RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION
CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND
ACCEPTING AND APPROVING CERTAIN DEEDS.
WHEREAS, the City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcels
is necessary to carry out Cleveland Street Right-of-Way,
IX-6627( 1 ) --79-07 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcel
hereinafter described to sell the same to the City of Waterloos
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the properties from the
owners thereof, and the deeds for the conveyance of the same are
also accepted and approved and the City of Waterloo is directed to
pay for the properties and the incidental expenses necessary to
the consummation of the sales from City funds .
The subject parcels are:
Parcel No. 11
Lawrence Meisner, 904 Cleveland Street
Partial Take - $10, 250. 00
All that part of Lot No. Three Hundred Seventy-seven ( 377 ) in
Galloway in the City of Waterloo, Iowa, described as follows:
Beginning at the Northeast corner of said Lot No. 377; thence
South along the East line of said Lot No. 377, a distance of
134 feet, to the Southeast corner thereof; thence North 69
degrees West along the South line of said Lot No. 377, a
distance of 35 . 35 feet; thence North 4 degrees East 130 . 86
feet to the North line of said Lot No. 377 ; thence
Southeasterly along said North line, a distance of 25. 7 feet
to the point of beginning.
Containing approximately 3 , 819 S.F.
Temporary Easement:
All that part of Lot No. Three Hundred Seventy-seven ( 377)
and Three Hundred Seventy-six ( 376 ) in Galloway in the City
of Waterloo, Iowa, being a strip of land 10 feet in width and
described as follows:
Beginning at a point on the North line of said Lot No. 377
being 25 . 7 feet Northwesterly of the Northeast corner
thereof; thence South 4 degrees West 130 . 86 feet to the South
line of said Lot No. 377; thence North 69 degrees West along
the said South line, a distance of 10. 7 feet; thence North 4
degrees East 130. 86 feet to the North line of said Lot No.
376; thence Southeasterly along said North line, a distance
of 10 . 7 feet to the point of beginning.
