RECEIVED DEC 1 8 1998 MEMORANDUM OF AGREEMENT BLACK HAWK COUNTY/CITY OF WATERLOO THIS AGREEMENT is made and entered into this ti-t day of tece4,1oerr, 1998, by and between the Black Hawk County Health Department,hereinafter referred to as DEPARTMENT, and the City of Waterloo, Iowa, hereinafter referred to as CITY. WHEREAS, the CITY wishes to confer upon the DEPARTMENT the jurisdiction to act as the • local Board of Health pursuant to Chapters 137, 170A, 17 OB, 191A,and 455B,Iowa Code 1997,within said CITY, and WHEREAS,the Code of Iowa, Chapter 137, Section 6 provides that the DEPARTMENT may,by agreement with the Council of the CITY, enforce appropriate ordinances of said CITY. NOW, THEREFORE, it is agreed and understood as follows: 1. The DEPARTMENT will enforce all of the following ordinances or ordinance sections as listed in the Waterloo Code of Ordinances, 19-89 9 7 for and on behalf of the CITY: (a) Food and Food Handlers - Chapter 15 (pursuant w itlr to Chapters 170, 170A, 170D, a11d 191A 137. 137C. 137D. 13=F of the Code of Iowa, -1-9$9 1997.) (b) Garbage and Refuse - Sections 16.11, 16.12, 16.13, 16.14, Articles 2 and 3. (c) Junk and Junk Dealers - Division 2. Auto Salvage Yards - Section 21.56. (d) Nuisances - Chapter 26 (appropriate sections). ••1 (f) Swimming pools - C11aph r 33.2. .)(Pursuant to Chapter 1351 of the Code of Iowa ) (g) Vehicles for Hire - Section 36.22. 36.24 (h) Private SewaQ.e diSnosal facilities - Pursuant to Iowa Code Section 455B.172. (i) Private Water well construction - Pursuant to Iowa Code Section 455B.172. (1) Waste and Used Tires - Chanter 14. Article 1'. (k) Second hand Goods dealers - Chanter 23 (appropriate section). (1) Tannin, Facilities - Chapter 136D of the Code of Iowa. (m) Tatoo establishments - 135.3 of the Code of Iowa. in) Funeral Homes - Chapter 156.10 of the Code of Iowa. (o) Garbage and Trash - Count,:Health Regulation 4-95 (formerly City Ordinance Chanter 16, Article II). fp) County Health Department Lead Hazards - Regulation 2-88. (q) Litter and trash - Chapter 23 - with the following exceptions - • 1. Section 23 `.,. -7.1 - Junk Motor Vehicles si 2. Section 23 ',! - 7(h) & (c)and similar sections of Chapter 26 addressing unauthnri_ed .1 accumulations on properties containing residential or commercial Structures. 2. The DEPARTMENT will provide non-ordinance Public Health Services as follows: (a) Mosquito Control - THE DEPARTMENT will provide approximately 400 hours of mosquito surveillance, larvicide and adulticide control per season. (Actual control hours will be determined by predicted or actual mosquito concentrations). (b) Pest Control - Pest monitoring and control will be provided to listed City buildings (Appendix I). 3. The city will reimburse the DEPARTMENT for services supplied within the limits of said City as follows: (a) During the of contract period, the CITY agrees to pay the DEPARTMENT the monthly sum of S7,488 S6,250. The first payment will be due July 1, 1999. Subsequent payments will be conveyed the first of each month. (1) The monthly sum may also be adjusted to reflect additional services by the CITY or DEPARTMENT if mutually agreed upon in advance. Said reimbursement shall be renegotiated each December for the following fiscal year. (b) The DEPARTMENT shall receive all fees for public health services performed within the CITY. 4. Additional items of mutual agreement are hereinafter recited: 3 (a) Copies of minutes of all Black Hawk County Board of Health meetings during the term of this agreement will be transmitted to the CITY. An activity log will be maintained by the DEPARTMENT. (b) Certain items of personal property owned by the CITY will be loaned to the DEPARTMENT for the purpose of carrying out the provisions of the contract. Such items shall remain the property of the CITY. A current list of loaned items is attached • (Appendix II) and shall be maintained on file by both the CITY and the DEPARTMENT. City Public Woiks Detraitinw1t. Future vehicle replacements will be determined each December by joint agreement between the City and the Black Hawk County Health Department. (d) Black Hawk County Board of Health is the designated Board of Health for the City of Waterloo, Iowa. 5. This agreement shall become effective on Jan. 1, 1999 and shall continue unless amended in writing in a manner agreeable to both parties. This agreement may be dissolved by either party. Notice of termination shall be at least ninety(90) days in writing.
