A RESOLUTION AUTHORIZING THE CONDEMNATION OF A CERTAIN
PARCEL OF REAL PROPERTY FOR DEERE ROAD PROJECT
WHEREAS , the City of Waterloo, Iowa has undertaken the Deere Road
Project , and the parcel of land hereinafter described has been
appraised and an offer made to the owners of said property in the
amount of t116appraised value which has been concurred in by the Iowa
Department of Transportation , refused and funds are available with
which to pay , or the said parcel from City funds ; and
WHET AS; cthe acquisition of the hereinafter described real
property is necessary in connection with said Deere Road Project .
NOW , THEREFORE , IT IS HEREBY RESOLVED by the City Council of the
City of Waterloo, Iowa that the following described parcel of real be
property acggrired by condemnation in the manner provided by law, other
and such fLtx tper action as may be necessary to effect acquisition .

STREET RIGHT-OF-WAY
Part of the Southwest Quarter of the Southwest Quarter of
Section 32, Township 89 North , Range 13 West of the 5th
Principal Meridian in the City of Waterloo , black Hawk
County, Iowa ; as shown on the plat , Exhibit"A" , attached
hereto and by reference made a part hereof.
Said part of the Southwest Quarter of the Southwest Quarter
of Section 32 is described as follows : Commencing at the
Southwest corner of Section 32, T89N, R13W of the 5th P .M. in
Black Hawk County , Iowa ; thence along the West line of the
Southwest Quarter of the Southwest Quarter of said Setion 32 ,
North 00 degrees 00 ' East 345. 00 feet ; thence North 90 degrees
00' East 33. 00 feet to the existing East line of Deere Road, the
Point of Beginning ; thence South 82 degrees 20 ' East 47. 42 feet ;
thence parallel with the West line of said Southwest Quarter of
the Southwest Quarter, South 00 degrees 00 ' East 63. 82 feet to
the existing Northerly line of Ridgeway Avenue ; thence along said
Northerly line , North 82 degrees 20 ' West 47 . 42 feet to the East
line of Deere Road ; thence along said East line, North 00 degrees
00 ' East 63. 82 feet to the Point of Beginning ; containing 3 ,000
square feet.
Bearings are based on the West line of the Southwest
Quarter of the Southwest Quarter of Section 32, T89N, R13W of the
5th P .M. in Black Hawk County , Iowa , which is assumed to bear due
North .
TEMPORARY EASEMENT
A temporary easement (as shown on the plat , Exhibit "A" , attached
hereto and by reference made a part hereof) for the purpose of
reconstructing a driveway over the West 25 feet of the North 25
feet of:
That part of the Southwest Quarter of the Southwest Quarter
of Section No. Thirty-two ( 32 ) , Township No. Eighty-nine ( 89)
North , Range No. thirteen ( 13) West of the Fifth ( 5th ) Principal
Meridan , Black Hawk County , Iowa , bounded as follows : Commencing
at a point which is thirty-three (33) feet East of a point
Thirty-one ( 31 ) Rods North of the Southwest Corner of said
Section ; thence East to a point which is Twenty ( 20) Rods Sixteen
( 16) links East of the West line of said Section ; thence South to
the Northerly ine of the Public Highway established by Warranty
Deed filed November 20 , 1956 , and recorded in Book 118 of Land
Deeds at Page 483 of the records of the said county ; thence
Westerly along the Northerly line of said Road to a point which
is Thirty-three (33) feet East of the West line of said Section ;
thence North to the point of beginning, except the East One
Hundred (100) feet in width thereof.
Also , a temporary easement for the purpose of relocating a
drainage channel in part of the Southwest Quarter of the
Southwest quarter of Section 32 , Township 89 North , Range
13 West of the 5th Principal Meridian in the City of
Waterloo , Black Hawk County , Iowa ; as shown on the plat ,
Exhibit "A" , attached hereto and by reference made a part
hereof .

Southwest corner of Section 32 , T89N , R13W of the 5th P .M.
in black Hawk County, Iowa ; thence along the West line of
the Southwest Quarter of the Southwest Quarter of said
Section 32, North 00 degrees 00 ' East 400. 00 feet ; thence
North 90 degrees 00 ' East 33. 00 feet to the existing East
line of Deere Road, the Point of Beginning ; thence South 45
degrees 50 ' East 197 . 96 feet to the existing Northerly line
of Ridgeway Avenue, thence along said Northerly line, North
82 degrees 20 ' West 95. 86 feet ; thence North 00 degrees 00 '
East 63 .82 feet ; thence North 83 degrees 20 ' West 47 . 42
feet to the existing East line of Deere Road ; thence along
said East line, North 00 degrees 00 ' East 55. 00 feet to the
Point of Beginning.

PASSED AND ADOPTED by the City Council this 9th day of August ,
1982, and approved by the Mayor this 11th day of August , 1982 .
