COUNCIL WORK SESSION
August 15, 2022

Members present: Boesen. Nichols,
Amos, Grieder, Wilder and Feuss. Mr.
Chiles anived at 4:15 p.m.

that the Agenda, as proposed, be
approved. Voice -vote Ayes: Six. Motion

that the Minutes, as proposed, for the
Regular Session on Monday, August 1,
2022, al 5:30 p.m., be accepted and
approved. Voice vote -Ayes: Six. Motion

Objective: Discussion of changes to Title
1, Rules. of Procedure.
Kelley Felchle, City Clerk, provided a brief
overview of Article C — Code of Ethical
Conduct and Artide D — Censure. She
explained that the purpose of having a
code of ethical conduct is to set a
common standard for expected behavior,
which council and board and committee
members will be held to. She noted that it
is becoming more common for cities
across Iowa to include a code of conduct
in their city code.
Mr. Boesen questioned it board members
will be provided a copy.
Kelley Felchle, confirmed.
Kelley Felchle reviewed the proposed
changes to Article D. and explained that it
includes certain requirements that the
council member making an allegation of
censure must present, such as a specific
code or policy and why they believe it was
violated. The proposed change also
places a limitation of six months from the
time of a violation to when a complaint
can be filed.
Mr. Boesen commented that the time
limitation should be 90 days, because if
something is egregious enough to pursue
censure it should be handled more
quickly. He appreciates that according to
the document, that the points of censure
will not be aired publicly.
Mr. Grieder concurred with 3-month
timeline.
Mr. Chiles questioned 1 the 3-months
includes the time it would take for a
proper investigation.
Kelley Felchle clarified that it would not
include the investigation portion, just the
time that one has to bring the allegation
forward after the volaton.
Mayor Hart provided a scenario where
three months passed before anyone
found out abouta violation.
Kelley Felchle clarified that the proposed
wording states six month from the time of
discovering the violation.
Mayor Hart commented that the change
from six months to 90-days is a great
compromise along with the clarification
that it would be 90-days from becoming
aware of the violation.
Mr. Feuss questioned if there was any
wording dealing with an allegation against
an outgoing councilperson.
A lengthy discussion on censure followed
amongst Councilmembers, Mayor and the
City Attorney.
Mr, Boesen requested council consider
removing the 5th Monday Planning
Sessions because they have turned into
mini -council meetings. He commented
that the timely submission of agenda
items by department heads has fallen by
the wayside and often use the Planning
Session to submit items that should have
been submitted at the regular meeting. A
Work Session would be a better use of
the time.
Mr. Grieder agrees that the meetings
should be tightened up so they are not
mini -council meetings. He suggested
using the time to discuss budget priories,
CIP and long -tens infrastructure needs,
etc.
Mayor Hart spoke to the importance of
identifying a regular goal -setting sched-
ule, whether that is the 5th Monday or
another time.
Mr. Feuss commented that the 5th
Monday would be a good time for the
goal -setting meetings, as finding an
additional time for at least tour council -
members to get together would be very
difficult
Objective: Discussion of amendments to
the plumbing and mechanical code.
Greg Ahlhelm, Building Official, explained
that updates am needed as the state has
moved to updatedplumbing and mechan-
ical codes. No changes would be needed
in addition to adopting the 2022 mechani-
cal code but changes in addition are
needed for the plumbing code.
Bob Os Plumbing Inspector, ex-
plained the majority of the amend-
ments are dates and the removal of
out-of-date items. He reviewed additional
changes including the allowance of
nonmetallic plastic water lines from the

Mr. Boesen questioned if the city staff
worked with the Water Works on the
plastic piping.
Bob Osgood confirmed.
Mr. Boesen commented that his concem
is what happens when the location of the
plume changes due to migration.
Mr. Nichols questioned what the process
looks like for identifying plumes.
Bob Osgood explained that the DNR has
a mapping system with all of the plumes
and the problem areas are known. The
map will show if a particular location is
within 500 feet of the plume area.
Mr. Nichols questioned how it is moni-
tored and what is the notification process
from the DNR if the plume has migrated.
Bob Osgood explained that the DNR
would notify residents that the plume had
migrated then the homeowner would have
to switch from plastic pipe to copper
pipes.
Mr. Chiles questioned if this has
happened prior.
Bob Osgood commented that he is not
aware of instances where this has
happened.
Mr. Boesen commented that on the East
Side of Waterloo they are constantly
moving monitoring wells.
Bob Osgood commented that they
continue to monitor the former chamber-
lain site and that would be an area of
concern.
Mr. Amos clarified that homeowners
would have the option of going with a
copper pipe.
Mr. Nichols questioned how far plumes
migrate.
Bob Osgood shared that he is unsure.
