The City of Waterloo, Iowa, a municipal corporation ("New Owner"), being the current
owner of record of certain property, commonly identified by Parcel Identification Numbers
8913-23-378-017, 8913-23-378-018, and 8913-23-455-001, and legally described as follows:
Lot 3, TechWorks Addition, Waterloo, Black Hawk County, Iowa; and Lot 1,
TechWorks Addition, Waterloo, Black Hawk County, Iowa, except Parcel "E" of
Plat of Survey Doc. #2013-8971; except Parcel "F" of Plat of Survey Doc. #2013-
19092, and amended in Doc. #2015-21270; except Parcel "G" of Plat of Survey
Doc. #2020-12244; and also except Parcel "I" of Plat of Survey Doc. #2022-
17202 (collectively, the "Transferred Property"),
acknowledges that it is aware of the Environmental Covenant affecting the Transferred Property
to which this acknowledgment is attached (the "Environmental Covenant"), and that New Owner
agrees that it has taken title to the Transferred Property subject to the Environmental Covenant.
New Owner desires to execute this Acknowledgment, Joinder and Consent to evidence its
intent to be bound by the Environmental Covenant and to join and consent in the covenants set
forth in the Environmental Covenant as current owner of the Transferred Property in order to
permit the Environmental Covenant to be recorded against the Transferred Property.
After the date hereof, all notices to "Grantor" with respect to the Transferred Property
shall be delivered to:
