RESOLUTION NO. 2016-273
RESOLUTION DIRECTING PROCESS FOR THE VACATE
AND SALE OF CERTAIN TRACTS OF LAND FORMERLY
PORTIONS OF WEST SAN MARNAN DRIVE RIGHT-OF-
WAY AND FIXING THE TIME AND PLACE OF HEARING
AND NOTICE TO BE GIVEN ON THE VACATE AND SALE
AND TAKING OF BIDS FOR SAID PROPERTY, SETTING A
BID OPENING AS JUNE 23, 2016 AND THE DATE OF
PUBLIC HEARING AS June 27, 2016, AT 5:30 P.M. IN
HAROLD E GETTY COUNCIL CHAMBERS, CITY HALL,
WATERLOO, IOWA, AND INSTRUCTING THE CITY CLERK
TO PUBLISH AND MAIL, NOTICE OF HEARING AND
TAKING OF BIDS.
WHEREAS, the City wishes to vacate, sell and convey certain portions of right of way
formerly being portions of West San Mannan Drive; and
WHEREAS, the City now wishes to sell the following described tracts in accord with
Iowa Code Section 306.23;
Tract l:
That part of the Southeast Quarter of Section 5, Township 88 North, Range 13
West of the Fifth Principal Meridian, Black Hawk County, Iowa, described as
follows: Commencing at the Southeast corner of said Section 5; thence
S89050'54"W 137.44 feet along the South line of said Section 5 to the point of
beginning on an extension Northwesterly of the existing right-of-way of
Ansborough Avenue; thence continuing S89°50'54"W 678.58 feet along the said
South line of said Section 5; thence Northeasterly 36.77 feet along a 50.00 foot
radius curve, concave Southeast, said'curve having.a chord of 35.95 feet bearing
N64°43'31"E; thence N85°09'49"E 118.28 feet; thence N87°59'00"E 493.93 feet
to the Northwesterly extension of the West right-of-way of Ansborough Avenue;
thence S40°10'56"E 53.66 feet to the point of beginning, containing 0.453 acres,
and is subject to utilities and drainage easement over, across, and upon`the entire
parcel.
Tract 2:
That part of the Northeast Quarter of Section 8, Township 88 North, Range 13
West of the Fifth Principal Meridian, Black Hawk County, Iowa, described as
follows: Commencing, at the Northeast corner of said Section 8; thence
S89050'54"W 137.44 feet along the North line of said Section 8 to the point of
beginning on an extension Northwesterly of the existing right-of-way of
Ansborough Avenue; thence S40°10'56"E 40.82 feet along,said right-of-way
extension to the existing intersection of the West right-of-way of Ansborough
Avenue and the South right-of-way of West San Mannan Drive; thence

'S89°07'02"W along the said existing south right-of-way 353.66 feet; thence S
87°52'32"W along said south right-of-way 365.40 feet to the east right-of-way of
Galactic Drive; thence NO°29'46"E 14.40 feet along a northerly extension of the
east right-of-way of Galactic Drive; thence Northeasterly 37.53 feet along a 50.00
foot radius curve, concave Southeast, said curve having a chord of 36.65 feet
bearing N21°59'26"E to the North line of said Section 8; thence N89°50'54"E
678.58 feet along the North line of said Section 8 to the Northwesterly extension
of the West right-of-way of Ansborough Avenue and the point of beginning,
containing 0.611 acres, and is subject- to utilities and drainage easement over,
across, and upon the entire parcel.

WHEREAS, the City has now obtained an independent appraisal of each tract from Rally
Appraisal, L.L.C. as follows:
Tract 1. $73,998
Tract 2. $99,807
and
WHEREAS,,present owners and original owners (except those who are deceased) have
been identified by staff,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
Section 1. It is directed that the above-described tracts of land be offered for sale in
accord with Iowa Code Section 306.23.
Section 2. City staff is directed to prepare in accord with Iowa Code Section 306.23
notices to be mailed by certified mail to such persons as are entitled to notice, and to publish
such notices, staff shall also prepare a sealed Offer to Buy form.
All bids shall be due on June 23, 2016 at 1:00 p.m. in the offices of the City Clerk upon such
sealed bid form as staff shall prepare, at which time bids will be opened in the First Floor
Conference Room at City Hall, 715 Mulberry Street.
Section 3. All bids ,received shall be considered by the Council at a hearing at its
regular meeting of June 27, 2016. The City Clerk is instructed to publish notice of hearing in
compliance with Iowa Code Section 364.7 prior to the regular Council meeting of June 27, 2016.
Section 4. That the Council of the City of Waterloo, Iowa, shall meet in the Harold
aE. Getty Council Chambers, City Hall, in the City of Waterloo, Iowa, at 5:30 p.m. on the 27th
day of June, 2016, for the purpose of holding a public hearing on the sale of certain tracts of land
formerly portions of West San Marnan Drive, in the City of Waterloo, with the taking of bids
therefore.
