February 23, 2025 *** Proof of Publication *** CITY OF WATERLOO, IOWA SUMMARY OF ORDINANCE NO. 5662 On September 19, 2022, the City Council of the City of Waterloo, Iowa, adopted an Ordinance entitled 'Ordinance No. 5662, An Ordinance amending the City of Waterloo Code of Ordinances by repeal- ing Chapter 4, Mayor and City Council, of Title 1, Administration, in its entirety and enacting in lieu thereof a new Chapter 4, Maya and City Council, of Title 1, Administration' In compliance with City procedures for adopting ordinances and the laws of the State of Iowa, this summary of the Ordinance has been prepared for publication. 1. The descriptions in this section and paragraph 2, constitute a summary of the essential elements of the Ordinance. The Ordinance describes, clarifies, and re- states procedures relating to the opera- tion of the Office of Mayor and the City Council. 2. The Ordinance revises several sections and articles in Chapter 4. Significant changes to Chapter 4, include: a. Special meetings of the city council may be held in any meeting room in city hall, Such changes are found in Section 1-4-7. b. Appealing a parliamentary decision made by the presiding officer requires a second and is debatable. Such changes are found in Section 1-4A-7, c. Requiting council members to refrain from attacking personalities or motives of other members, limiting debate to the question on the table, and requiring council members to compel the presiding officer to enforce rules of decorum and debate by raising a point of order. Such changes are found in Section 14A-9. d. Prohibiting the public from requesting to remove items from the consent agenda during the council meeting and requiring the public to contact council members with such requests or questions. Such changes are found in Section 1-4A-16. e. Establishing rules for raising a point of order. Such changes are found in Section 14A-27. f. Sets the maximum amount of time the public can speak at three (3) minutes during the public comment section of the agenda and eliminates the registration requirement for public speaking. Such changes are found in Section 1-4A-33. g. Providing flexibility for the presiding officer on whether public comment will be received during a city council planning session. Such changes are found in Section 1-4A-36. h. Establishing a code of ethical conduct for elected officials and individuals appointed to serve on city boards and commissions. Seta financial parameters for substantial interests, establishes standards of conduct, procedures for disclosing interests, seeking advisory opinions, requirements for ex-parte com- munications, and establishes procedures for reporting ethical violations and enforc- ing the code of ethics. Such changes are lound in Article C. i. Amending the complaint procedure to clarify the process. Such changes are found in Section 14D-3. j. Prohibiting council members from amending the resolution to censure and clarifying that the individual who is subject to censure has the ability to speak to the contents of the censure resolution and findings within the investigation report prior 10 a vote on the censure resolution. Such changes are found in Section 1-4D-4. k. Establishing a new section allowing current elected officials to censure the conduct of a former elected official provided the complaint is Tiled within three (3) months of discovering the alleged violation. Such changes are found in Section 1-4D-5. 3. The full text of the Ordinance may be inspected at the Office of the City Clerk, City Hall, 715 Mulberry Street, Waterloo, Iowa 50703, Monday through Friday, between the hours of 8:00 a.m. and 4:00 p.m. The Ordinance will become effective upon publication of this Summary.
