RESOLUTION ROBERT PETERSEN FOR A WAIVER FOR
ELIMINATION OF THE SIDEWALK SECTION AND ALLOW
USE OF COLORED CONCRETE IN THE
CONCRETE APPROACH LOCATED AT 239 PAULINE PLACE.
WHEREAS, the City Engineer has made written application to the City Council asking
that Robert Petersen, be authorized and permitted to construct a concrete driveway, with the
elimination of the sidewalk section and use of colored concrete in the approach, located at 239
Pauline Place, and legally described as follows:
SITUATED IN THE COUNTY OF BLACKHAWK IN THE STATE OF IOWA
DESCRIBED AS FOLLOWS TO WIT:
A PART OF THE SOUTHEAST QUARTER OF THE SOUTWEST QUARTER
OF SECTION NO. THIRTY-FOUR (34) TOWNSHIP NO. EIGHTY-NINE (89)
NORTH. RANGE 00. THIRETEEN (13) WEST OF THE FIFTH PRINCIPAL
MERIDIAN IN THE CITY OF WATERLOO, BLACK HAWK COUNTY,
IOWA, LYING WITHIN THE FOLLOWING DESCRIBED BOUNDARIES:
COMMENCING AT A POINT WHICH IS TWENTY (20) FEET SOUTH OF
THE NORTHWEST CORNER OF LOT NO. TWENTY-THREE (23) (NOW
VACATED) IN LAKE PARK ADDITION; RUNNING THENCE SOUTH
ALONG THE WEST LINE OF LOTS NOS. TWENTY-THREE (23), TWENTY-

THENCE NORTH ALONG A LINE WHICH IS PARALLEL WITH AND
THIRTY (30) FEET EAST OF THE EAST LINE OF SAID LOTS TO A POINT
WHICH WOULD INTERSECT A LINE DRAWN PARALLEL WITH AND
TWENTY (20) FEET SOUTH OF THE NORTH LINE OF SAID LOT NO.
TWENTY-THREE (23) (NOW VACATED) IF EXTENDED; THENCE WEST
ALONG A LINE PARALLEL WITH AND TWENTY (20) FEET SOUTH OF
THE NORTH LINE OF SAID LOT NO. TWENTY-THREE (23) (NOW
VACATED) TO THE PLACE OF BEGINNING.
SUBJECT TO ALL EASEMENTS, CONVENANTS, CONDITIONS,
RESERVATIONS, LEASES AND RESTRICTIONS OF RECORD, ALL
LEGAL HIGHWAYS, ALL RIGHTS OF WAY, ALL ZONING , BUILDING
AND OTHER LAWS, ORDINANCES AND REGULATIONS, ALL RIGHTS
OF TENANTS IN POSES SION, AND ALL REAL ESTATE TAXES AND
ASSESSMENTS NOT YET DUE AND PAYABLE.
BEING THE SAME PROPERTY CONVEYED BY DEED RECORDED IN
VOLUME LD 556, PAGE 942, OF THE CLACK HAWK COUNTY, IOWA
RECORDS.
WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request
should be granted.

NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted
to Robert Petersen to construct a concrete driveway, with the elimination of the sidewalk section
and use of colored concrete in the approach, located at 239 Pauline Place, subject to the
following conditions:
1. Work is to be performed by an approved and bonded contractor.
2. A permit is to be obtained from the office of the City Engineer prior to
construction.
3. All work shall be under the supervision of the City Engineer and at no cost
to the City of Waterloo.
BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward
a certified copy of this resolution to the Black Hawk County Recorder for recording and the
Black Hawk County Auditor for filing in order that this said action may become a matter of
official County Record.
PASSED AND ADOPTED this 15th day of August 2022.
