HomeMy WebLinkAbout1989-127-03.20.1989 RESOLUTION NO. 1989-127 RESOLUTION MAKING ASSESSMENT FOR STOPPING OF FLOW OF WATER AND PREVENTION OF FURTHER DAMAGE AT 922 MULBERRY STREET. WHEREAS, the Board of Water Works Trustees of the City of Waterloo, Iowa, did, as provided by law, notify by written notice the property owner of the premises known as 922 Mulberry Street to have the water flow stopped and further damage prevented, and WHEREAS, the property owner failed to comply with the order of the Board of Water Works Trustees as by law provided, and WHEREAS, the Board of Water Works Trustees proceeded to have the work done on the premises described as 922 Mulberry Street, in the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of the City of Waterloo, Iowa, and, WHEREAS, the Board of Water Works Trustees filed with the City Clerk on the 16th day of March, 1989, a report filing claim for the stopping of water and preventing further damage at above described premises and same meet all the requirements of the City ordinance and have been fully completed, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the said report of the Board of Water Works Trustees be, and the same is hereby, approved; that the work was done under and by virtue hereby, accepted, and that the cost of said work is hereby determined to be as follows, which amount can be assessed over a ten-year period against the property: First Federal Savings and Loan Association NKA Statesman Bank for Savings, Owners Diane K. Miller, Contract Buyer 922 Mulberry Street, Waterloo, Iowa Legal Description: The Northwesterly Thirty-nine ( 39 ) feet of the Southeasterly Ninety ( 90) feet of Lot No. One ( 1 ) ; the Northwesterly Five ( 5 ) feet of the Northeasterly Forty-three ( 43 ) feet of the Southeasterly Fifty-one ( 51 ) feet of Lot No. One ( 1) ; and the Northwesterly Thirty-nine ( 39) feet of the Southeasterly Ninety ( 90 ) feet of the Northeasterly Twenty ( 20) feet of Lot No. Four ( 4 ) , in Block No. Twenty-five ( 25) in the Original Plat on the East Side of the Cedar River, in the City of Waterloo, Black Hawk County, Iowa. Unpaid Assessment: $240 . 00 BE IT FURTHER RESOLVED that there be, and are hereby assessed and levied as special tax and assessment against the property improved, described as 922 Mulberry Street in the City of Waterloo, Iowa, the amount of $240 . 00 , said assessment shall bear interest from the date of levy of the assessment, viz : March 20 , 1989, at the rate of twelve ( 12 ) percent per annum until paid on all the unpaid amount of this assessment certified to the County Treasurer of Black Hawk County, Iowa, and BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby instructed to notify First Federal Savings and Loan Association, NKA Statesman Bank for Savings, Owner of said property and Diane K. Miller, Contract purchaser of said property, accordingly and also instructed to certify said assessment to the County Treasurer of Black Hawk County, Iowa, to be entered upon Resolution No. 1989-127 Page 2 the tax list to be collected as other taxes, as provided by law, and when collected to be credited to the Water Works Fund of said City, and assessment to be made over a ten-year period.
