Firm 2001 April 9, 1986 The regular meeting of the Waterloo Park Board was held on Wednesday, April 9, 1986, at 8:00 A.M. , in the Park Board Office, City Hall . Members present were : Sheryl Annette, Sammie Dell , Cecil Pierce, Gene Yagla and Mike Zegarac. The agenda was approved as amended. It was moved by Pierce, seconded by Yagla to approve the minutes of the March 19, 1986, meeting. Motion carried. The City Forester reported on discussions with Conway Civic Center concerning trees that were blocking their large display sign at West 4th Street and Jefferson. He also briefed the Board on plans for Arbor Day celebrations in Waterloo. It was moved by Pierce, seconded by Zegarac to approve the bills for payment as submitted. The Director reported on progress relating to the stadium lighting renovations. A proposal from Lindstrom and Associates of Lincoln, Illinois , was reviewed. Lights were available immediately and could be installed by the first night game from this contractor. In order to meet the time schedule as set by the Cleveland Indians for up-grading the field lights to a safe level it was moved by Yagla, seconded by Zegarac to approve this proposal in the amount of $9,576.00. Motion carried. It was moved by Zegarac, seconded by Dell to approve two golf outing requests as submitted (see attached) . Motion carried. The Board discussed plans for the 1986 Waterloo Open Golf Tournament sponsored by the Waterloo Jaycees. It was moved by Dell , seconded by Pierce to set the course rental rate for the 1986 Waterloo Open at $600 per day per course. Motion carried. With no further business before the Board the next meeting date was set for May 14, 1986. Meeting adjourned. S i gned, ( _de G MINUTES WATERLOO CITY PLANNING, PROGRAMMING AND ZONING COMMISSION WATERLOO, IOWA REGULAR MEETING - 4:00 P.M. - APRIL 14, 1986 The regular meeting of the Waterloo City Planning, Programming and Zoning Commission was called to order at 4:00 P.M. by Chairman Shirey in the Council Chambers of City Hall . The following members were present: Carter, Fister, LaRosee, Mast, Miller, Shirey, Stroh, Allen, Burton, Lichty, Means, and Radue. Also present were: Dick Refshauge, Fred Debe, Council Members Willie Mae Wright and Jim Miller, Mark Boesen, Dennis Gentz, Bob Stevenson, John McCool and Dave Van Dee. It was moved by Miller, seconded by Carter, to approve the minutes of the regular meeting on March 10, 1986. The motion passed unanimously. It was moved by Burton, seconded by Radue, to approve the Financial Report for the month of February, 1986. The motion passed unanimously. It was moved by Miller, seconded by Burton, to approve the Bills Payable for the month of March, 1986. The motion passed unanimously. Under oral presentations, the request to vacate an unopened portion of Easton Avenue lying between I -380 and Texas Street was presented. McCool gave the staff report and indicated the location of the portion of Eason Avenue requested to be vacated. It was also pointed out that it is proposed to combine the vacated area with a parcel of City-owned land to the north. The staff also indicated that a twenty (20) foot utility easement over the northern portion and a forty (40) foot sanitary sewer easement will be retained over the vacated street as identified in the staff report. Some questions arose as to the future plans for this area and it was noted that it is intended to sell the parcel as one large tract of land. After further discussion, it was moved by Means, seconded by Stroh to approve the vacation of Easton Avenue between I -380 and Texas Street, with the retention of the easements. The motion passed unanimously. The next item discussed was in regards to the request by Linemasters Striping, Inc. to rezone approximately one (1 ) acre of land from "R-2" One and Two Family Residence to "M-1" Light Industrial District. McCool gave the staff report and pointed out that the property is located between Baker Avenue and Chicago and Northwestern Railroad tracks and east of Hallowell Road, a distance of approximately 250 feet. It was also noted that the applicant proposes to centralize the storage of equipment and materials on the property to be rezoned. The staff recommended setting a date of public hearing for the May 12, 1986 Commission meeting. After further discussion it was moved by Radue, seconded by Miller to set the date of hearing for the May meeting. The motion passed unanimously. Page Two - Minutes Planning, Programming and Zoning Commission Meeting April 14, 1986 The next item discussed was in regards to the Preliminary and Final Plat of Carriage Hill Third Addition. Van Dee gave the staff report and pointed out that the area being subdivided has been developed with an eight (8) plex dwelling unit being located on each of the three (3) lots included in the plat. The staff did indicate that for the most part the discrepancies noted by the Technical Review Committee had been corrected. The Engineering Department would ask that the easement noted on the final plat along the western lot line of Lot One (1 ) be identified as a drainage and utility easement. After further discussion, it was moved by Means, seconded by Mast to approve the Preliminary/Final Plat of Carriage Hill Third Addition with the aforementioned drainage easement being noted on the plat. The motion passed with all members present voting aye, except Radue, who abstained from the vote. The next item discussed was a combination of street and easement dedications as noted on the agenda. McCool indicated that since the two (2) requests were interrelated, they would be presented together, though the staff asked that two (2) motions be made. A brief review of the Greyhound Park Addition Preliminary Plat was offered and it was mentioned that the street and easements that are proposed to be dedicated are consistent with said preliminary plat. Since the street is proposed to be paved only to the northern property line of the Greyhound Racing Track, questions arose as to the future extension of the street. The staff pointed out that it will be retained as a private drive until such time as the remaining land is developed. After further discussion, it was moved by Burton, seconded by Means, to approve the dedication of certain property from the Ralph E. Russell Estate for purposes of a public street to provide access to the Greyhound Race Track. The motion passed unanimously. It was then moved by Burton, seconded by LaRosee to approve the dedication of certain property from the National Cattle Congress to the City of Waterloo to accept a permanent eight (8) foot utility easement and a thirty-seven (37) foot sanitary sewer easement along the southern property line of the Greyhound Race Track site. The motion passed unanimously. The next item discussed was an update of the Historical Survey that is the second phase of the Architectural Survey. Van Dee reported that the survey is progressing on schedule and it does appear that it is well within the budget. Stevenson mentioned that the Historic Preservation Commission has been established and will be meeting in the near future. No motion was made in regards to this matter. The next item discussed was in regards to an update on the status of the Land Use Plan. Stevenson presented the Commission with a revised schedule of the development of the plan. Also it was pointed out that with the retirement of Holly Borland from the Commission, a new committee member should be appointed and he asked for a volunteer. Bruce Radue volunteered to serve on the Land Use Committee. Page Three - Minutes Planning, Programming and Zoning Commission April 14, 1986 The next item discussed was in regards to proposed zoning ordinance amendments in relation to the development of a beer garden ordinance by the City Clerk 's office. McCool gave the staff report and indicated the changes that will be required by the proposed beer garden ordinance. The staff recommended that a date of public hearing be set in regards to this matter for the May meeting. After further discussion, it was moved by Radue, seconded by Means to set a date of public hearing for the May meeting. The motion passed unanimously. Under discussion items, the following actions were taken and topics discussed: Shirey mentioned that John McCool will be leaving the City in the near future and a motion should be made to fill his position. After some discussion, it was moved by Miller, seconded by Lichty to fill the position. The motion passed unanimously. Stevenson identified a Planning and Zoning Conference that will be held May 7 - 9 in Madison, Wisconsin. Costs were discussed and Stevenson asked that Jeff Klein be allowed to attend. After further discussion, it was moved by Stroh, seconded by Means to approve the request. The motion passed unanimously. Stevenson then briefly went over the Interstate Substitution Construction Schedule. Schedules were discussed and it was noted that Wagner Road should be completed by mid August. Stevenson then gave an overview of the Fifth/Sixth Street Project, Hackett Road Bypass and San Marnan Drive. It was also noted that the Ansborough Avenue North Environmental Assessment will be presented at the May Commission meeting. Being no other business, the meeting adjourned at 4:40 P.M. Box 1435 Waterloo, Iowa 50704 (319) 291-4491 MINUTES: The regular monthly meeting of the Waterloo Recreation Commission was held on Thursday, May 8, 1986 at 12:00 noon at the Waterloo Recreation and Arts Center. Meeting was called to order by Chairman Richardson with the following members present: Christensen, Hayes, Klima, Marsau, Singer and Staack. Moved by Singer, seconded by Klima the minutes be approved. Carried. Moved by Staack, seconded by Christensen, the financial reports be approved. Carried. Moved by Marsau, seconded by Staack, the bills be approved. Carried. CENTER Copies of proposed Collections Policy for members perusal were distributed. REPORT Ailing requested these be returned to him as soon as possible with any changes and recommendations. SPORTS Sport's Supervisor Eggleston. Copy attached to secretary's permanent file. ICE McElroy Chairperson Klima reported on meeting held with 'ice users'. Klima, FACILITY three Board members and Myhr will 'meet with Mayor McKinley and Jack Seeber to determine what the city's on-going commitment to an ice program is, and to explore with them some options regarding a new ice facility. The second meeting of the 'ice-users' will take place on Wednesday, May 14, 1986. REGATTA Reardon reported on 1986 Regatta to be held Saturday, May 10, 1986 with approximately 300-350 participants on fifteen teams. Finals are scheduled to begin at 9:30 a.m. with Mayor McKinley opening the event. Sports Illustrated magazine has contacted the Center requesting information on summer activities in Waterloo Iowa. It is possible that Waterloo will be the city selected for overview of summer sports activities in a midwestern city. MC ELROY Myhr reported a thorough examination of the facility shows owner of concessions at McElroy is using excessive amounts of storage space and electricity year- around. Recreation personnel will investigate equipment and management costs should the Waterloo Recreation Commission opt to take over concessions for FY '86-'87. More at future meeting. Communication from City Planner on selling City-owned property (utilized by the Waterloo Water Works) to the Iowa Department of Transportation in conjunction with the Relocated U.S. 218 Project. ORAL PRESENTATIONS 89167 - Tammy Smith, student at Greenbriar School , was awarded a plaque by Mayor Bernie McKinley for her winning entry in a contest sponsored by the Cedar Valley Economic Action Committee. Students in the elementary Waterloo and Cedar Falls Schools were asked to submit an essay on "What Business Means to Me." Tammy's essay was read by Mayor McKinley. Tammy was congratulated along with her Teacher, Mrs . Virginia Shimpach. Mayor McKinley also presented to Council members a new brochure about Waterloo. Gene Geiger also asked whether or not the City Clerk had researched why certain establishments, particularly Scheels Hardware, are not required to keep a log of who buys and sells guns as; is required of pawnbrokers. Mr. Geiger was told by Police Chief Roger Shook and Larry Burger, Clerk/Auditor, that gun laws are legislated by the "federal -1111 `Trriment and that their requirements supersede that of City Ordinance. It was suggested that a work session be held by the Council on the City's pawnshop ordinance. • May 12, 1986 Page Three ORAL PRESENTATIONS CONTINUED 39167 - Fire Chief, Gerald Olson, thanked the Mayor and Council for the years of support (cont. ) during his tenure as Chief. He also thanked former administrations for their cooperation. Mayor McKinley extended his appreciation to the Chief for his many years of service. Mrs . Mike Baker, 1300 Byron Avenue, asked why Stan Stapella, the Mayor's appointment to fill the vacancy created by the retirement of Chief Olson, was allowed to not pay his property taxes . She stated that many of the properties that he owns in the City of Waterloo are delinquent and dilapidated. Mr. Stapella stated that he would be glad to talk about this issue with anyone who was concerned. Mayor McKinley stated that he was aware of the situation and had talked to Mr. Stapella regarding hi unpaid taxes. The Mayor indicated that Mr. Stapella was willing to cooperate with the City and bring the items up to code as soon as possible. Councilperson Wright stated that many of the properties that will be put up for public auction on Saturday, May 17, 1986, are houses that are listed on the City's demolition list. Motion carried. UNFINISHED BUSINESS 99171 - The ection of the Board of Adj�w.tm nt of April 22, 1986 granting a variance at 600 Cater Avenue was brought to the floor for discussion. It was stated that at the May 3, 1986 Council Meeting action was taken by the Council for an item that appeared under the oral presentation section of the Agenda. Under the Iowa Open Meetings Law, no action can be taken by the Council unless the item appears on the Agenda. At that meeting the Council asked the Board of Adjustment to reconsider its granting of a variance at Emo Reber Avenue. Mayor McKinley reported that since that Council meeting, Councilpersons Lichty and Seeber and members of the Board of Adjustment met to discuss the item. In addition, each Board of Adjustment member was polled as to whether or not they felt a fair hearing had been held and secondly whether or not they would reconsider their action. All members stated that the residents had been given a fair hearing and that they would not reconsider their action unless new evidence was presented. Councilperson Miller stated that the property owner owns and controls the property to the flood wall and it becomes a question of access and whether or not gates can be anchored into the flood wall . Mayor McKinley stated that he would have City staff look into this matter and report back to Mr. Geiger. Councilperson Lichty asked that all Council members speak clearly into the microphones so that everyone in the audience can hear the conversation. Councilperson Lichty stated that in conversations with members of the Waterloo Police Department, they have supported the idea of a "peephole" in the doors of taverns. This would allow them to know the circumstances before they enter a tavern. Police Chief Shook stated that such an ordinance would be beneficial to his officers. This thirty (30) foot building setback line is parallel to Cataract Avenue, located along the northeasterly property line of Lot 150, Crestview Second Addition. This area is shown on the attached plat and is legally described in Exhibit "A" attached hereto. The thirty (30) foot building line is proposed to be reduced to fifteen ( 15) feet. Since this particular property is located on a corner, the zoning ordinance would require that the setback along Cataract Avenue be no less than one-half the front yard distance of the adjoining structures. The adjoining properties would appear to be at or near thirty (30) feet; therefore, the platted setback line is proposed to be reduced to fifteen (15) feet which would appear to be in compliance. The Commission and utility companies have no problems with this request. It was unanimously recommmended that the request be approved by the City Council . We would ask that the City Council set a date of public hearing and publish an official notice pertinent to the request. The property is located between Baker Street and Chicago & Northwestern Railroad tracks, and approx- imately 250 feet east of Hallowell Road. This parcel is shown in the shaded area on the attached base map and is legally described in Exhibit "A". The applicant currently operates a business that uses heavy equipment and machinery for various types/aspects of paint striping. This operation of paint striping involves airport landing strips, centerlines/road edges of highways and streets, parking lots, etc. Much of the equipment and supplies used are currently stored outside and in buildings at other sites in the City. The property to be rezoned is a low lying area that is considered to be a wetland. The applicant proposes to drain this area and deposit fill material in order to raise the ground elevation. A 60 X 120 foot building will then be erected for purposes of storing equipment and material . This will allow various aspects of his business operations to be in a centralized location. At the Planning and Zoning Commission meeting, it was pointed out that utility services are available in this area, but will require an extension of said services to this site. It was also noted that access is not currently provided onto Baker Street, but this property will continue to use the private access drive located to the east. The Planning and Zoning Commission held a public hearing pertinent to this rezoning request on May 14, 1986. Prior to this hearing, notices were mailed to property owners within 250 feet of this property to be rezoned. Objections were presented by three (3) property owners for this request. Their concerns pertained to noise; the other permitted uses of the "M-1 " Light Industrial zoning district; possible access onto Baker, Corrine Streets and Hallowell Road (residential neighborhood) ; the proposed use/operation may jeopardize the residential neighborhood ' s serenity; and the availa- bility of approximately sixty (60) acres of land already zoned "M-1" to the east. As you are aware, the Board has refused to reconsider its decision. The next step for the City Council is to determine whether to petition the District Court to hear the dispute. As you know, the neighbors on Reber Avenue have asked you to do this on their behalf. The first issue to be determined, is whether the City Council has the power to petition the Court for such a Writ . Section 414 .15 of the Code of Iowa (1985 ) states: "Any person or persons, jointly or severally, aggrieved by any decision of the board of adjustment under the provisions of this chapter, or any taxpayer, or any officer, department, board, or bureau of the municipality, may present to a court of record a petition, duly verified, setting forth that such decision is illegal, in whole or in part , specifying the grounds of the illegality. Such petition shall be presented to the court within thirty days after the filing of the decision in the office of the board. It would be our view that the City Council could be determined to be "person or persons , jointly or severally, aggrieved by any decision of the board" or could be determined to be a "board or bureau of the municipality" under this section and therefore have standing to bring the action. This might be subject to challenge but notwithstanding this fact there are a number of other reasons in our opinion why the Council should not enter into this dispute as an advocate for either side. ( 1) The most substantial argument against the City Council petitioning for Certiorari is that the Board 's decision does � f Mayor and City Council May 16 , 1986 Page 2 not seem to be illegal. A party which petitions for a Writ of Certiorari claiming an illegality of the Board of Adjust- ment ' s decision has the burden of proof to show the illegal- ity of this decision. Board of Adjustment of Des Moines v Ruble , 193 NW2d 497 ( Ia. 1972 ) . Furthermore, the findings of such a Board may not be overturned, by the Court , upon Certiorari review when the findings are supported by sub- stantial evidence unless it is shown that the findings resulted from the application of an erroneous legal standard. Giesey v Board of Adjustment of Iowa City, 229 NW2d 258 ( Ia. 1975 ) . It does not appear from our investiga- tion of the facts that the Board has done anything which would be illegal or that it has applied an erroneous legal standard. Accordingly, there is no legal basis to file such a Petition for Writ of Certiorari. ( 2 ) There is an essential conflict in having the City Council suing one of its Boards . The inherent conflict results in the unnecessary expenditure of city funds in which the City would both be required to, under these circumstances , prosecute the claim on behalf of the neighbors on one hand and on the other have to employ outside counsel to defend the Board of Adjustment . This is especially true in what constitutes a neighborhood dispute and not a city-wide matter of concern. In addition, the minutes indicate that at the Board of Adjustment meeting that one of the neighbors was represented by their own counsel. ( 3 ) The purpose behind the creation of the Board of Adjust- ment is to avoid having political decisions enter into zoning disputes. By the City Council working as an advocate for a neighborhood group in this manner, this insulation from politics is eliminated which violates the spirit of as well as the intent of Chapter 414 . The Mayor and Council have the ultimate ability to determine how these matters are handled by the persons whom it appoints to the Board of Adjustment and this is the manner in which this matter should be resolved. Accordingly, it is our advice, based upon the above and foregoing reasons , that you should, for the above-stated legal reasons , decline to become involved in this dispute . V ry truly your , ugh . Field City Attorney HMF: lc • CITY Op WATERLOO, I OVA COUNCIL RECORD The Mayor announced that the time had arrived to hear discussion on the proposed resolution of City participation with regard to litigation against the Waterloo Board of Adjustment for their action taken on variance at 600 Reber (Case No. 289 of April 22, 1986) . Dave Dutton, attorney representing the neighbors of the Reber Avenue area, stated that this variance would pose a threat to the neighborhood. He also stated that there are three arguments that the action taken by the Board was improper: (1) Iowa Law requires that the Board of Adjustment publish its rules of procedure of how appeals are made by citizens, etc. No such rule publication has occurred: (2) Each decision of the Board must be addressed in writing. He stated that the minutes of the meeting do not accurately reflect the contents of the discussion during the Board Meeting and (3) that the continuation of a nonconforming use is not the intention of the zoning ordinance. He also stated that the City of Waterloo should take on the burden of challenging these issues to determine whether or not the Board acted legally. Discussion followed on who would be responsible for payment of attorney fees should the City take action against the Board of Adjustment. Hugh Field, City Attorney, reiterated his communication to the Mayor and Council of May 16, 1986. He recommended that the Council decline involvement in this dispute. Councilperson Wright expressed concern of deciphering between two clear issues: (1) whether the Board of Adjustment action was illegal and (2) whether the Council could take action against one of its own boards and commissions. Kay Buehler, co-owner of the property at 600 Reber Avenue, stated that she regretted the controversy and attitudes that have eminated from this situation. She stated that they had tried to keep the business operating but that with the controversy they have been losing their cooperative attitude. She stated that much of the business of the Auto Parts Store will be wholesale. Dave Primmer, tenant of the building at 600 Reber Avenue, stated that he had lived in the Reber Avenue area since 1955. He invited Council members to view his operation. Chuck Demuth, 801 Reber Avenue, asked the Council how three people (members of the Board of Adjustment voting on the prevailing side of the motion) could control the, lives of 96 people. He also stated that this is the first time he has heard the tenant address his business as being wholesale. He asked the City to enforce its ordinances and again questioned why the Board of Adjustment was the first body to act on this variance. Ken Buehler, co-owner of property at 600 Reber Avenue, stated that the petition containing the signatures of 96 people opposing the variance were not all associated with the area. He stated that the petitioners favored the building to remain vacant. He stated that the Council should go ahead and take the matter to District Court and that they were willing to hire their own attorney to defend them. Dave Dutton cited several Iowa Supreme Court decisions regarding the actions of Board of Adjustments. Councilperson Seeber asked if there was any other recourse than to take the Board of Adjustment to court. It was stated that Council members have power over the appointment of members to the Board of Adjustment. It was stated that there is no other precedent for a City suing one of its own boards or commissions. There was discussion on allowing "parking on the parking" as is done at 600 Reber Avenue. Mayor McKinley stated that the question boiled down to whether or not the Council was willing to pay the legal costs that would be incurred for hearing this case in court. The installation shall meet the requirements of local municipal,county,state,and federal laws,franchise rules,and regulations, regulations and directives of the Iowa State Commerce Commission, Utilities Division, the Department of Water, Air and Waste Management, all rules and regulations of the Iowa Department of Transportation,and any other laws or regulations applicable. 3. The permit holder shall be fully responsible for any future adjustments of its facilities within the established highway right of way caused by highway construction or maintenance operations. 4. The Iowa Department of Transportation shall give the permit holder at least 48 hours notice of any proposed construction or maintenance work, on either existing or newly acquired right-of-way, that is likely to conflict with the installation belonging to the permit holder in order that the permit holder may arrange to protect its facilities. 5. The State of Iowa and the Iowa Department of Transportation assume no responsibility for damages to the permit holder's property occasioned by any construction or maintenance operations on said highway if permit holder has been notified in accordance with stipulation number 4 above or if the facilities is not located in accordance with this permit. 6. The permit holder shall take all reasonable precaution during the construction and maintenance of said installations to protect and safeguard the lives and property of the traveling public and adjacent property owners. 7. This agreement is merely a continuation of the existing agreements with all terms and conditions remaining the same. As you will note, the Credit Union is responsible for payment of monthly rent in the amount of $200.00 as well as payment of utilities and telephone. Three Resolutions are necessary due to the fact that on March 15, 1985 the City Council authorized them to be made in the current 1985-1986 Fiscal Year Budget. (1) TAX INCREMENT TO THE DRRT SERVICE Money from the tax increment financing district that has been collected and transferred to pay for the General Obligation Bonds for work performed in the financing district (2) FEDERAL REVENUE SHARING TO THE GENERAL FUND Federal Revenue Sharing money that was budgeted to pay a portion of the Police and Fire Salaries within the General Fund. (3) TRUST AND AGENCY TO THE GENERAL FUND Tax Money collected outside the General tax levy to pay a portion of the Police and Fire IPERS and Insurance within the City General Fund . Two Resolutions are necessary due to the City Refinancing it's of Sewer Revenue Bonds and the adoption of the Bond Covenant due to the sale of these bonds. (4) SEWER FACILITIES FUND TO THE SEWER REVENUE DEBT SINKING FUND Money from sewer revenues being deposited to the Debt Sinking Fund for Payment of the Sewer Revenue Bonds and Interest that were sold in December 1985. (5) DEBT SERVICE FUND TO THE SEWER REVENUE DRRT SINKING FUND. Money deposited in the Debt Service fund for payment of Sewer Bonds, but, due to refunding and issuance of Sewer Revenue Bonds in December 1985 the Bond Covenant states that these be paid from the Sewer Revenue Debt Sinking Fund, thus this transfer shifts the money to the correct fund. Hwy. 218/I -380) and north of vacated Easton Avenue. This easement is shown in the shaded area of the attached base map and is legally described in Exhibit "A" attached hereto. This forty (40) foot sanitary sewer/public utility easement is located over an existing ten (10) inch sanitary sewer. It is also proposed to extend city water along the east side of this easement for future development and better fire protection. All utility companies and city departments have been given an opportunity to review this proposal . The Planning, Programming and Zoning Commission unanimously approved the acceptance of this sanitary sewer/public utility easement at their regular meeting on May 14, 1986. It is requested that a resolution pertaining to the City' s acceptance of this easement be adopted. REQUESTOR: City Engineer GENERAL DESCRIPTION: The sanitary sewer easement to be dedicated is located approximately 490 feet south of Mitchell Avenue and 240 feet west of the Iowa Northern Railroad. The easement is described as a 40' X 790' strip of land extending north from the southerly right-of-way line of Easton Avenue. There is an existing ten (10) inch sanitary sewer line that will be entirely within the easement. This sewer line has been in place for quite some time and apparently the existing easement does not adequately provide for future maintenance or repair of the line. IMPACT ON NEIGHBORHOOD: Since the sanitary sewer is in place at this time, it would appear the request would have a positive impact on the neighborhood, as it will provide service for future development. TRAFFIC CONDITIONS: Easton Avenue in this vicinity is in the process of being vacated. There are plans being made to extend Texas Street north from where it currently ends at Locke Avenue to provide access to the proposed U.A.W. site. It would appear that this request will have no significant impact on existing traffic patterns or conditions. UTILITIES: All utilities currently exist on the site and are adequate. It appears that no major relocations will be necessitated by this request. RELATIONSHIP TO PLAN: The acceptance of this sanitary sewer would appear to have no significant relationship to the plan. STAFF ANALYSIS: The ten (10) inch sanitary sewer existing in this area would appear to be adequate for the needs of the existing development. The property over which this easement is located is owned by the City and the dedication has been initiated by the City Engineer in order to correct the alignment of the easement in relation to the existing sanitary sewer. The staff recommends acceptance of the forty (40) foot sanitary sewer easement. Jim Rodemeyer, Personnel Director, stated that the proposal included a 1 .5% increase for employees on July 1 , 1986, with a 2.5% increase on January 1, 1987. This resulted in a total increase of 2.75% which is identical to the negotiated agreements with bargaining units. Councilperson Angel objected to across the board increases. She stated that a performance appraisal system should be implemented and raises judged according to their review. The Mayor indicated that a performance appraisal system will be initiated soon with department heads being evaluated by the Mayor. He also stated that he knew of no recommendations not to raise any department head 's salary. Councilperson Angel indicated that they had been mislead during labor strategy sessions. Councilperson Seeber acknowledged that giving a percentage increase is not always the best method but the only method available at this time. Councilperson Lichty objected to a percentage increase for management employees. Councilperson Budak stated that it would be difficult not to give management equal raises to that given to the bargaining units. Moved by Budak, seconded by Seeber that "Resolution approving a 1.5% increase for employees on July 1 , 1986 and 2.5 increase on January 1, 1987", be adopted. Ayes: Six. Nays: Lichty. Moved by Seeber, seconded by Wright that the 12 Administrative Secretaries currently classified in Range C be placed in Range D, effective July 1, 1986 and in Range E, effective January 1 , 1987 and a commitment made to move them into Range F on July 1, 1987, and that the Secretary currently classified in Range E be moved to Range F on January 1 , 1987 and that the salary of the Administrative Secretaries in the Parks Department, Police Department and Fire Department be placed in Range F whenever they become vacant. Councilperson Budak also stated that with the deletion of the Assistant Fire Chief from the FY87 Operating Budget, that the positions of Division Chief be made the same as Captains in the Police Department. Jim Rodemeyer indicated that an assessment will be made later in the year to evaluate this recommendation and that a recommendation will go to the Reorganization Committee on this matter. Councilperson Angel indicated that she disagreed with the hiring of an outside consultant to evaluate the jobs of the Administrative Secretaries as has been proposed. She stated that the present Personnel Department should be able to undertake •this study and ignore the personalities of those people within those positions. Councilperson Seeber stated that he felt that the management staff should not be treated as second-class citizens and that the Council should be commended for giving raises within the confines of the budget. On May 6, 1986, Captain Mike Beener forwarded to City Clerk/Auditor Larry Burger, a report detailing the results of our inspection of four (4) taxicabs. Captain Beener's report indicated several items not in compliance with the following City Ordinance Sections: Sec. 36-21. Compliance with chapter provisions. (a) Every driver licensed under this chapter shall comply with all city, state and federal laws. Failure to do so will justify suspension or revocation of his license. (b) Prior to the use and operation of any vehicle under the provisions of this chapter, said vehicle shall be made to comply with all applicable requirements of the state motor vehicle code or other state and city laws. Sec. 36-22. Vehicles kept in clean and sanitary condition. Every vehicle operating under this chapter shall be kept in a clean and sanitary condition.
