RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN ON THE APPLICATION OF
CLAASSEN ENGINEERING ON BEHALF OF LOST ISLAND
REAL ESTATE, LC TO REZONE APPROXIMATELY 14.8
ACRES FROM "A-1" AGRICULTURAL DISTRICT TO
"R-1" ONE AND TWO FAMILY RESIDENCE DISTRICT,
51.4 ACRES FROM "A-1" AGRICULTURAL DISTRICT
TO "R -4,R -P" PLANNED MULTIPLE RESIDENCE
DISTRICT, AND 87.2 ACRES FROM "A-1"
AGRICULTURAL DISTRICT TO "C -P" PLANNED
COMMERCIAL DISTRICT, ALL GENERALLY LOCATED AT
THE NORTHWEST CORNER OF EAST SHAULIS ROAD AND
HESS ROAD, AS SEPTEMBER 7, 2010, AT 5:30 P.M.
IN THE COUNCIL CHAMBERS IN CITY HALL AND
INSTRUCTING CITY CLERK TO PUBLISH NOTICE OF
HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5:30 p.m. on the 7th day of September, 2010,
for the purpose of considering and acting upon an application of
Claassen Engineering on behalf of Lost Island Real Estate, LC to
rezone approximately 14.8 acres from "A-1" Agricultural District
to "R-1" One and Two Family Residence District, 51.4 acres from
"A-1" Agricultural District to "R -4,R -P" Planned Multiple
Residence District, and 87.2 acres from "A-1" Agricultural
District To "C -P" Planned Commercial District, all generally
located at the northwest corner of East Shaulis Road and Hess
Road, and legally described as follows:

The West Five Hundred (500.00) feet of the Southwest
Quarter (SW 1/4) of the Southeast Quarter (SE 1/4) of
Section Eleven (11), Township Eighty-eight North
(T88N), Range Thirteen West (R13W), of the Fifth
Principal Meridian, Waterloo, Black Hawk County, Iowa,
EXCEPT the South Thirty-three (33) feet as described in
Book 103, page 517 in the Black Hawk County Recorder's
Office, containing 14.8 acres, all in the City of
Waterloo, Black Hawk County, Iowa.

That part of the Southeast Quarter (SE 1/4) of Section
Eleven (11), Township Eighty-eight North (T88N), Range
Thirteen West (R13W), of the Fifth Principal Meridian,
Waterloo, Black Hawk County, Iowa, described as

Commencing at the South Quarter (S 1/4) corner of
aforesaid Section Eleven (11); thence N00001'16"E
Thirty-three (33.00) feet along the West line of
aforesaid Southeast Quarter (SE 1/4) to a point on the
North line of parcel described in Deed Book 103, page
517 in the Black Hawk County Recorder's Office and to
the point of beginning; thence N89°46'33"E One Thousand
Two Hundred Eighty-six and Eighty Hundredths (1286.80)
feet along said North line to the Southwest corner of
tract described in Land Deed 540, page 106 in aforesaid
Recorder's Office; thence N00°13127"W Seventeen (17.00)
feet along the West line of said tract to the Northwest
corner of said tract; thence N89046'33 One Hundred
Thirty and Thirty Hundredths (130.30) along the North
line of said tract; thence N00013127"W Ninety-five and

said West line to the point of beginning, EXCPET The
West Five Hundred (500.00) feet of aforesaid Southwest

containing 51.4 acres, all in the City of Waterloo,
Black Hawk County, Iowa.

North, Range No. Thirteen (13) West of the Fifth
Principal Meridian, Waterloo, Black Hawk County, Iowa,
except that part conveyed to Black Hawk County, Iowa,
for road purposes by following deeds: Book 103 at page
517, Land Deed 540 at page 106, Land Deed 544 at page
888, and Land Deed 538 at page 819.
AND EXCEPT the following described parcel;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
