RESOLUTION REGARDING FUTURE SEWERS AND STREETS
WHEREAS , the City of Waterloo and Wm. G. G . Miller and John
G. Mil`ter, hereafter called Millers , have entered into an
Xgreenent providing for the purchase by the City from Millers of
Wertatn land at Hackett Road and University Avenue in Waterloo ;
and
WHEREAS , millers have a Remainder portion of land adjoining
that part purchased by the City , all as shown by Exhibits A and B
which are attached hereto and made a part of this Resolution ; and
WHEREAS , it is to the best interest of the City and Millers
that the intention of the City and Millers as to future sewers and
sttreet ,with regard to the Remainder land be made a matter of
recorctL
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO , IOWA AS FOLLOWS :
That the City of Waterloo will allow the owners of the
Remainder land as shown by Exhibits A and B to develop the
property as allowed under the City of Waterloo Zoning Ordinance
No. 2479 , as amended.
2. That the owners of Remainder land will be permitted to
drain storm water wherever possible into the Hackett ditch and the
balance of storm drainage may be drained to the existing storm
sewer at St. Andrew Street and Sager Avenue.
3. That the owners of Remainder land may install sanitary
sewer into the City system and tie into sanitary sewer at Sager
Avenue between St . Andres Street and Delores Drive.
4. That City will provide an access street to Remainder
land from Hackett Road By-pass when it is constructed. Such
access street shall be subject to final design being capable of
providing said access street. However , the access street shall
not be arbitrarily deleted.
5. That all items above are subject to the final
development plan being designed in accordance with generally
accepted engineering practices and policies in effect at the time
of development and any City of Waterloo ordinance.
6. That the City would give preference for resale of the
property to the owner as allowed in the 1981 State Code of Iowa ,
Chapter 306 . 23 , Notice - Preference for Resale .
Passed and adopted this 14th day of June , 1982 .
