RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE
OF CERTAIN EXCESS RIGHT-OF-WAY TO VERNER D. ?,
DONNA L. NELSON FOR $ 682.63 , PLUS COSTS AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE ANO DELIVER A DEED FOR SAME .
WHEREAS , the City of Waterloo, Iowa , is the owner of real
property in the City of Waterloo , Iowa , as described below, and
WHEREAS , an offer to purchase said c€ rtain parcel of real
property in the sum of $ 682.63, plus costs , has been made by
Verner D . E Donna L . l';elson , and
WHEREAS , a public hearine was held on January 11 , 19I2 at
7 : 00 P .F . in the Council Chambers in City Hall , waterloo, Iowa , as
provided by law, by the Council of the City of Waterloo , Iowa , on
the proposal to sell and convey premiss owned by the City of
Waterloo , Iowa to Verner D . & Donna L . Nelson , Waterloo , Iowa ,
and
WHEREAS , it is the opinion of this Council that sale and
conveyance should he made as proposed.
NOW , THEREFORE , IT IS HEREHY RESOLVED RY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS :
1. The following described real Property , as fully
described in the published notice in the Waterloo Courier on
Oecember 24, 1981 , is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its ownershir
is serving no municipal Purpose , and
2. That the offer of Verner n . Si ronna L. Nelson to
purchase real property for the sum of sty_ hundred eighty-two
63/ 100 dollars ( $ 682.63) and costs he , and it is hereby accented
for real property described below :
All that part of Lots 1 and 2 , Union ill Plat and that part of
the right-of-way of West Fourth Street (formerly fridge Street )
adjacent to Union mill Plat in the City of Waterloo , Mack Hawk
County, Iowa , lying within the following described property :
beginning at a point on the southwesterly line of said Lot
1 , which point is 3. 09 feet northwesterly from the most
southerly corner of said Lot 1 ; thence north 54°26 ' 47" east
a distance of 1?3 .00 feet , along a line which if extended
would intersect the northeasterly line of said Lot ? at a
point which is 2.00 feet northwesterly from the most
easterly corner of said Lot 2 ; thence south 57°00' 08" east a
distance of 2. 30 feet to the land side corner of the flood
wall ; thence south 9°29 ' 00" west along the flood wall face a
distance of 17. 90 feet ; thence south 4c° 19 ' 55" east along
the flood wall face a distance of 7 . 33 feet ; thence south
1°45 ' 23" east along the flood wall face a distance of 56. 39
feet ; thence south 47°07 ' 06" west a distance of 64 . 25 feet ;
thence north 48° 131 west along the extension of the
northeasterly line of Ceder Street a distance of 79. 00 feet
to the point of henirnine.
NOTE : Hearings are based on the northeasterly line of Cedar
Street bearing south 48° 13 ' east as indicated on Union mill
Plat.
AREA: 6826 . 3 sq. ft .
An easement will be retained over the entire parcel .

3. That the City of Waterloo , Iowa , convey said parcels of
real property to Verner D . .?! Donna L. Nelson by Quit Claim Deed ,
the form of which is hereto attached and approved.
4. That the ?layor and City Clerk are hereby authorized to
execute and deliver deeds to Verner D . Donna L . Nelson .
5. That the original of said deed fully executed and
acknowledged having been submitted with this Resolution , the same
is hereby approved and confirmed by the Council .
6. That the City Clerk is authorized and directed to
deliver said deed of conveyance to Verner fl . Donna L. "elson
upon receipt of the sun of six hundred eighty-two and 63/100 dollars
( 82.63) and costs .
