INSTRUCTING THE DEPUTY CITY CLERK TO PUBLISH THE NOTICE

" E• :11 `:. F$E IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
• as follows:
Section 1. That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 7: 00 p.m. on the 28th day of August, 1989, for the
purpose of considering and acting upon a proposal to sell and
convey a portion of vacated Easton Avenue located between
I-380/218 and Texas Street owned by the City of Waterloo, Iowa,
to Dave Hershberger, and legally described as follows:
That portion of the sixty-six ( 66) foot right of way lying
east of I-380 and westerly of a line one hundred ( 100) feet
southwesterly of and parallel to the westerly line of Iowa
Northern Railway.With the City' s retention of an easement over, under and
i- above the below described property:
The northerly twenty (20) feet of vacated Easton Avenue
lying easterly of I-380 and westerly of a line one hundred
( 100) feet westerly of and parallel to the westerly line of
the Iowa Northern Railroad, and
Commencing at the point of intersection of the northerly
line of vacated Easton Avenue and the easterly line of
1-380, thence N 89°13 ' 30" E 341. 53 feet to the point of
beginning, thence S 21°10 ' E to the centerline of vacated
Easton Avenue, thence south perpendicular to the right of
way of vacated Easton Avenue 33 feet to the south line of
vacated Easton Avenue, thence N 89°13 ' 30" E 43 . 17 feet,
along said line, thence north perpendicular to the last
described course 33 ' to the centerline of vacated Easton
Avenue, thence N 21°10 ' W to the North Line of vacated
Easton Avenue, thence west 43 . 17 feet to the point of
beginning, all in the City of Waterloo, Black Hawk County,
Iowa;
for $11, 073.70, plus costs.
Section 2. That the Deputy City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 14th day of August, 1989.
