RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND
NOTICE TO BE GIVEN ON THE VACATION, SALE AND CONVEYANCE
OF THE EASTERLY FIFTEEN ( 15) FEET OF LAPORTE ROAD, AS
OCTOBER 9, 1989, AT 7: 00 P.M. IN CITY HALL COUNCIL
CHAMBERS, WATERLOO, IOWA, AND INSTRUCTING THE CITY
CLERK TO PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
Section 1. That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 7: 00 p.m. on the 9th day of October, 1989, for the
purpose of considering and acting upon a proposal to vacate, sell
and convey the easterly fifteen ( 15 ) feet of LaPorte Road, owned
by the City of Waterloo, Iowa, to Dick Witham Crossroads Ford,
and legally described as follows:
A parcel of land located in the E 1/2 of Section 2-88-13 ,
Waterloo, Black Hawk County, Iowa described as follows:
Commencing at the intersection of the Northwesterly
right-of-way line of Bopp Street and the northeasterly
right-of-way line of LaPorte Road; thence S 54°39 ' 30" W a
distance of 15 . 00 feet; thence N 35°20 ' 30" W along a line
parallel with and 30. 00 feet normally distant from the
center line of LaPorte Road a distance of 883 . 70 feet;
thence N 89°55 ' 30" E a distance of 18. 30 feet; thence S
35°20 ' 30" E a distance of 873 . 09 feet to the point of
beginning.
The center line of LaPorte Road is assumed to bear N
35°20 ' 30" W.
Said parcel contains 13 ,175. 87 sq. ft;
with the City' s retention of a permanent utility easement over,
under and above the above described parcel;
for $17, 196. 00, plus costs.
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 18th day of September, 1989 .
