HomeMy WebLinkAbout1989-083-02.27.1989 RESOLUTION NO. 1989-83 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF THE EAST 50 FEET OF LAPORTE ROAD RIGHT-OF-WAY FROM EAST SAN MARNAN DRIVE SOUTH 343 FEET TO PEOPLES BANK & TRUST COMPANY FOR $14 , 237 . 50 , PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $14 , 237. 50, plus costs, has been made by Peoples Bank & Trust Company, and WHEREAS, a public hearing was held on February 27 , 1989 , at 7: 00 P.M. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa to Peoples Bank & Trust Company, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on February 10 , 1989, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Peoples Bank & Trust Company to purchase real property for the sum of $14 , 237 . 50 and costs be, and it is hereby accepted for real property described below: A part of the Northeast Fractional Quarter of Section 2-88-13 West of the 5th Principal Meridian, Waterloo, Black Hawk County, Iowa, bounded as follows : Commencing at a point on the East line of said Section which is 500. 8 feet South of the Northeast corner of said Section; thence West along a line which is parallel with the North line of said Section a distance of 1091 . 87 feet to the centerline of the State Road; thence Southeasterly along the centerline of the State Road a distance of 555 . 83 feet; thence East along a line which is parallel with the North line of said Section a distance of 772 . 11 feet to the East line of said Section; thence North along the East line of said Section to the place of beginning. Except that part conveyed to the State of Iowa by Deed recorded in Book 111 of Land Deeds, Page 547, and except that part conveyed to the City of Waterloo, Iowa, by Deed recorded in Book 122 of Land Deeds, page 549 of the records of said County. And except all that part of a tract described in Book 422 , page 249, and except all that part of a tract described in Book 123 , page 461 of the Black Hawk County Recorder; subject to closing and receipt of monies within one ( 1 ) year. 3 . That the City of Waterloo, Iowa, convey said parcels of real property to Peoples Bank & Trust Company by Quit Claim Deed. Resolution No. 1989-83 Page 2 tTJtij c 0 4 . -) - That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Peoples Bank & Trust Company. H H 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. sHJ 6. - i That the City Clerk is authorized and directed to deliver said deed of conveyance to Peoples Bank & Trust Company upon receipt of the sum of $14 , 237 . 50, and costs. • m - PASSED AND ADOPTED this 27th day of February, 1989 .
