RESOLUTION APPROVING A REQUEST BY 5 BEES, LLC
(JONNY B. CONSTRUCTION), FOR AN APPEAL TO THE
CITY CODE REQUIREMENT PROHIBITING VEHICLES
FROM PARKING ON THE CITY -OWNED RIGHT-OF-WAY
OF WEST 16TH STREET, LOCATED ACROSS WEST 16TH
STREET FROM 1728 BLACK HAWK STREET, TO ALLOW
AN APPROXIMATE 20 FOOT BY 120 FOOT PAVED AREA
BETWEEN THE STREET AND THE PROPERTY LINE.
WHEREAS, 5 Bees, LLC (Jonny B. Construction), has made written application to the
Waterloo Planning, Programming, and Zoning Commission, appealing Section 273 of the Traffic
Code, adopted by Ordinance No. 4602, for the requirement prohibiting vehicles from parking on
City owned right-of-way, of West 16th Street, located across West 16th Street from 1728 Black
Hawk Street, to allow an approximate 20 foot by 120 foot paved area between the street and the
property line and legally described as follows:
LOT 5 OF BLOCK 12 IN HAYES ADDITION, CITY OF WATERLOO, IOWA
and,
WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that the request
of 5 Bees, LLC (Jonny B. Construction), appealing the City Code requirement prohibiting
vehicles from parking on city -owned right-of-way, of West 16th Street, located across West 16th
Street from 1728 Black Hawk Street, to allow an approximate 20 foot by 120 foot paved area
between the street and the property line, be approved.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the request of 5 Bees, LLC (Jonny B. Construction), appealing the
City Code requirement prohibiting vehicles from parking on City -owned right-of-way, of West
16th Street, located across West 16th Street from 1728 Black Hawk Street, to allow an
approximate 20 foot by 120 foot paved area between the street and the property line, be
approved.
PASSED AND ADOPTED this 17th day of October 2022.
