RESOLUTION APPROVING AGREEMENT WITH ALABAR PLAZA, INC.

WHEREAS, the property lying adjacent to and abutting the
easterly portion of Linbud Lane is necessary to carry out the FY
1989 Lindbud Lane Paving, Contract No. 358, and
WHEREAS, Alabar Plaza, Inc. has agreed to sell the easterly
portion of Linbud Lane for public right-of-way to the City of
Waterloo for the sum of $23 ,200. 00, and
WHEREAS, it is the opinion of this Council that purchase
"' -'should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described property is needed for the
widening and paving of Linbud Lane in conjunction with FY 1989
Linbud Lane Paving, Contract No. 358.
2. Alabar Plaza, Inc. has agreed to convey to the City of
Waterloo, in consideration of the receipt of said $23 ,200.00, a
warranty deed for real property described below:
The West Thirty ( 30. 0) feet of that part of the Southwest
Quarter of the Southeast Quarter of Section No. Twenty-one
( 21) , Township No. Eighty-nine (89) North, Range No.
Thirteen ( 13 ) West of the Fifth Principal Meridian in
Waterloo, Iowa, described as follows:
Commencing at a point Thirty and Six Hundredths (30. 06) feet
North of the Southwest corner of said Southeast Quarter;
thence North Two Hundred Eighty-six and Twenty-nine
Hundredths ( 286.29) feet; thence East Three Hundred Five
( 305) feet; thence South Two Hundred Eighty-six and
Twenty-nine Hundredths (286. 29) feet; thence West Three
Hundred Three and Eight Tenths ( 303 .8) feet to the point of
beginning;
Except that part thereof conveyed by Deeds recorded in Book
452, pages 110, 111, 113 , 115, and 117 of the records of
Black Hawk County, Iowa.
This parcel contains 15,445 square feet.
3 . Alabar Plaza, Inc. agrees to pay the full cost of public
improvement, which payment shall be made as a special assessment.
PASSED AND ADOPTED this 7th day of August, 1989.
