o. O RESOLUTION APPROVING TRANSFER OF OWNERSHIP OF THE CEDAR
• s o RIVER DAM LOCATED AT THE PARK AVENUE BRIDGE TO THE CITY
OF WATERLOO, IOWA.

WHEREAS, the Cedar River Dam, located at the Park Avenue
° �-Bridge, and owned by Iowa Public Service, is no longer needed for
0, operation of the Maynard Station Electric Plant due to the
Plant' s closing; and
WHEREAS, Iowa Public Service has proposed transferring
ownership of said Dam to the City of Waterloo, Iowa, with the
understanding that Iowa Public Service will convey ownership of
the facility in good repair so that it will be maintenance free
in the future; and
WHEREAS, Iowa Public Service proposes to beautify the
, facility before transfer of ownership of said Dam to the City of
Waterloo by pulling out all equipment now located at the site,
including removal of all towers and buildings, all cable and the
cable car, and all the boards and equipment associated with
putting up and taking down the boards and building a permanent
two-foot cement cap on the top of the dam which would increase
� the water level behind the dam to a permanent elevation two feet

above the present level.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE
w nCITY OF WATERLOO, IOWA, that conveyance of the Cedar River Dam,
M -4located at the Park Avenue Bridge, in the City of Waterloo, Iowa,
• upon completion of said repairs by Iowa Public Service, be and
d the same is hereby approved.
PASSED AND ADOPTED this 14th day of August, 1989.
