PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date , time and place above set out. The tentative agenda for said meeting is as follows : Resolution of necessity for the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) . - Public hearing on proposed resolution of necessity. - Resolution amending resolution of necessity. - Resolution adopting resolution of necessity. - Resolution directing preparation of detailed plans and specifications , form of contract and notice to bidders . - Resolution ordering bids, approving plans , specifications and form of contract and related matters . Such additional matters as are set forth on the addi- tional pages(s ) attached hereto. IOWA (Contract No. 234 ) PART 1 -- HEARING PROCEEDINGS August 16 , 1982 The City Council of Waterloo, Iowa, met in regular session, in the Council Chambers , City Hall , Waterloo, Iowa, at 7:00 o'clock p, .M. , on the above date. There were present Mayor Pro Tem, Jack L. Roehr , in the chair, and the following named Council Members: Wilharm, Getty, Dowie and Burton. Absent: Penaluna and Bowers * * * * * * * The Mayor ProTem then called for objections to the adoption of the proposed Resolution of Necessity for the construction of the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) , in the corporation, pursuant to notice of the time and place of hearing duly published and mailed, and pursuant to prior action of said Council ; and announced to those pre- sent at said Council meeting that both written and oral objec- tions would be received and considered by the Council at this time. Written and oral objections were then received or heard. Council Member Burton moved that the time for the receiving of objections be closed. Seconded by Council Member Dowie . On vote, the motion was adopted. After reviewing all the objections received , the Council found and determined that no remonstrance , pursuant to the provisions of Section 384. 51 of the City Code of Iowa, was filed with the Council , pertaining to the proposed improvement as set out in said Resolution of Necessity as originally proposed. - 1 - AHLERS, COONEY, DORWEILER, HAYNIE&SMITH, LAWYERS, DES MOINES, IOWA PART 3B Council Member Getty introduced the following Resolution entitled "RESOLUTION ADOPTING RESOLUTION OF NECESSITY," and moved its adoption. Council Member Dowie seconded the motion to adopt. The roll was called and the vote was , AYES: Wilharm, Getty. Dowie and Burton. ABSENT: Penaluna and Bowers NAYS: None Whereupon, Mayor ProTem declared the following Resolution duly adopted: RES. NO. 1982-372 (CONTRACT NO. 234 ) RESOLUTION ADOPTING RESOLUTION OF NECESSITY BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the Resolution of Necessity introduced at a meeting of this Council on August 16 , 1982, (and a3 amended by Resolution of thi3 Council adopted on the day of , 1902 ) , for the construction of the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) , described in said Resolution of Necessity, notice having been given as required by law for hearing thereon, be and the same is hereby adopted and all objections filed have been fully considered and are hereby overruled. Council Member Burton seconded the motion to adopt. The roll was called and the vote was , AYES: Wilharm, Getty, Dowie and Burton ABSENT: Penaluna and Bowers NAYS: None Whereupon,Mayor Pro Temdeclared the following Resolution duly adopted: RES. NO. 1982-373 (CONTRACT NO. 234 ) RESOLUTION DIRECTING PREPARATION OF DETAILED PLANS AND SPECIFICATIONS , FORM OF CONTRACT AND NOTICE TO BIDDERS ON THE WATERLOO, IOWA, F.Y. 1983 PAVING PROGRAM (CONTRACT NO. 234 ) BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the City Engineering Department, is hereby ordered and directed to prepare and file with the Clerk detailed plans and specifications for the construction of the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) . BE IT FURTHER RESOLVED that the Attorney is hereby ordered and directed to prepare and file with the Clerk a Notice to Bidders and form of contract for the construction of the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) . NO. 1982-374 (CONTRACT NO. 234 ) RESOLUTION ORDERING BIDS, APPROVING PLANS, SPECIFICATIONS AND FORM OF CONTRACT AND NOTICE TO BIDDERS , FIXING AMOUNT OF BID SECURITY, AND ORDERING CLERK TO PUBLISH NOTICE AND FIXING A DATE FOR RECEIVING SAME , AND FOR A PUBLIC HEARING ON PLANS , SPECIFICATIONS , FORM OF CONTRACT AND ESTIMATE OF COSTS BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) , is hereby ordered to be advertised for bids for construction. BE IT FURTHER RESOLVED that the detailed plans and speci- fications as prepared by the City Engineering Department, Engineer for the project, for the construction of the Waterloo, Iowa, F.Y. 1983 Paving Program (Contract No. 234 ) , and the form of contract and Notice to Bidders , as approved by the Attorney, be and the same are hereby approved, subject to hearing thereon, and are hereby ordered placed on file in the office of the Clerk for public inspection. BE IT FURTHER RESOLVED, that the amount of the security to accompany each bid shall be in an amount which shall conform to the provisions of the notice to bidders hereby approved as a part of said specifications . - 8 - AHLERS, COONEY, DORWEILER. Publication shall be not less than four clear days nor more than twenty days prior to September 7 , 1982 , which latter date is hereby fixed as the date for receiving bids. Said bids are to be filed prior to 4:00 o'clock P .M. , on said date .
