FOR $737 . 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME AND REPEALING RESOLUTION NO. 1989-10 . WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase a portion of said Arbor Street in the sum of $737. 00, plus costs, has been made by Waterloo Lumber Company, and WHEREAS, an offer to purchase a portion of said Arbor Street in the sum of $737. 00, plus costs, has been made by Iowa Terminal and Warehouse, Inc. , and WHEREAS, a public hearing was held on February 27, 1989, at 7 : 00 P.M. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of thethe City of Waterloo, Iowa, on Waterloo proposallowa sell Waterloo cLumber premises awned by the City of Warehouse, Inc. , Waterloo, Iowa, and y d Iowa Terminal and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on February 10, 1989, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Waterloo Lumber Com an to purchase a portion of Arbor Street for the sum of $73 7 . 00 and costs, and it is hereby accepted for real property described below: The south and southeasterly one-half of the Street conveyed to the City of Waterloo on July 3 , Street extending from the northeasterly li1 ne knownof Commercial Street to a line 20 feet west of and parallel to the line of Lots 34 and 35 in South Addition,east recorded in Book 302 on pages 65 and 69, said street being 40 feet in width; all in the City of Waterloo, Black Hawk County, Iowa; with the City' s retention of a permanent utility easement over, under and above the above described parcel; and the offer of Iowa Terminal and Warehouse, Inc. to purchase a portion of Arbor Street for the sum of $737. 00 and costs, be and it is hereby accepted for real property described below: The north and northwesterly one-half of the Street conveyed to the City of Waterloo on July 3 , 1951 and Street extending from the northeasterly line knownof Commercior al Street to a line 20 feet west of and parallel to the line of Lots 34 and 35 in South Addition,east recorded in Book 302 on Pages 65 and 69 , said street being 40 feet in width; all in the City of Waterloo, Black Hawk County, Iowa; with the City' s retention of a permanent utility easement over, under and above the above described parcel. Resolution No. 1989-82 Page 2 3 . That the City of Waterloo, Iowa, convey said parcels of real property to Waterloo Lumber Company and Iowa Terminal and Warehouse, Inc. by Quit Claim Deed. 4 . That the Mayor and City Clerk are hereby authorized to execute and deliver deeds to Waterloo Lumber Company and Iowa Terminal and Warehouse, Inc. 5 . That the originals of said deeds fully executed and acknowledged are hereby approved and confirmed by the Council. 6 . That the City Clerk is authorized and directed to deliver said deeds of conveyance to Waterloo Lumber Company upon receipt of the sum of $737 . 00 , and costs, and Iowa Terminal and Warehouse, Inc. upon receipt of the sum of $737 . 00 , and costs . 7.
