.
c. Relocate natural gas facilities.
d . Allow credit for salvage items .
The total estimated cost of the work to be done is : $12,064.80.
This agreement has been reviewed by City staff and the Iowa DOT and we would
recommend that the City Council authorize the Mayor to enter into this agreement .
The agreement will then be forwarded to the Federal Highway Administration for
approval .

Transmitted herewith is a signed warranty deed from John B. and Marjorie
K. Young, Richard H. and Imelda M. Young, Robert A. and Edith M. Young
for a parcel of land in conjunction with the proposed extension of Texas
Street. This parcel of land is being given as a gift to the City of
Waterloo from the aforementioned individuals. The only condition
attached to the gift of this land is that no assessments will be applied
to the remaining property for street improvements. The subject property
is identified and legally described on the attached property plat.
Our staff would recommend accceptance of this parcel of land as a gift,
with the understanding that no assessments will be applied to the
remaining land for street improvements in conjunction with the extension
of Texas Street. We would also ask that the warranty deed be approved
and forwarded to our office.

RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACTS TO SELL REAL PROPERTY
TO THE CITY AND ACCEPTING AND APPROVING
CERTAIN DEEDS
WHEREAS, The City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
AND WHEREAS, the acquisition of the hereinafter described
parcels is necessary to carry out the Dysart Road Reconstruction Project
in connection with the Interstate Substitution Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Waterloo, Iowa, that the contract for the parcels hereinafter
described to sell the same to the City of Waterloo, Iowa, all of which
are situated in the City of Waterloo, Black Hawk County, Iowa, are
accepted and approved and the Mayor and City Clerk are authorized and
directed to execute the same in behalf of the City and to execute all

Dear Mayor and Council Members:
Transmitted herewith is the request for the City of Waterloo to accept
a forty (40) foot sanitary sewer/public utility easement between Iowa
Northern Railroad and Washington Street (Reloc. Hwy. 218/I -3801 and
north of vacated Easton Avenue. This easement is shown in the shaded
area of the attached base map and is legally described in Exhibit "A"
attached hereto.
This forty (40) foot sanitary sewer/public utility easement is located
over an existing ten (10) inch sanitary sewer. It is also proposed
to extend city water along the east side of this easement for future
development and better fire protection. All utility companies and city
departments have been given an opportunity to review this proposal .
The Planning, Programming and Zoning Commission unanimously approved
the acceptance of this sanitary sewer/public utility easement at their
regular meeting on May 14, 1986.
It is requested that a resolution pertaining to the City's acceptance
of this easement be adopted.

A Sanitary Sewer/Public Utility Easement described as follows:
Commencing at the point of intersection of the northerly line of
vacated Easton Avenue and the easterly line of I -380, thence N 89°
13' 30" E 341 .53 feet to the point of beginning, thence S 21° 10' E
to the centerline of vacated Easton Avenue thence south perpendicular

REQUEST: DEDICATION OF A FORTY (40) FOOT SANITARY SEWER EASEMENT
LOCATED SOUTH OF MITCHELL AVENUE, WEST OF IOWA NORTHERN
RAILROAD AND EAST OF I -380.
REQUESTOR: City Engineer
GENERAL
DESCRIPTION: The sanitary sewer easement to be dedicated is located
approximately 490 feet south of Mitchell Avenue and 240
feet west of the Iowa Northern Railroad. The easement
is described as a 40' X 790' strip of land extending
north from the southerly right-of-way line of Easton
Avenue.
There is an existing ten (10) inch sanitary sewer line
that will be entirely within the easement. This sewer
line has been in place for quite some time and apparently
the existing easement does not adequately provide for
future maintenance or repair of the line.
IMPACT ON
NEIGHBORHOOD: Since the sanitary sewer is in place at this time, it
would appear the request would have a positive impact
on the neighborhood, as it will provide service for future
development.
TRAFFIC
CONDITIONS: Easton Avenue in this vicinity is in the process of being
vacated. There are plans being made to extend Texas
Street north from where it currently ends at Locke Avenue
to provide access to the proposed U.A.W. site. It would
appear that this request will have no significant impact
on existing traffic patterns or conditions.
UTILITIES: All utilities currently exist on the site and are adequate.
It appears that no major relocations will be necessitated
by this request.
RELATIONSHIP
TO PLAN: The acceptance of this sanitary sewer would appear to
have no significant relationship to the plan.
STAFF
ANALYSIS: The ten (10) inch sanitary sewer existing in this area
would appear to be adequate for the needs of the existing
development. The property over which this easement is
located is owned by the City and the dedication has been
initiated by the City Engineer in order to correct the
alignment of the easement in relation to the existing
sanitary sewer.
The staff recommends acceptance of the forty (40) foot
sanitary sewer easement.

Attached herewith is a copy of the proposed Zoning Ordinance Amendments
that pertain to offstreet parking requirements for bars, restaurants,
and lighting requirements. These proposed changes are in conjunction
with the beer garden and outdoor cafe regulations as proposed by the
City Clerk/Auditor's office.
The Planning and Zoning Commission conducted a public hearing concerning
these proposed changes at their regular meeting on May 14, 1986. There
was very little discussion pertaining to these proposed regulations
and the commission unanimously approved these amendments. For this
reason, it is recommended to you that these changes by adopted.
Our office respectfully requests that a date of public hearing be set
and the City Clerk/Auditor be instructed to publish hearing notices
pertinent to this matter.

Regarding: The rezoning of one acre of land located between Baker St.
and the Chicago & North Western Railroad tracks approximately
250 feet east of Hallowell Road. requested by Line Masters
Striping Inc. , Dick Refshauge, president.
Dear Mayor and City Council :
I will be out of town and unable to attend the Council meeting on
Monday, June 16th. Therefore, this letter.
M/M Fred Bartachek, Mrs . Fay, and I visited with Dick Refshauge, Line
Masters Striping Inc. , after the council meeting on June 9th. Dick
assured us his intentions are to construct the one building and leave
a buffer zone of TREES, NOT GRASS around the required 40 foot city
regulation. He also said he would not ask the city to put a through
street on Baker to accommodate his business .
I asked him to back up his verbal statements with a written letter, on
company letterhead, signed by him, stating these facts . He would bring
a copy of his letter to the council meeting and mail one to me. He
agreed to do so.
On Tuesday morning, June 10th, I called and spoke with Dick. I asked
if he would mind including in his letter, that if he were to sell this
property, he would have as a condition of the sale, a clause with these
provisions . He said he had no problem with this, but wasn' t sure of the
legality of it.
I 'm sure Dick is an honorable man. However, even honorable people have
been known to change their mind. Plus , it' s a fact of life, any one of
us could die tomorrow. Therefore, I am requesting that a condition of
the rezoning provide for these provisions . I realize this is not a
normal procedure . However, I feel it is necessary in order to preserve
the integrity of our residential neighborhood.
I propose it is written and kept on public file, that a condition of the
rezoning of this property require that the 40 foot, city regulation, of
a buffer zone remain one of trees, and not grass or other light foliage.
That the mature trees presently existing on this 40 feet, remain in tact,
and not be cut down and replaced by young sibling trees. Futhermore,
that Baker Street not become a through street in order to accommodate
a commercial business. That these provisions be binding to Dick
Refshauge, his heirs and assigns, Line Masters Striping Inc. , and it's
successors and assigns.
I greatly appreciate the concern shown by the Mayor and Council Members,
at the June 9th meeting. Please act on this concern, and need, for the
preservation of our residential neighborhood, by having this clause as

Dear Mayor and Council Members:
Transmitted herewith is the request by Linemaster Striping, Inc. of 1965i Indepen-
dence Avenue, Waterloo, to rezone approximately one (1 ) acre of land from "R-2" One
and Two Family Residence District to "M-1" Light Industrial District. The property
is located between Baker Street and Chicago & Northwestern Railroad tracks, and approx-
imately 250 feet east of Hallowell Road. This parcel is shown in the shaded area
on the attached base map and is legally described in Exhibit "A" .
The applicant currently operates a business that uses heavy equipment and machinery
for various types/aspects of paint striping. This operation of paint striping involves
airport landing strips, centerlines/road edges of highways and streets, parking lots,
etc. Much of the equipment and supplies used are currently stored outside and in
buildings at other sites in the City.
The property to be rezoned is a low lying area that is considered to be a wetland.
The applicant proposes to drain this area and deposit fill material in order to raise
the ground elevation. A 60 X 120 foot building will then be erected for purposes
of storing equipment and material . This will allow various aspects of his business
operations to be in a centralized location.
At the Planning and Zoning Commission meeting, it was pointed out that utility services
are available in this area, but will require an extension of said services to this
site. It was also noted that access is not currently provided onto Baker Street,
but this property will continue to use the private access drive located to the east.
The Planning and Zoning Commission held a public hearing pertinent to this rezoning
request on May 14, 1986. Prior to this hearing, notices were mailed to property
owners within 250 feet of this property to be rezoned. Objections were presented by
three (3) property owners for this request. Their concerns pertained to noise; the
other permitted uses of the "M-1" Light Industrial zoning district; possible access
onto Baker, Corrine Streets and Hallowell Road (residential neighborhood) ; the proposed
use/operation may jeopardize the residential neighborhood' s serenity; and the availa-
bility of approximately sixty (60) acres of land already zoned "M-1 " to the east.
This opposition represented approximately twenty (20) percent of the surrounding
property ownerships.

As a result of hearing the proponents and objectors, the Commission approved the
recommendation of approval to the City Council by a 5 aye to 2 nay vote. This motion
for approval was based on the following reasons: 1 )The property is a low lying wet-
land undesirable for residential purposes; 2)It would appear to be unlikely that
residential development would occur since it is next to an industrial use; 3)The
proximity of the existing business is in the same vicinity of this property to be
rezoned and proposed building for storage of equipment and materials.
It is respectfully requested that a date of public hearing be set and the City
Clerk/Auditor be instructed to publish pertinent notices concerning this matter.
Please keep in mind that because of the opposition representing twenty (20) percent
of the surrounding property owners, it is required that a three-fourths (3/4) favorable
vote by all City Council Members must be secured in order to be approved.

LOCATION: The property requested to be rezoned is located between Chicago
Northwestern Railroad tracks and Baker Street and east of Hallowell
Road approximately 250 feet. Independence Avenue is located
approximately one-quarter of a mile to the south of this parcel of
land.
ZONING At the time Zoning Ordinance No. 1734 was adopted in 1947, this
HISTORY: property was zoned "R-1" One and Two Family Residence District.
When Zoning Ordinance No. 2734 was adopted in 1969, this area was
reclassified to the "R-2" One and Two Family Residence District and
has remained unchanged since that time. That area of land to the
east has been zoned "M-1" Light Industrial since the adoption of
Zoning Ordinance No. 1734 in 1947.
LAND USE The 1967 Land Use Plan shows the area developing as low density
PLAN: residential . The long range land use plan conforms with the 1967
Land Use Plan.
SURROUNDING AREA ZONING CLASSIFICATION CURRENT USE
LAND USES: North "R-2" One & Two Family Residence vacant property
East "M-1" Light Industrial District petroleum products

industrial uses.

FLOOD The property is a low lying area with ground water and surface
INFORMATION: runoff causing this area to be considered a wetland/marsh during
wet seasons. The Federal Insurance Administration's Flood Hazard
Map does not show this area to be within the flood hazard area.
Blowers Cr ec drainage area is approximately one-quarter of a mile
to the east. Because this property is relatively a low area, it
will be necessary for fill material to be deposited prior to the
construction of any building.
MAJOR STREET Independence Avenue is approximately one-quarter of a mile to
PLAN: the south. This street is a minor arterial street that acts as a
collector street for properties in this particular vicinity of the
community, Many of the streets in this area are unimproved streets
and generally surfaced with gravel/sand. Access to this property
is gained via traveling northward on a portion of Starr Drive and
onto a private drive. Corrine Street is open for access and
extends east of Hallowell Road to the property currently used by
Linemasters Striping, Inc. Baker Street is dead-ended
approximately 300 feet east of Hallowell Road.

UTILITY The current site where the existing building is located is
SERVICES: serviced with City water and sanitary sewer. The sanitary sewer
appears to be a private line that extends between the building and
connects into a public system in Ruth Street. This private line is
a force main eight (8) inches in diameter. The six (6) inch water
main is dead-ended in Ruth Street, but does extend as a private
line to the building. It will require that the private services
will need to be extended to the new building.
DEVELOPMENT The parcel of land requested to be rezoned is identified to be
within the developed portion of the City. Since surrounding
ANALYSIS: properties have sparsely developed, it is anticipated that further
development will occur in the future, especially when public
services are improved and extended into this area.
PROPOSED USE: The applicant currently operates an industrial business that uses
heavy equipment and machinery for various types/aspects of paint
striping. This operaton of paint striping involves airport landing
strips, centerlines/road edges of highways and streets, parking
lots, etc. Much of the equipment and supplies used are currently
stored outside, although there is some storage in buildings at
other sites in the City. This business currently operates out of
an existing building 60' X 200' . The applicant proposes to
construct a 60' X 120' foot building on the property to be rezoned.
This will permit the material and equipment stored outside to be
stored inside and allow all of the equipment to be in a centralized
location.
STAFF This particular area has sparsely developed with several
COMMENTS: residential homes to the south, east and northwest of the property
to be rezoned. The area has recently been drained and will permit
the deposit of fill material to raise the ground elevation. A
grove of trees and brush are located on the south and east side of
this property. This natural vegetation will be thinned out to
allow better growth of the larger trees and will provide a natural
screen/buffer between the residential properties and industrial
uses.
Public utilities are available in this area, but will require the
extension of private services to the proposed new building. There
is some concern for the extension of a "M-1" Light Industrial
District into an area that is residentially zoned with existing
residential homes. It would appear that there is adequate "M-1"
zoning in this area with available vacant land that will allow the
construction of this building.
On the contrary, it would appear that a residential structure would
probably never be constructed in this area because of the abutting
industrial uses and railroad tracks to the north. Residential
sewer hooking into a public sewer may be costly because of the
topography for this property. There may be some concern and
complications for a residential sewer to connect into a private
sewer that is used for industrial purposes.

RECOMMENDATION: Our office finds some merit to the rezoning of this particular
parcel , but there are also a number of concerns. These concerns
pertain to the extension of an industrial zoning classification
into an area zoned residential and that the proposed use is not
compatible to abutting residential uses.
It is the staff's recommendation that this rezoning request be
denied for the following reasons:
1. The concerns as described above.
2. The request does not conform to the 1967 Land Use Plan or
long range land use plans that identify this property as low
density residential .
3. That there is approximately 60. 5 acres of land currently
zoned "M-1" Light Industrial . This area of land is located
immediately to the east of this property requested to be
rezoned. For this reason, it is our opinion that there is
an abundance of industrially zoned property in this
immediate vicinity.

Council Members:
Transmitted herewith are the Plans and Specifications on the F. Y. 1987
GREYHOUND TRACK ACCESS ROAD - PHASE II, Contract No. 296. This project
involves the construction of left turn lanes along U. S. 63 to serve Greyhound
Drive and the east-bound U.S. 20 ramp. It will also include the installation
of barrier rail adjacent to the piers of the U. S. 20 bridge overpass and impact
attenuators at each end. This will be a U-STEP project with the Iowa DOT
paying 55% of the construction cost.
It is recommended that Council approve these documents, set July 7, 1986 as the
date for the p elic hearing and bid opening, and instruct the Clerk to publish
said notice.

OPEN DISCUSSION:
Commissioner Reed called the meeting to order at 4:10 p.m.
Ms. Furgerson introduced and welcomed new commissioner Lois Mayne.
There were no oral presentations from the public. Alex Walker and Pete Butler
from Job Service of Iowa were present.
Commissioner Quirk moved and commissioner Allen seconded to adjourn Open Session
to go into Closed Session to discuss complaints filed with the Commission.
Roll call vote was taken. Motion Carried unanimously. Time: 4:15 p.m.
Following discussion of complaints commissioner Ward moved and commissioner
Allen seconded to go back into Open Session. Motion Carried. Time: 5:20 p.m.

FINANCIAL REPORT

Commissioner Meeks moved and commissioner Ward seconded that the March budget
report be approved. Motion Carried.
Ms.Furgerson stated that in the FY '87 Budget - no Captial Outlay funds were
approved to purchase the requested typewriter. Ms. Furgerson, Reed and Quirk
will meet to write a request to the Budget Committee re: the typewriter.
Ms. Furgerson stated that she received a letter from Personnel Director,
Jim Rodemeyer, re: Specialists positions being removed from the union. The
city is requesting an amendment from the PER Board re: this matter. As more
information is made available re: this matter, Ms. Furgerson will pass this on
to the Commissioners.
STATUS OF CASES
Presented & Reviewed.
OPEN DISCUSSION:
- Commissioner Reed stated that training will be available from time to time
for Commissioners re: ordinance, steps on how complaint is processed etc.
Ms. Furgerson stated it is very important to follow procedures so that
in case of a suite the city will provide us with legal representation.
Ms. Furgerson also stated that the commissioners assigned to cases will be
receiving in the mail the case number and Complainant vs Respondent when
the complaint is first docketed so that the commissioner assigned can follow
the case step by step.
CORRESPONDENCE:
- Ms. Furgerson reminded the Commissioners of the KBBG banquet. We have a
reserved table and she needs to know who all are going to sit at the table
of eight. The cost is $26.25 per person.
- A Human Rights Conference sponsored by the Des Moines Human Rights Commission
is being held on May 30, 1986 in Des Moines. Anyone interested in attending
is to contact the office so reservations can be made.

WATERLOO CITY PLANNING, PROGRAMMING AND ZONING COMMISSION
WATERLOO, IOWA
REGULAR MEETING - 4:00 P.M. - MAY 12, 1986
The regular meeting of the Waterloo City Planning, Programming and Zoning
Commission was called to order at 4:00 P.M. by Acting Chairman Ken Mast
in the Council chambers of City Hall .
The following members were present: Carter, LaRosse, Mast, Allen, Burton,
Lichty and Radue.
Also present were: Fred and Inez Bartacheck, Roy and Leona Fay, Thomas
Lind, David Grune, Tim Lind, Dick Refshauge, Willaird Butterfield, Faith
Kubik, Mark Graham, Mayor McKinley, Councilpersons Wright, Seeber, Miller
and Budak, Don Temeyer, Bob Stevenson, Randy Pilkington, John McCool and
Dave Van Dee.
It was moved by Burton, seconded by Carter to approve the minutes of the
regular meeting on April 14, 1986. The motion passed unanimously.
It was moved by Radue, seconded by Burton to approve the Financial
Reports for both Commissions for the month of March, 1986. The motion
passed unanimously.
It was moved by Burton, seconded by Allen to approve the Bills Payable
for both Commissions for the month of March, 1986. The motion passed
unanimously.
The first item considered was the public hearing for the request by
Linemaster Striping, Inc. to rezone approximately one (1 ) acre of land
from "R-2" One and Two family Residence to "M-1" light Industrial District.
Chairman Mast read a statement of verification indicating that notices
had been sent to property owners and it was moved by Radue, seconded
by Lichty to receive and place the statement on file. The motion passed
unanimously. McCool gave the staff report and pointed out that a video
tape will be shown which should put the area into perspective. It was
also noted that access to the existing site of Linemaster Striping, Inc.
is limited to a private drive from Starr Drive. The staff recommended
denial of the request for the following reasons:
1 . The proposed use of the requested area is incompatible with
the abutting residential uses.
2. The request does not conform to the 1967 Land Use Plan
or long range land use plans that identify this property
as low density residential .
3. That there is approximately 60.5 acres of land currently
zoned "M-1 " Light Industrial . This area of land is located
immediately to the east rf this property requested to be
rezoned. For this reason, it is our opinion that there is
an abundance of industrially zoned property in this
immediate vicinity.

PLANNING AND ZONING COMMISSION
MAY 12, 1986
Questions were raised in regards to the water run off in relation to the
surrounding properties, the number of new jobs that may be created and
whether there is any opposition to the request from the adjacent
property owners. Dick Refshauge came forward on behalf of Linemasters
and indicated the water run off from the property would be controlled
and there may be six (6) new employees as a result of the expansion.
Faith Kubik a property owner came forward and indicated that she is
opposed to the request and identified several other property owners
from the area who were opposed. After further discussion it was moved
by Burton, seconded by Carter to close the public hearing. The motion
passed unanimously. It was then moved by Radue, seconded by Carter
to approve the request for the following reasons:
1 . The subject property is low lying and would appear
to be undesirable for future residential development.
2. In the event the parcel was developed as residential
it would then be adjacent to an existing industrial use.
The Motion passed on a five (5) to two (2) vote with Barton and
LaRosee being dissenting votes and all others aye.
The next item discussed was in regards to the proposed amendments to
Zoning Ordinance No. 2479 in conjunction with the development of a Beer
Garden Ordinance by the City Clerk 's Office. McCool gave an overview
of the proposed amendments indicating that they were in regards to
lighting and parking requirements. These proposed amendments were noted
as pertaining to outdoor cafes and drinking establishments and essential

Carter, seconded by Radue to approve the proposed amendments. The
motion passed unanimously.
The next item discussed was in regards to the request by Tim Lind to
rezone one lot from "C-1" Commercial District to "C-Z" Conditional
Zoning. Van Dee gave the staff report and identified the surrounding
uses and the zoning history of the subject property. It was noted that
the applicant proposes to operate a new car dealership out of this
property. The staff recommended setting a date of public hearing for
the June meeting in regards to this request. After further discussion
it was moved by Radue, seconded by Allen to set a date of public hearing
for June 9, 1986. The motioned passed unanimously.
The next item discussed was in regards to the request by Dale Swehla
of 2704 Saratoga Drive to reduce a thirty (30) foot platted set back
line to fifteen (15) feet. Van Dee gave the staff report and pointed
out that there is an existing thirty (30) foot platted set back line
along Saratoga Drive and Cataract Avenue. It was also noted that the
applicant had submitted a petition bearing the signatures of 87 out of
32 property owners in the subdivision as well as the signatures of
abutting property owners. The staff indicated that though the applicant

had originally requested a reduction to 14 feet 6 inches he was agreeable
to the 15 feet and appeared to understand why the staff was making their
recommendation of approval . After further discussion it was moved by
Burton, seconded by Allen to approve the reduction of the thirty (30)
foot platted set back line to fifteen (15) feet. The motion passed
unanimously.
The next item discussed was in regards to the request by Jeff and
Pat Swartzendraber for the City of Waterloo to vacate, and convey the
frontage road located east of and adjacent to 1208 and 1216 LaPorte Road.
McCool gave the staff report and indicated that the City Engineer
recommended that curbing be placed across the frontage road to aid in
controlling traffic in the area. Questions were raised in regards
to breaking up the frontage road and it was noted that consideration
should be given to vacating the entire frontage road rather than a one
block segment. Councilperson Tony Budak came forward and stated that
as an area resident he felt the frontage road was a nuisance. The staff
pointed out that there will be a public hearing in regards to this
matter at the City Council . After further discussion it was moved by
Carter, seconded by LaRosee to approve the vacation of said frontage
road. The motion passed on a six (6) to one (1 ) vote with Lichty being
the dissenting vote.
The next two agenda items were presented together though two (2) seperate
motions were made. Van Dee gave the combined staff reports and indicated
that the issue at hand was the request to vacate a fifty (50) foot
easement and subsequently dedicate a forty (40) foot easement on
property located south of Mitchell Avenue and easterly of I -380 currently
owned by the City of Waterloo. The staff pointed out that the fifty
(50) foot easement was found to be out of alignment with the ten (10)
inch sanitary sewer over which it had been placed during the course
of a recent survey. Therefore the City Engineer requested that said
fifty (50) foot easement be vacated and a new forty (40) foot easement
be dedicated to provide for the sanitary sewer as well as other utilities
as the property developed. After further discussion it was moved by
Burton, seconded by Lichty to approve the vacation of the fifty (50)
easement. The motion passed unanimously.
It was then moved by Burton, seconded by Lichty to aprove the dedication
of the forty (40) foot utility and sewer easement. The motion passed
unanimously.
The next items discussed were listed on the agenda under Plans and Studies
and pertained to the Sixth Street Extension Location/Design Review and
Location/Design review. Stevenson gave an overview of the Sixth Street
project and indicated that a Public hearing had been held and the
concerns were in regards to parking and the shifting of the railroad

in conjunction with the Sixth Street project. After further discussion
it was moved by Carter, seconded by LaRosee to approve the Location/

Environmental Assessment and noted the project limits and potential
imports. It was noted in the course of the ensuing conversation that
access will remain as it is for those properties located on the west
side of the project corridor. After further discussion it was moved by
Carter, seconded by Radue to approve the Ansborough Avenue North Environ-
mental Assessment. The motion passed unanimously.

The written examination was held May 7, 1986 Fire Station Number One, out of the 325
who applied, 162 showed up to participate in the examination process. The physical
agility examination was held May 17, 1986 at East High School , fifty-two (52)
applicants were invited to this examination. Forty-six (46) applicants passed the
physical agility examination and will be invited to participate in the oral
examination process.
Laboratory Technician
Advertisement for the position began April 20, 1986 and the deadline is May 9, 1986.
Sixty-one (61 ) applicants applied for the vacant position. Oral examinations will be
scheduled in the near future.
Equipment Operator I
The positions were posted for a transfer and several applicants indicated they wish
to transfer. Three applicants were accepted from the transfer procedure which leaves
