RESOLUTION NO. 2022-530 RESOLUTION ROBERT PETERSEN FOR A WAIVER FOR ELIMINATION OF THE SIDEWALK SECTION AND ALLOW USE OF COLORED CONCRETE IN THE CONCRETE APPROACH LOCATED AT 239 PAULINE PLACE. WHEREAS, the City Engineer has made written application to the City Council asking that Robert Petersen, be authorized and permitted to construct a concrete driveway, with the elimination of the sidewalk section and use of colored concrete in the approach, located at 239 Pauline Place, and legally described as follows: SITUATED IN THE COUNTY OF BLACKHAWK IN THE STATE OF IOWA DESCRIBED AS FOLLOWS TO WIT: A PART OF THE SOUTHEAST QUARTER OF THE SOUTWEST QUARTER OF SECTION NO. THIRTY-FOUR (34) TOWNSHIP NO. EIGHTY-NINE (89) NORTH. RANGE 00. THIRETEEN (13) WEST OF THE FIFTH PRINCIPAL MERIDIAN IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA, LYING WITHIN THE FOLLOWING DESCRIBED BOUNDARIES: COMMENCING AT A POINT WHICH IS TWENTY (20) FEET SOUTH OF THE NORTHWEST CORNER OF LOT NO. TWENTY-THREE (23) (NOW VACATED) IN LAKE PARK ADDITION; RUNNING THENCE SOUTH ALONG THE WEST LINE OF LOTS NOS. WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. ff V ‘1 'o Resolution 2022-530 Page 2 NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Robert Petersen to construct a concrete driveway, with the elimination of the sidewalk section and use of colored concrete in the approach, located at 239 Pauline Place, subject to the following conditions: 1. Work is to be performed by an approved and bonded contractor. 2. A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
