RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF
ARBOR STREET TO WATERLOO LUMBER FOR $800 . 00, PLUS COSTS
AND TO IOWA TERMINAL AND WAREHOUSE, INC. (KROBLIN
REFRIGERATED EXPRESS ) FOR $800 . 00, PLUS COSTS,
AUTHORIZING THE MAYOR PRO TEM AND CITY CLERK TO EXECUTE
AND DELIVER A DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said Arbor Street has been made
by Waterloo Lumber Company for the sum of $800 . 00, plus costs, and
Iowa Terminal and Warehouse, Inc. (Kroblin Refrigerated Express)
for $800 . 00 , plus costs, and
WHEREAS, a public hearing was held on January 9 , 1989, at
7 : 00 P.M. in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa to Waterloo Lumber Company and Iowa Terminal and
Warehouse, Inc. (Kroblin Refrigerated Express) , Waterloo, Iowa,
and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully
described in the published notice in the Waterloo Courier on
December 27 , 1989, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its ownership
is serving no municipal purpose, and
2 . That the offer of Waterloo Lumber Company to purchase
real property for the sum of $800 . 00 and costs be, and it is
hereby accepted for real property described below:
The south and southeasterly one-half of that street conveyed
to the City of Waterloo on July 3 , 1951 and known as Arbor
Street extending from the northeasterly line of Commercial
Street to a line 20 feet west of and parallel to the east
line of Lots 34 and 35 in South Waterloo Addition, said
street being 50 feet in width, all in the City of Waterloo,
Black Hawk County, Iowa;
with the City' s retention of a permanent utility easement over,
under and above the above described parcel; and
that the offer of Iowa Terminal and Warehouse, Inc. (Kroblin
Refrigerated Express ) to purchase real property for the sum of
$800 . 00 and costs be, and it is hereby accepted for real property
described below:

to the City of Waterloo on July 3 , 1951 and known as Arbor
Street extending from the northeasterly line of Commercial

4 . That the Mayor Pro Tem and City Clerk are hereby
authorized to execute and deliver deeds to Waterloo Lumber Company
and Iowa Terminal and Warehouse, Inc. (Kroblin Refrigerated
Express) .
5 . That the original of said deeds fully executed and
acknowledged is hereby approved and confirmed by the Council.
6. That the City Clerk is authorized and directed to
deliver said deeds of conveyance to Waterloo Lumber Company and
upon receipt of the sum of $800 . 00, and costs, and Iowa Terminal
and Warehouse, Inc. (Kroblin Refrigerated Express) upon receipt of
the sum of $800. 00, and costs.
