HomeMy WebLinkAbout1989-263-06.05.1989 RESOLUTION NO. 1989-263 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF LAPORTE ROAD RIGHT-OF-WAY SOUTH OF SAN MARNAN DRIVE TO PEOPLES BANK AND TRUST COMPANY FOR $13 , 739. 40 , PLUS COSTS AND AUTHORIZING THE MAYOR AND DEPUTY CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME, AND REPEALING RESOLUTION NO. 1989-83 IN ITS ENTIRETY. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $13 ,739 . 40 , plus costs, has been made by Peoples Bank and Trust Company, and WHEREAS, a public hearing was held on May 22 , 1989 , at 7 : 00 P.M. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa to Peoples Bank and Trust Company, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on May 12 , 1989 , is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Peoples Bank and Trust Company to purchase real property for the sum of $13 ,739. 40 , plus costs be, and it is hereby accepted for real property described below: A part of the Northeast Fractional Quarter of Section 2 , Township 88 North, Range 13 West of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows: That part of said Northeast Fractional Quarter conveyed to the City of Waterloo by Quit Claim recorded in Deed Record Book 122 , page 549 except that part thereof described as follows: Beginning at a point on the Northeasterly right of way line of LaPorte Road ( formerly known as U.S. Highway No. 218 ) which is 500 . 8 feet south of the North line and 1023 . 6 feet West of the East line of said Northeast Fractional Quarter, said point being 60 feet normally distant Northeasterly from the centerline of said LaPorte Road; thence North 90° East parallel to the North line of said Northeast Fractional Quarter a distance of 61 . 35 feet to a point which is 110 feet normally distant from the centerline of said LaPorte Road; thence South 35°20 ' 30" East parallel with and 110 feet normally distant from said centerline a distance of 213 . 8 feet; thence South 48°34 ' 30" West a distance of 50 . 28 feet to a point which is 60 feet normally distant from said centerline; thence North 35°20 ' 30" West parallel with and 60 feet normally distant from said centerline a distance of 254 . 59 feet to the point of beginning. Said parcel contains 16 , 164 sq. ft. , more or less . 3 . That the City of Waterloo, Iowa, convey said parcel of real property to Peoples Bank and Trust Company by Quit Claim Deed. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6 . That the Deputy City Clerk is authorized and directed to deliver said deed of conveyance to Peoples Bank and Trust Company upon receipt of the sum of $13 , 739 . 40 , and costs . 7 .
