No. 922 - 1.3.2023Supplemental Agreement No. 7 to the Hammond Ave. Bridge Replacement Project Professional Service Agreement between the City of Waterloo, Iowa and Wayne Claassen Engineering and Surveying, Inc. PROJECT: Hammond Avenue Bridge Replacement Project TO: Wayne Claassen Engineering and Surveying, Inc. (CES) FROM: City of Waterloo, Iowa You are hereby ordered to make the following changes to the existing Agreement for Professional Services for the Hammond Avenue Bridge Replacement project, dated 10/02/2017 1. Add the following to said existing Agreement: Part HI. TERMS AND CONDITIONS Article 1. ENGINEERING SERVICES 1.1 Basic Services - The Engineer agrees to perform professional services in connection with the Project, as set forth below and contained within this Agreement: A. Final Engineering Phase Task 19. Review and update structural construction plans to ensure compliance with current standards. This task will be completed by H.R. Green, as a sub -consultant to CES. Task 20. Addressing USACE 404 permit comments and questions. This task will be completed by H.R. Green, as a sub -consultant to CES. Task 21. Additional hydraulic modeling and exhibits for the CLOMR/LOMR. This task will be completed by H.R. Green, as a sub -consultant to CES. Task 22. Additional Engineering to design the new Hawkeye Community College field access and drainage way. Task 23 Review and update the remaining non-structural construction plans to ensure compliance with current standards Page 1 of 2 2. Settlement for cost of work to be made as follows: Tasks 19, 20 and 21. These tasks increase the Basic Services Amount by $29,800.00. Tasks 22 and 23. These tasks increase the Basic Services Amount by $15,000.00. The Professional Services Agreement is increased by $44,800 by this Supplemental Agreement 7 to a total of $263,350. 3. All other sections of said existing Agreement remain unchanged. PROFESSIONAL SERVICES AGREEMENT AMENDMENT NO. 4 THIS AMENDMENT, made this 6th day of December 2022 by and between, Wayne Claassen Engineering & Surveying, Inc. the CLIENT, and HR GREEN, INC. (hereafter "COMPANY"), for professional services concerning: Hammond Avenue Bridge Over Sink Creek Hydraulic Analysis COMPANY Project Number: 181817 hereby amends the original Professional Services Agreement dated 4/18/2019 as follows: The CLIENT and COMPANY agree to amend the Scope of Services of the original Professional Services Agreement and previous amendments as follows: GENERAL 1. Project Management as necessary to complete the tasks below. 2. Participate in up to 4 meetings to coordinate the tasks below with CLIENT and permitting agencies. STRUCTURAL DESIGN 1. Additional checks and design updates on existing structural design. The latest design is almost 3 years old and its use moving forward requires a full review and various updates to ensure compliance with current standards. USACE Permit 1. At this time, it is difficult to know how large a USACE 404 permit effort will be. It may simply be answering some questions to help the USACE reviewer better understand the project, or it may morph into a full streambank mitigation effort. Therefore, an initial allowance of $5,000 will be added to this contract, to cover this USACE 404 permit effort. Should this initial allowance be exceeded, COMPANY will provide a quotation prior to executing additional effort on this task. CLOMR/LOMR Effort 1. Notification of adjacent property owners affected by rise of FEMA 100-year Base Flood Elevation (BFE). New exhibit was required to show changes of floodplain and floodway and research of property and condominium owners. 2. Additional modelling work required by FEMA, but not anticipated in Amendment #3, to respond to CLOMR application comments, to include translating poor HEC2 data that did not match Flood Insurance Study. Updated set of box culvert plan sheets (Sheets V1-V13). 2. Deliverables associated with the USACE permit allowance. 3. Notification letters and exhibits for adjacent property owners (already provided). 4. Additional modelling work to recreate HEC2 model for CLOMR application (already provided). Items not Included The following items are not included as part of this AGREEMENT: 1. Any design/coordination activities associated with stream mitigation for the USACE permit. 2. Site visits by COMPANY staff. 3. Surveying 4. Floodway no -rise certification 5. Locating storm sewer system structures and outfalls 6. Evaluation of proposed condition alternatives 7. Additional modelling work not outlined in the scope of services 8. Additional responses, over and above the response to the first 2 rounds of DNR and FEMA reviews of the application packet. If additional responses are necessary for CLOMR/LOMR approval, the COMPANYs required time on these will be evaluated in detail and the AGREEMENT amended to right -size the effort. 9. Wetland Delineation(s). 10. The fee payable to FEMA that should accompany the submittal of the CLOMR and LOMR application packets. These fees are published by FEMA here: https://www.fema.gov/flood- maps/change-your-flood-zone/status/flood-map-related-fees. These are assumed to be paid by the CLIENT. 11. Additional planning or design of any improvements associated with the CLOMR/LOMR.
