A RESOLUTION AUTHORIZING THE SALE OF
DISPOSAL PARCEL NO . 42 b & c IN THE
LOGAN AVENUE URBAN RENEWAL AREA,
PROJECT NO. IOWA R-2 .
WHEREAS , an Urban Renewal Plan for the Westfield-Virden
Urban Renewal Area , Project Iowa R- 2, adopted by the City Council
of the City of Waterloo , Iowa by Ordinance No. 2202 , passed on the
3rd day of January , 1961 .
WHEREAS , the sale of a parcel of land described as Disposal
Parcel No. 42 b & c in the Logan Avenue Urban Renewal Area ,
Project No. Iowa R-2 , situated in Black Hawk County , Iowa , more
particularly described as :
All of Lots 1 , 2 , 3 , 4 and 5 in Cooley ' s Sub-
division of Lots 6 , 9 & 10 , Block 67 in Cooley ' s
Addition to the City of Waterloo , Black Hawk
County , Iowa .
Also all of Lots 7 , 8 and 11 , Block 67 of Cooley ' s
Addition to City of Waterloo , Black Hawk County , Iowa .
Also the east-west alley located in Block 67 , Cooley ' s
Addition to Waterloo , Black Hawk County , Iowa .
Also the north-south alley located in Cooley ' s
Subdivision of Lot 6 , 9 and 10 of Block 67 in Cooley ' s
Addition to the City of Waterloo , Black Hawk County ,
Iowa.
Also the north-south alley located in Block 67 , Cooley ' s
Addition to Waterloo , Black Hawk County, Iowa .
Also the above described property is subject to a 20
foot wide sanitary sewer easement described as , the
north -south alley located in Block 67 , Cooley Addition
to Waterloo, Black Hawk County, Iowa .
Containing approximately 60. 600 sq . ft .
which has been acquired for Urban Renewal purposes , is necessary
to carry out the aforesaid Urban Renewal Plan ; and
WHEREAS , said parcel of land is zoned R- 2 under the zoning
ordinance of the City of Waterloo and said Urban Renewal Plan ;
WHEREAS , Herbert Emily has made an offer to purchase said
parcel of land for the sum of six thousand six hundred dollars
($6 , 600 . 00) cash upon delivery of deed ; and
WHEREAS , The sale of said land under the conditions
described herein has been approved by the Community Development
Board , the agency of the City of Waterloo having supervision and
management of such land at its Board meeting held April 6 , 1982 .
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO , IOWA:
1 . That the terms and conditions of the proposed agreement
for the sale of the subject disposal parcel in the Logan Avenue
Urban Renewal Area , Project Iowa R-2 , more particularly described
as :
See above .
as set forth in the Proposal to Purchase Property for private
Redevelopment executed by Herbert Emily and the approved Contract
for Sale of Land for Private Redevelopment are satisfactory and
hereby approved.
2. That the Community Development Board agrees that the
proposed redevelopment of said land is the best use of the land in
accordance with the Urban Renewal Plan , and therefore , disposal of
said land to Herbert Emily is based on the Proposal to Purchase
Property for Private Redevelopment submitted by Herbert Emily .
m 3. That the prospective purchaser possesses the
qualifications and financial resources necessary to acquire and
develop said land in accordance with the Urban Renewal Plan .
4. That the proposed purchase price of six thousand six
hundred dollars ($6 ,600 . 00) is the fair market value of the land .
. That the Community Development Staff be and it is hereby
authorized to prepare a deed for the conveyance of said property
and to submit the same to this Council for final approval and
execution in the event said offer is accepted.
6.- ‹'That this action of the Council be considered to be and
in fact does constitute a notice to all concerned of the intention
of the Council to accept the offer of Herbert Emily to purchase
said parcel and to give a deed to the same after hearing and
notice .
7 . That the Deputy City Clerk be and is authorized and
directed to publish a Notice of Hearing in conformance with the
1979 Code of Iowa .
