RESOLUTION NO. 2022-713 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CITY-OWNED PROPERTY LOCATED ADJACENT TO 2122 WEST RIDGEWAY AVENUE, TO KWIK TRIP, INC., OF LACROSSE, WISCONSIN, IN THE AMOUNT OF $50,000.00, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the legal owner of property located adjacent to 2122 West Ridgeway Avenue, in the City of Waterloo, Iowa, and legally described as follows: PARCEL "D", SOUTHEAST QUARTER, SECTION 32, TOWNSHIP 89 NORTH, RANGE 13 WEST CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA PARCEL "D", BEING THAT PART OF LOT 3, BROCK THIRD ADDITION, IN THE SOUTHEAST QUARTER (SE 1/4) OF SECTION 32, TOWNSHIP 89 NORTH, RANGE 13 WEST OF THE FIFTH PRINCIPAL MERIDIAN (5TH PM), CITY OF WATERLOO, BLACK HAWK COUNTY, STATE OF IOWA, AND BEING FURTHER DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF LOT 1, BROCK ADDITION; THENCE SOUTH 89°10'40" WEST 400.01 FEET ALONG A LINE PARALLEL WITH THE NORTH LINE OF LOT 1, BROCK SECOND ADDITION TO THE NORTHERLY EXTENSION OF THE WEST LINE OF SAID LOT 1, BROCK SECOND ADDITION; THENCE SOUTH 00°49'05" EAST 150.08 FEET ALONG THE SAID NORTHERLY EXTENSION OF THE WEST LINE OF LOT 1 TO THE NORTHWEST CORNER OF SAID LOT 1, BROCK SECOND ADDITION; THENCE NORTH 89°10'40" EAST 400.01 FEET ALONG THE SAID NORTH LINE OF LOT 1 TO THE NORTHEAST CORNER SAID OF LOT 1; THENCE NORTH 00°49'05" WEST 150.08 FEET ALONG THE WEST LINE OF THE AFORESAID LOT 1, BROCK ADDITION TO THE POINT OF BEGINNING CONTAINING 60,032 SQUARE FEET (1.38 ACRES). WHEREAS, an offer to purchase said parcel of real property, in the amount of $50,000.00,has been made by Kwik Trip, Inc., and WHEREAS, a public hearing was held on November 21, 2022 at 5:30 p.m., as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey said premises owned by the City of Waterloo, Iowa, to Kwik Trip, Inc., and WHEREAS, it is the opinion of this Council that the sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The above described property located adjacent to 2122 West Ridgeway Avenue, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier November 14, 2022, is not presently needed, and will not be needed in the foreseeable future for municipal purposes, and its ownership is serving no municipal purpose. That the offer of Kwik Trip, Inc., to purchase said property located adjacent to 2122 West Ridgeway Avenue, in the City of Waterloo, Iowa, for the sum of $50,000.00, is hereby accepted, for the real property legally described above. 3. That the City of Waterloo, Iowa conveys said parcel of real property to Kwik Trip, Inc., by general warranty deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said general warranty deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Planning and Development Director is authorized and directed to deliver said deed of conveyance to Kwik Trip, Inc.,upon receipt of the sum of$50,000.00.
