A RESOLUTION AUTHORIZING THE CONDEMNATION OF A CERTAIN
PARCEL OF REAL PROPERTY FOR THE HACKETT ROAD BY-PASS
WHEREAS, the City of Waterloo, Iowa has undertaken the Hackett Road
By-pass, and the parcel of land hereinafter described has been appraised
and an offer made to the owners of said property in the amount of the
appraised value which has been concurred in by the Iowa Department of
Transporation, refused and funds are available with which to pay for the
said parcel from Federal Aid to Urban Systems and City funds ; and
WHEREAS, the acquisition of the hereinafter described real property
is necessary in connection with the said H.R.B. Project.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Waterloo, Iowa that the following described parcel of real
property be acquired by condemnation in the manner provided by law, and
such other further action as may be necessary to effect acquisition.
LEGAL DESCRIPTION
All that part of the Southwest Quarter of Section 21 and the Northwest
Quarter of Section 28, all in Township 89 North, Range 13 West of the
Fifth Principal Meridian, City of Waterloo, Black Hawk County, Iowa,
described as follows :
Beginning at a point which is 50 feet east of a point which is
1 , 887 . 1 feet south of the Northwest corner of the Southwest Quarter
of said Section 21 ; THENCE east a distance of 580 feet; THENCE north
along the East line of the West 630 feet of the Southwest Quarter of
said Section 21 to the South line of an access road right-of-way as
described in Deed Record Book 483, page 331 ; THENCE southeasterly
along said access road right-of-way to a point which is 254 feet
normally distant west of the East line of the West half of the
Southwest Quarter of said Section 21 ; THENCE south parallel with the
East line of said West Half of the Southwest Quarter of said Section
21 to the westerly extension of the North line of Flower Street ;
THENCE North 89 degree , 39 feet, 52 inches west along the westerly
extension of the North line of Flower Street a distance of 230 feet;
THENCE South 43 degrees , 15 feet , 7 inches West a distance of 581 . 98
feet ; THENCE South 26 degrees , 52 feet, 17 inches West a distance of
201 . 06 feet; THENCE South 11 degrees , 42 feet, 21 inches West a
distance of 286. 76 feet to a point on the northerly line of Sager
Avenue (formerly Janney Avenue) which point is the Westerly end
(P.T. ) of a 323 foot radius curve as platted in Bel Air Heights ;
THENCE northwesterly along the Northerly line of Sager Avenue to a
point which is 50 feet east of the West line of the Southwest
Quarter of said Section 21 ; THENCE north along a line which is
parallel with the West line of the Southwest Quarter of said Section
21 to a point of beginning. Said are containing approximately 13. 9
acres of land.
NOTE : Bearings are based on the assumption the West line of the
Quarter of said Section 21 bears north and south.
PASSED AND ADOPTED by the City Council this 24th day of May, 1982,
and approved by the Mayor this 26th day of May, 1982.
