HomeMy WebLinkAbout1989-052-02.06.1989 RESOLUTION NO. 1989-52 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACTS FOR PERMANENT AND TEMPORARY EASEMENTS FOR PROPERTY TO CHAMBERLAIN MANUFACTURING CORPORATION AND ACCEPTING AND APPROVING CERTAIN EASEMENTS. WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels is necessary to Chamberlain Manufacturing Corporation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the permanent and temporary easements for the parcels hereinafter described to grant the same to Chamberlain Manufacturing Company of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor Pro Tem and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to grant the easements for the properties from the owners thereof, and the deeds for the conveyance of the same are also accepted and approved. The subject parcels are: Permanent Easement City of Waterloo Park Commission, Owner A 20 foot permanent easement for a storm sewer line over, under and across the land of the Waterloo Park Commission located in the SW 1/4 of S 13 T 89 R 13 West of the 5th P.M. Black Hawk County, Iowa. The easement being described as follows: Commencing at the SE corner of Lot 7 , Block 11, Logan Dale Heights Addition, thence East parallel to the South line of Lot 7 a distance of 7 . 00 ft; thence Southerly along the centerline of the alley in Block 11 , Logan Dale Heights Addition ( this line assumed to bear due north) extended a distance of 100 . 0 ft; thence due West a distance of 3 . 71 feet to the point of beginning; thence S 0 degrees 56 ' 49" W a distance of 28 . 26 ft; thence N 87 degrees 18 ' 54" E a distance of 670 . 65 ft; thence N 2 degrees 41 ' 06" W a distance of 20 . 0 ft; thence S 87 degrees 18 ' 54" W a distance of 649 . 37 ft; thence N 0 degrees 56 ' 49" E a distance of 7 . 74 ft; thence westerly to the point of beginning. Temporary Easement City of Waterloo Park Commission, Owner A temporary easement for the construction of a storm sewer line and all appurtenances being described as follows : Commencing at the SE corner of Lot 7 , Block 11, Logan Dale Heights Addition, thence West parallel to the South property line of Lot 7 a distance of eight ( 8 ) feet; thence Southerly parallel to the East property line of Lot 7 a distance of One Hundred ( 100 ) feet to the point of beginning; thence continuing along same said line a distance of Forty-three and Twenty-six Hundredths ( 43 . 26 ) feet; thence Easterly a distance of Six Hundred Eighty-five and Sixty-five Hundredths ( 685 . 65 ) feet to a point Seventy-six ( 76 ) feet South of the centerline of the existing CC & P mainline track; thence Northerly a distance of Seventy-six ( 76 ) feet to a point on Resolution No. 1989-52 Page 2 F-t o the centerline of the existing CC & P mainline track; thence h u' Westerly to the point of beginning, excluding all railroad n F right-of-way.
