RESOLUTION NO. 1982-172
A RESOLUTION GRANTING PERMISSION TO CONSTRUCT
ONE (1) TEMPORARY ASPHALT DRIVEWAY AT 829 EAST
RIDGEWAY AVENUE, IRRESPECTIVE OF A LATER OFFICIAL
GRADE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
That,
WHEREAS , L.K. Riggs has made written application to the City
Council asking that he be authorized and permitted to construct
one (1 ) temporary asphalt driveway without respect to a permanent
sidewalk grade when and if the same may be subsequently set on 829
East Ridgeway Avenue known as Unplated Waterloo West, South, 248
feet of that part, SE 1/4 Section 35 T 89 R 13 Corn at Pt 223 .7
Feet East of Southwest Corner, SE said and Section TB N to PT 30
FT South of South line Block 10, Lincoln Heights and 224 .6 feet
East of West Line, SE TB E 224 .6 feet TM S to PT on South Line
Section 223 .7 feet East of DEC TB W to Beg Exc. West 75 feet and
Exc East 75 feet also exc street; and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted, now,
therefore,
BE IT FURTHER RESOLVED that permission is hereby granted to
L.K. Riggs to construct one (1 ) temporary asphalt driveway in
accordance with the existing contour of the abutting land with the
subjective understanding and agreement between the City of
Waterloo, Iowa, and the said L.K. Riggs that, should at a later
date a permanent formal grade be established for sidewalk purposes
or otherwise, that the said L.E. Riggs will immediately
thereafter, and at her own expense, remove all or whatever portion
of temporary asphalt driveway she may have constructed, and
rebuild or reconstruct the same in accordance with the permanent
grade as may hereafter be set and established, the work to be done
under the supervision of the City Engineer.
BE IT FURTHER RESOLVED, that the City Clerk is authorized
and directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk County
Auditor for filing in order that this said action may become a
matter of official County Record.
Passed and adopted this 10th day of May, 1982 .
