RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE REQUEST
TO VACATE APPROXIMATELY 0.039 ACRES (1,697
SF) OF CITY RIGHT-OF-WAY AT 563 ARCHER AVENUE
NEAR THE SOUTHWEST CORNER OF DUBUQUE ROAD AND
COLORADO STREET TO CHARLES AND HOLLY RICH,
AND TO CONVEY A SMALL PORTION (52.5 SF) OF
THEIR PROPERTY AS IT EXTENDS INTO THE ALLEY
TO THE CITY OF WATERLOO AS DECEMBER 6, 2010,
AT 5:30 P.M. IN CITY HALL COUNCIL CHAMBERS,
WATERLOO, IOWA, AND INSTRUCTING THE CITY
CLERK TO PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa,
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 5:30 p.m. on the 6th day of December, 2010, for the
purpose of considering and acting upon a request to vacate
approximately 0.039 acres (1,697 SF) of city right-of-way at 563
Archer Avenue and sale and convey to Charles and Holly Rich, and
convey a small portion (52.5 SF) of their property as it extends
into the alley to the City of Waterloo, legally described as
follows:
563 Archer Avenue, Waterloo, Iowa:
A survey of Lot Thirteen (13), except the North forty
(40) feet of the East forty (40) feet of said Lot, and
Lot Twelve (12), except the North forty (40) feet of
said Lot, and except that part lying Northeasterly of a
line beginning at a point on the Easterly line of said
Lot Twelve (12) and the Westerly line of Colorado
Street, said point 94.82 feet North of the Southeast
corner of said Lot Twelve (12); thence Northwesterly to
a point on the Southerly line of said North forty (40)
feet of Lot Twelve (12), said point S89°59'16"W 14.92
feet from the Southeast corner of said North forty (40)
feet of Lot Twelve (12) and the point of termination of
this line; all in Block No. Four (04) of Linden Place
addition to the City of Waterloo, Black Hawk County,
State of Iowa, containing 12,960.0 square feet, or
0.298 acres, all in the City of Waterloo, Black Hawk
County, Iowa;
And
Property transfer to the City of Waterloo:
A survey of that part of Lot Twelve (12) in Block No.
Four (04) of Linden Place Addition to the City of
Waterloo, Black Hawk County, State of Iowa, more
particularly described as follows:
That part lying Northeasterly of a line beginning at a
point on the Easterly line of said Lot Twelve (12) and
the Westerly line of Colorado Street, said point 94.82
feet north of the Southeast corner of said Lot Twelve
(12); thence Northwesterly to a point on the Southerly
line of said North forty ( 40 ) feet of Lot Twelve (12) ,
said point S89059'16"W 14.92 feet from the Southeast
corner of said North forty (40) feet of Lot Twelve (12)
and the point of termination of this line, containing

52.2 square feet, or 0.001 acres, all in the City of
Waterloo, Black Hawk County, Iowa;
And
Property transfer from the City of Waterloo:
A survey of that part of the North forty (40) feet of
the East forty ( 40 ) feet of Lot Thirteen (13) , and the
North forty (40) feet of Lot Twelve (12), all in Block
No. Four (04) of Linden Place Addition to the City of
Waterloo, Black Hawk County, State of Iowa, more
particularly described as follows:
Beginning at a point on the North line of said Lot
Thirteen (13), said point the Northwest corner of the
East forty (40) feet of said Lot; thence S64051'20"E
93.98 feet to a point on the Southerly line of said
North forty (40) feet of Lot Twelve (12), said point
S89059'16"W 14.92 feet from the Southeast corner of
said North forty (40) feet of Lot Twelve (12); thence
S89059116"W 84.96 feet along the Southerly line of said
North forty (40) feet to the Southwest corner of the
North forty (40) feet of the East forty (40) feet of
said Lot Thirteen (13); thence N00009'42"W 39.97 feet
along the West line of the East forty (40) feet of said
Lot to the point of beginning, containing 1,697.2
square feet, or 0.039 acres, all in the City of
Waterloo, Black Hawk County, Iowa.
Section 2. That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
