HomeMy WebLinkAbout1989-100-03.13.1989 t;E v RESOLUTION NO. 1989-100 t (\J c 0 C RESOLUTION AUTHORIZING THE CONDEMNATION OF A CERTAIN I PARCEL OF REAL PROPERTY FOR THE CLEVELAND STREET RECONSTRUCTION PROJECT, IX-6627 ( 1) --79-07 . o n WHEREAS, the City of Waterloo, Iowa, has undertaken the Cleveland Street Reconstruction Project, IX-6627 ( 1 ) --79-07 , and the parcel of land hereinafter described has been appraised and an offer made to the owner of said property in the amount of the appraised value and said offer has been refused; and WHEREAS, the acquisition, by Permanent Right-of-Way and Temporary Easement of the hereinafter described real property are necessary in connection with the said Cleveland Street Reconstruction Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the following described parcel of real property be acquired by condemnation in the manner provided by law, and such other further action as may be necessary to effect acquisition: Parcel No. 16 - Lois A. Clute, Owner Permanent Easement: The East 18 feet of Lots Nos . Three Hundred Twenty-four ( 324 ) , Three Hundred Twenty-five ( 325 ) , and Three Hundred Twenty-six ( 326 ) in Galloway, an addition to the City of Waterloo, Black Hawk County, Iowa. Containing approximately 2 , 160 S.F. Temporary Easement: The West 10 feet of the East 28 feet of Lots Nos. Three Hundred Twenty-four ( 324 ) , Three Hundred Twenty-five ( 325 ) , and Three Hundred Twenty-six ( 326 ) in Galloway, an addition to the City of Waterloo, Black Hawk County, Iowa. Containing approximately 1 , 200 S.F. NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that if the owners of said property and the City of Waterloo, Iowa, agree to a settlement prior to the time and date for commencement of condemnation proceedings, such further action relating to the condemnation shall be null and void and the Mayor and Clerk/Auditor be authorized and directed to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds.
