HomeMy WebLinkAbout1982-087-03.15.1982 RESOLUTION NO. 1982- A RESOLUTION ACCEPTING AND APPROVING CERTAIN OFFERS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS . WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, AND WHEREAS, the acquisition of the hereinafter described parcel is necessary to carry out the Hackett Road By-Pass Project. NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that the offer of the owner of the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which is situated in the City of Waterloo, Black Hawk County, Iowa, is accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owner thereof, and the deed for the conveyance of the same is also accepted and approved and the City of Waterloo is directed to pay for the property and the incidental expenses necessary to the consummation of the sale from City Funds with reimbursement from Federal Aid to Urban Systems Funds. Rooff, Mayor ATTEST: a y P. urger, Cit Clerk 30 EXHIBIT "A" The Taking is legally described as follows: All that part of the West Half Southwest Quarter of Section 21, Township 89 North, Range 13 West of the Fifth Principal Meridian, City of Waterloo, Black Hawk County, Iowa, lying within the following described boundary: Beginning at the point of intersection of the North right-of-way line of University Avenue (being 115 feet normally distant north- easterly from the centerline of University Avenue) with the East line of the West 498 feet of the West Half Southwest Quarter of said Section 21; THENCE North 72° 25' 42" West along the North- easterly right-of-way line of University Avenue a distance of 351.99 feet; THENCE North 52° 59' 05" West along the Northeasterly right- of-way a distance of 58. 00 feet; THENCE North 340 37' 20" East a distance of 169.79 feet; THENCE North 51° 16' 30" East a distance of 90. 00 feet; THENCE North 78° 00' 30" East a distance of 220.00 feet to a point on the East line of the West 498 feet of the West Half Southwest Quarter of said Section 21 ; THENCE South along East line of said West 498 feet a distance of 382.92 feet to the point of beginning. The bearings are based on the assumption that the East line of the West 498 feet of the West Half Southwest Quarter of said Section 21 bears north and south. The Taking contains an area of 2.20 acres. •
