Mr. Getty asked why the agenda says formerly known as 1604 Garden Avenue. Tim Andera,
associate planner, stated it is known as that because the home that is was there that the City
acquired throught the 657a process was known as 1604 Garden Avenue. Mr. Getty asked if it
will be used for the new residence too. Mr. Andera stated it could be depending on where the
house is located on the lot. Mr. Schmitt asked if this is the property that gentlemen spoke of a
few weeks ago? Mr. Andera stated yes.

Mr. Getty asked how many companies are available to bid on asbestos removal. Louis Starks,
Contracts and Grants Coordinator, stated as a rule of thumb no less than three, preferably four to
five companies, we try to solicit bids from. That is pretty much the universal approach at all
times. Mr. Getty stated I have a little problem with this asbestos stuff because it always seems
that we will put it out for bid and these companies bid on it and all of sudden they come back and
say they missed something and we found something else. Well I am not buying that anymore
because of the fact that they are professionals, they bid on it, then that is the contract. Mr. Starks
stated I think, I am going on memory, because I don't have any documentation but I think we
have been pretty good as far as not having any change orders and I totally agree with what you
are saying. I would just say on balance, it is sort of like when you get some street repairs or
reconstruction, there are things that are unseen or unforeseeable. So just moving forward I would
just encourage you to weigh that on balance. I think we have been pretty good as far as not
having any needless or very high change orders but your point is well taken.
Noel Anderson, Community Planning and Development Director, explained that we utilize a
two-step process. We go through and do asbestos surveying. What their job is to identify what
they believe through their experience could have asbestos. They take test samples and send them
to a lab and then we come back later and re-bid out a separate contract for the removal. That is
where sometimes, what you are talking about, is that the removal guys are in there tearing it out
and then maybe they find some more that was hidden by something else. They say hey this has
the appearance of asbestos as well. The first group that did the survey did not see it or did not
find it. It is kind of a two stage approach and one is supposed to check the other to make sure
they are removing things that have asbestos. Mr. Starks stated universally there haven't been
many change orders. But if someone would say this is asbestos in this podium, I mean you might
look at it visually and say there is or there isn't asbestos but then once you start to take it down
or dismantle it you might find that there is asbestos in this little nodule here. It is no different
than any other type of construction whether you are doing rehab, road construction, building
construction, so there are sometimes things that are unforeseen or not foreseeable. We have been
blessed that we haven't had that occur much at all.
Mr. Hart asked if these are all houses and smaller. Mr. Starks stated yes these are all single-
family homes. Mr. Hart stated we have been pretty descent on that regards with home. Mr. Starks
replied right. I would have to really press my memory to find a situation were we had a change
order and even when we have had change orders which have been pretty few and far in between,
they have been minimal. Mr. Schmitt stated given the conversation we are having now with the
Boswell proposal are all of these beyond rehab. Mr. Starks stated yes, we meet, the
subcommittee of persons Barry Stratton, Chris Western, Dave Zellhoefer and myself, weekly and
then we have our monthly meetings were Councilman Hart as well as Noel sometimes Rudy, so
we try to get a consensus that these are goners versus fixer uppers.

Mr. Getty asked the Clerk to explain the item. Suzy Schares, City Clerk, stated the contracts are
up on all three of the services. For the local and long distance, that is not the phone service in
house, that is the service to bring it to us and then of the long distance and the wireless is the City
cell phones. They have all been expired now for a while. Mr. Getty asked who has our service
now? Mrs. Schares stated that Verizon has our local and long distance and Sprint has our
wireless.

Moved by Welper, seconded by Getty that Authorization to approve request of Jonathan Boswell
of Boswell Properties to purchase four (4) city owned residential properties located at 720 W.
Park Avenue, 312 Charles Street, 116 Parker Street and 261 Cottage Grove at a cost of$3,500.00
per property for a total of $14,000.00 and forward to the council agenda of August 2, 2010 -
Submitted by Noel Anderson, Community Planning &Development Director, be approved.
Jonathan Boswell, Boswell Properties, handed out a proposal of the project. He stated essentially
what I am looking to do, I have met with Noel and Chris and you guys have done a fantastic job
of taking over properties that are in serious need of rehab or demo. They have initially all been
slated to be demolished. What I would love to do is partner with the City to actually rehab some
of the better ones, instead of demolishing all of those properties. What I am looking to do is to
build a long-term relationship with you guys where we can take properties that are in disrepair
and fix them up and get them back on the tax roll. This package of four is a great way to start.
Just a little bit about myself, Boswell properties has 61 units in the Waterloo area. We are
currently rehabbing quit a few properties in the area right now. The before and after pictures that
you see in that packet, that is what we did in two and a half weeks. My crew, we are looking to
move very efficiently on these projects. Essentially what we do is we take houses that are in
disrepair and get them into a good rent condition, rent them out to people. Mark, my property
manager is here. He works full time for Boswell Properties. We also have part-time people who
help out as well. Mark runs the daily operations. I also brought one of tenants, Hope Reickers.
We work with several of the community organizations. Things like Operation Threshold, EMA,
Section 8, of course, Waterloo Housing. She can answer questions about our efficiency of
management and quality of management. If you guys have any questions as well. What we are
basically looking to do is to take these properties, rehab them and get them back into rentable
condition.
Mr. Getty, asked so this cost is all out of your pocket? Mr. Boswell replied, yes sir. Mr. Getty
asked if the 720 Park Avenue is that east or west. Mr. Boswell replied, that is west. Those are
right there pretty close to the Wellington, across from the churches.
Mr. Welper asked when you look to renovate these properties what do you look at first to decide
whether you want to keep or whether you think you can make it? Mr. Boswell replied the main
thing we look at is structural soundness. When I go in and inspect these properties the thing I
look at is the foundation, whether it is sufficient. What state the roof is in, the walls. I don't
really look at the cosmetics; I just look at the structure. I look for structural soundness and once I
feel that is sufficient, that it is worth saving, and then it is something I would be interested in.
But mainly I look at the roof, foundation, structure. Is it leaning? That sort of thing.
Mr. Getty stated you want to buy these for$14,000 correct? Mr. Boswell replied yes sir.
Mr. Welper asked do you tend to look at more abandoned properties rather than dilapidated? Mr.
Boswell responded for example the 720 Park is right next to the 8-plex, which is in really bad
condition, but that area of town with the architecture across the street, and some of the churches
in the area, could really be a good area. So I look at that property. I know that that one particular
has had drug issues, people in there. I think that is just a lack of good management to be honest.
What I look for are properties that are not just representing an opportunity within that particular
property but also the area. If we were to get myself and my company into there, with good
management and also I am interested in purchasing some other properties in that area as well. I
think we could really do something with that street, which I think is exciting to me. So it isn't
just the structure, it is also the neighborhood around it and the proximity to other properties that I
am interested in.
Mr. Getty asked Ms. Reickers if he is a good landlord. She replied yes, I have children and I am
real picky. Mr. Getty stated Mr. Boswell, I am going to give you a chance. I think everybody

Noel Anderson, Community Development Director, stated yes, Mr. Ridgeway from Fortunes
Tap, we will put together a development agreement to spell out the needed easements and all
that, but one of the other things it will say is that he will acquire this for one dollar and in the
agreement that if Operation Threshold buys him as planned that he convey that to them for one
dollar with the site plus any costs he may put into it. That way he doesn't turn around and want a
bunch of money for the site.
Mr. Welper stated so there is a possibility that he could still be there, that Operation Threshold
not buy him out. Mr. Anderson replied that Operation Threshold is applying for more tax credits
as part of there project. They are moving along in the process. It is looking very faithful thats
going to get the extra funding. They are hoping to find out on that next month.
Mr. Getty stated I don't think Noel and them want to but if something happens and Oepration
Threshold didn't, I think the pressure would be on Noel and his people to find money to buy it.
To get rid of it so that complex or that campus can be complete. Mr. Welper stated OK I would
agree to that.

properties located in the Highway 63 Expansion Project Area: 1707 Logan, 1711 Logan, 1745
Logan, 1302 Logan, 1232 Logan, 1353 Logan and forward item to the Council Agenda—
Submitted by Community Planning & Development Director Noel Anderson.
Councilperson Welper stated that he was confused on how the city purchased 30 homes but only
ended up with only 6. Noel Anderson, Community Planning & Development Director, stated
that as part of the Highway 63 project the Iowa Department of Transportation (IDOT) is
purchasing the homes. And what they do is part of that is first off to offer the home to the
homeowner to retain it to be moved off the property for a permanent home. The IDOT did not
receive any bids on these homes here and since its past that timeline the city can still request the
homes for acquisition. The city has a developer that has come forward and would like to move
the homes onto city owned lots. So as part of the process the city needs to acquire the homes.
Staff is working on a development agreement with the developer essentially so that they put forth
some money in escrow. The one danger would be that the home would be moved and they
wouldn't finish the projects so the city would have to demolish the homes and so there would be
some demolition costs. Otherwise the developer would have a certain amount of time to move
the homes out of the Highway 63 corridor on to the new lot to save the homes and to create more
housing. Councilperson Welper stated that he is confused because the city has a bid on one and
the city is acquiring 6 and asked about the other 23 homes. Mr. Anderson responded that the
other 23 homes are to be demolished. The IDOT has put forth a strict timeline as to when the
homes are under demolition time so essentially they will be ready to move on with their project
this spring. Councilperson Getty asked if all of them are going to be demolished or if some of
them are sold by the state. Mr. Anderson responded that one of the homes has been sold and it
was to the original homeowner that decided to move it themselves otherwise the rest are going to
be demolished. Councilperson Schmitt stated that the other 24 are either not movable because
they are too big, not worthy of moving or a combination of both. Councilperson Cole stated that
nobody wants to move. Councilperson Hart asked that it was his understanding that there was a
walk through of the properties to see if they were sturdy and quality homes to be fit for a move.
Mr. Anderson responded that was correct. Mike Cook, Highway 63 CDC Chairman, stated that
he is involved because the CDC was looking for a potential source of income but with the
limited funds and expertise in development they work with the city and walked through some of
the homes. Mr. Cook stated that he thinks this is going to be a very good project for the city
because some of the areas that need in-fill and the houses will be able to be kept in the City of
Waterloo. He is proud of the team that came up with these issues to facilitate getting these
developers here to start to put together the housing and personally thanked staff and those
involved. Councilperson Greenwood asked if the city-owned lots are all identified that these
homes are going to be moved to. Chris Western, City Planner II, responded that he has been
working with the developer for several weeks. He drove to all of the properties that have been
identified as homes that would make a good fit in different areas of the city. Pictures were also
taken of the lots and will be matched with the specific homes. Councilperson Getty asked for a
list of homes and what lot they are going to. Mr. Western responded that he could do that and he
showed the developer more than enough lots they needed and it was up to them to decide where
they wanted to put each one. He stated that will all be in the development agreement and given
to Council. Councilperson Hart stated that there is actually one home on the agenda tonight. Mr.
Western stated that Mr. and Mrs. Burt at 1232 Logan Avenue are moving their own home to 522
Albany Street. He stated that there will also be a second lot available adjacent to their lot for
another home. The extra lot may be a potential place for another home that the developer may
choose to place one of the homes at. Councilperson Getty asked if these homes will cause any
problems like the 600 block of Donald Street. Mr. Western stated that he does not believe that it
will. This organization is in the business for doing these moves, they do this all over the country
and they are connected with the second largest movers in the country — Patterson Moving.

times if the city were to have the property appraised then it would be what the property is worth.
Yet at the same time using a price per square foot solely as the only means of determining value
is that is for the full site where this is a small sliver of the property which means it is still worth
$4.50 per square foot. The area is questionable unless we get another appraiser. Councilperson
Welper stated that he is not opposed of selling the property he would just like the council to be
involved in determining the price not the buyer. Mr. Anderson stated that he thinks staff
determined the price per square foot based on a price within 50-100 percent with a 5 percent
commission. Councilperson Getty stated that staff took $4.50 and multiplied that with 8,168
square feet. Mr. Anderson stated that was how the $36,756.00 came about. What Manatt's is
saying is the city reduce that by 75 percent because it is a small sliver of property instead of the
full site. Councilperson Greenwood asked that on the $5,000.00 take back on the demolition of
the encroachment area did that come from Manatt's encroaching on the levee system and also
asked if there are policies or rules on how far they could go against the total at one point in time.
Mr. Anderson stated that at one point property owners were allowed to go 10 feet from the levee
and thinks that it was possibly 5 years ago that the Army Corps. Of Engineers changed it to 15
feet. Mr. Anderson referred to the map and stated that along the riverfront the property lines are
not straight and are in fact jagged. So there is a chance that the property lines could not be
exactly determined so it is not that uncommon to find some small encroachments.
Councilperson Welper asked if Manatt's has to remove the concrete that is encroached once they
purchase the property. Mr. Anderson stated that the Army Corps. Of Engineers actually visits
annually to inspect the levee system and they are noted in their inspections that the
encroachments onto the levee systems must be removed. And engineering has to inform them
that they are been removed. Councilperson Welper asked if engineering would like to or would
have to. Mr. Anderson stated that the city always tries to do things in a friendly manner. Brad
Strauss spoke on behalf of Manatt's. He stated that the existing concrete that Manatt's is
removing at the request of the Army Corps. Of Engineers is there because a prior owner of the
property. So that is something that everyone agrees that at the request of the Army Corps. Of
Engineers needs to be removed. Mr. Strauss stated that the $4.50 per square foot comes from an
appraisal that was done of the entire Manatt property. While the 75 percent reduction would be
appropriate, regardless of whether the appraisal amount was high or low it is even more
appropriate in this case where the front portion of the Manatt property is more valuable and the
farther back of the lot the less useful it becomes. It is not the fact that it is accessible and
independent of their property but the less valuable it becomes. He thinks that the property in the
rear, if independently appraised, would appraise for a value substantially low at $4.50 per square
foot.

Moved by Welper, seconded by Greenwood that request to sell city owned property located at 1333
Leavitt Street for $1.00 to Iowa Heartland Habitat for Humanity, be approved. Ayes: Three. Motion
carried.
Mr. Welper stated that the request stated that the sale would be for $1.00 plus costs. He
questioned whether part of the cost would be $378 in back taxes that the City has paid. Noel
Anderson, Community Development Director, stated that the buyer would be covering recording
costs but that the City did not intend to collect for the back taxes since the buyer was picking up
the demolition cost.
Moved by Greenwood, seconded by Welper that request to grant permission for Planning
Department to take bids on the repairs and installation of fencing at the Chamberlain Site, be
approved. Ayes: Three. Motion carried.
Noel Anderson, Community Development Director, stated the fencing will fill in the gabs of
missing fence and based on the anticipated demolitions at site, this would prevent people from
wondering through the site. Mr. Greenwood asked if this area would remain fenced after the
demolition was completed. Mr. Anderson reported the City will be working with EPA for the
underground environmental and depending on what the outcome of what's required for
corrective action, the City will begin making the corrective actions. After that it will be
determined what portions of the fence can be removed. Mr. Getty stated that portions would have
to remain in place to fence off Gates Park Golf Course. Mr. Schmitt asked if the City was still
trying to salvage some of those buildings. Mr. Anderson stated the EPA reported that the
contaminate that is at there is not harmful in open spaces but can be harmful in contained spaces.
EPA recommends demolishing the existing structures.
