RESOLUTION GRANTING PERMISSION TO ROBERT THOMPSON AND
AUTHORIZING CONSTRUCTION OF ONE ( 1 ) TEMPORARY CONCRETE
DRIVEWAY IRRESPECTIVE OF A LATER OFFICIAL GRADE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that:
WHEREAS, Richard Thompson has made written application to
the City Council asking that he be authorized and permitted to
construct one ( 1) temporary concrete driveway without respect to
a permanent sidewalk grade when and if the same may be
subsequently set on 105 Broadway and legally described as
follows:
Part of Lots 50 & 51 beg at a pt on SELY line of lot 51
which is 75 ft SWLY from ELY cor Lot 51 th NWLY along a
straight line to a pt on SWLY line of the NELY 54 ft Lot 51
which pt is 25 ft NWLY from SWLY line of said Lot 51 th NWLY
along SWLY line NELY 54 ft of Lot 51 to NW line of Lot 51 th
SWLY along NWLY line Lots 51 & 50 to the WLY cor Lot 50 th
SELY along SWLY line Lot 50 to SLY cor Lot 50 th NELY along
SELY line of said lots to pt of beg SELY line of said lots
to the pt of beg in Morris Cases Addition all in the City of
Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Robert Thompson to construct one ( 1) temporary
concrete driveway in accordance with the existing contour of the
abutting land with the subjective understanding and agreement
between the City of Waterloo, Iowa, and the said Robert Thompson
that, should at a later date a permanent formal grade be
established for sidewalk purposes or otherwise, that the said
Robert Thompson will immediately thereafter, and at his own
expense, remove all or whatever portion of temporary concrete
driveway he may have constructed, and rebuild or reconstruct the
same in accordance with the permanent grade as may hereafter be
set and established, the work to be done under the supervision of
the City Engineer.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
PASSED AND ADOPTED this 7th day of August, 1989.
