RESOLUTION DEDICATING THE FORMER CHICAGO AND NORTH
WESTERN TRANSPORTATION COMPANY RIGHT-OF-WAY ALONG U.S.
HIGHWAY 63, EXTENDING FROM UNIVERSITY AVENUE TO WEST
SHAULIS ROAD, FOR PUBLIC RIGHT-OF-WAY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, that the following legally described real property be and
the same is hereby dedicated as public right-of-way for bikeway
purposes:
A strip of land 100 feet in width, being 50 feet in width on
each side of the center line of the main track (now removed)
of the Wisconsin, Iowa and Nebraska Railway Company ( later
the Chicago Great Western Railway Company, now the Chicago
and North Western Transportation Company) , as said main
track was originally located and established over and across
the following described lands: Beginning at a point (pile
Post 323 .74 ) in the Northeast Quarter of the Northeast
Quarter of Section 27 , Township 89 North, Range 13 West of
the Fifth Principal meridian, distant 300 feet Southwesterly
from the intersection of said original main track center
line with the center line of University Avenue (U.S. Highway
218) ; then Southwesterly over and across said Northeast
Quarter of the Northeast Quarter, the South Half of the
Northeast Quarter, the Northwest Quarter of the Southeast
Quarter, the East Half of the Southwest Quarter and the
Southwest Quarter of the Southwest Quarter of Section 27,
the Southeast Quarter of the Southeast Quarter ( if any) of
Section 28, the Northwest Quarter of the Northwest Quarter
of Section 34, the North Half of the Northeast Quarter, the
Southwest Quarter of the Northeast Quarter, the Southeast
Quarter of the Northwest Quarter, the Northeast Quarter of
the Southwest Quarter and the West Half of the Southwest
Quarter of Section 33 , all in Township 89 North, Range 13
West of the Fifth Principal Meridian; thence continuing
Southwesterly over and across the Northwest Quarter of the
Northwest Quarter of Section 5 , the East Half of the
Northeast Quarter, the Northeast Quarter of the Southeast
Quarter, the West Half of the Southeast Quarter and the
Southeast Quarter of the Southwest Quarter of Section 6, the
East Half of the Northwest Quarter, the Southwest Quarter of
the Northwest Quarter and the Northwest Quarter of the
Southwest Quarter and the Southwest Quarter of the Southwest
Quarter ( if any) of Section 7 and the East Half of the
Southeast Quarter of Section 12, all in Township 88 North,
Range 14 West of the Fifth Principal Meridian, to the South
line of said Section 12, being also the center line of West
Shaulis Road, and there terminating.
PASSED AND ADOPTED this 18th day of September, 1989.
